Kendig, City Attorney Mayor Puckett acknowledged Tustin Unified School District Board Members in attendance: Francine Scinto, President, Lynn Davis, Vice President, James H. Laird, Member and Tammie Bullard, Board Member. City Council August 25, 2015 Special Meeting Minutes Page 1 of 3 PUBLIC INPUT — None REGULAR BUSINESS ITEM 1. APPROVE SCHOOL FACILITIES IMPLEMENTATION, FUNDING AND MITIGATION AGREEMENT WITH TUSTIN UNIFIED SCHOOL DISTRICT. APPROVE SITE CONVEYANCE AGREEMENT WITH TUSTIN UNIFIED SCHOOL DISTRICT. APPROVE JOINT COMMUNITY FACILITIES AGREEMENT WITH TUSTIN UNIFIED SCHOOL DISTRICT AND STANDARD PACIFIC CORPORATION. AUTHORIZE CITY MANAGER TO EXECUTE ALL AGREEMENTS AND ANY OTHER DOCUMENTS NECESSARY TO IMPLEMENT THE AGREEMENTS CONSISTENT WITH THE CITY COUNCIL'S APPROVALS, INCLUDING THE GRANT DEED CONVEYING SITE NO. 2 OR AN ALTERNATIVE SITE, TO TUSTIN UNIFIED SCHOOL DISTRICT. City Manager Jeffrey C. Parker provided a verbal presentation regarding the project background. City Manager Jeffrey C. Parker thanked Superintendent Dr. Gregory A. Franklin and Chief Financial Officer Anthony Soria. In 2013, the City and the Tustin Unified School District (TUSD) reinstated discussions on how to establish a financial plan, development plan, and implementation schedule for 6-12 schools within Tustin Legacy. Approval of the school facilities implementation, funding and mitigation agreement, the approval of the site conveyance agreement, and the joint community facilities agreement with TUSD and Standard Pacific will provide the framework for development of grades 6-12 schools on the 40 -acre designated site, along with the opening of Heritage Elementary School as a magnet elementary site in the fall of 2016. It was moved by Councilmember Murray and seconded by Councilmember Bersntein the the City Council 1. Approve Resolution 15-54 authorizing the City Manager to execute all agreements and documents referenced therein, including conveying site No. 2, or an alternative site, to TUSD as and when required by the agreements. 2. Appropriate $4 million of funds from land sale proceeds or CFD 14-1 bond proceeds to meet our October 2015 timeline to ensure Heritage City Council August 25, 2015 Special Meeting Minutes Page 2 of 3 Elementary is opened for the 2016-17 school year. Motion carried: 4-0 RESOLUTION NO. 15-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE ALL AGREEMENTS AND ANY OTHER DOCUMENTS NECESSARY TO IMPLEMENT THE AGREEMENTS CONSISTENT WITH THE CITY COUNCIL'S APPROVALS TO TUSTIN UNIFIED SCHOOL DISTRICT City Manager Jeffrey C. Parker thanked City Attorney David E. Kendig, Deputy City Attorney David A. DeBerry, Director of Community Development Elizabeth A. Binsack, and Director of Public Works Douglas S. Stack for their assistance with the project. On behalf of Councilmember Gomez, City Manager Jeffrey C. Parker acknowledged the efforts made by the sub -committee, Council, Tustin Unified School Board, staff and noted she is very pleased to see this project move forward.
