DEPARTMENT OF THE INTERIOR (DOI) APPLICATION FOR PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY RECOMMENDATION It is recommended that the City Council adopt Resolution No. 94-26, approving an application to the U.S. Department of the Interior (DoI) for the public benefit transfer of surplus Federal real property (MCAS, Tustin) for parks/recreational use by the City. FISCAL IMPACT The application requesting the transfer of surplus property from MCAS, Tustin for public benefit will not result in an immediate fiscal impact to the City of Tustin. Between the time of application approval (estimated early 1995) to the time that formal property acquisition would occur (estimated in mid-1997), a complete fiscal analysis would be prepared for the Council's consideration and approval. The application requests conveyance of a variety of recreational facilities at no cost to the City. However, each application is reviewed by the DoI. Based upon their evaluation, final transfer of the property by the Department of the Navy could resul, t in the City being given the opportunity to acquire the.facilities. BACKGROUND/DISCUSSION As Council is aware, Marine Corps Air Station (MCAS), Tustin is scheduled to close by July 1997. In compliance with federal base closure law, the Navy has recently begun the process of advertising the property for future conveyance to military branches, federal agencies, and state and local entities. On October 20, 1993, the City of Tustin responded to the Navy's state and local screening effort by indicating a wide range of potential future interest in property and facilities at the base. Base disposal law provides the above referenced agencies an opportunity to acquire property at closing military bases for below market value or for free when certain categories of public benefit can be shown. In response to the City's October 20, 1993 letter of interest, the federal Department of the Interior (DoI) requested that a formal application be submitted which detailed the City's interest in • City Council Report DoI Application February 22, 1994 Page 2 • future recreational reuses of the property and identified the specific public benefit which would occur from the transfer As a result, staff received a formal application which is required to be submitted by February 26 1994 A portion of the application requires the City Council to adopt a resolution authorizing the City s application and designate an authorized individual to act on behalf of the City Resolution 94 -26 has been prepared in accordance with DoI requirements to indicate this support and if approved by Council, will be forwarded to the DoI as part of the application Public benefit transfer of this property would allow the City to potentially obtain the land and facilities at below market cost However, the City will not be obligated to make a commitment to take control of the property until such time that the U S Secretary of the Navy notifies the City of acceptance of its request It is important for the City to participate in this phase of the Federal screening process to ensure that base properties with potential public parks /recreational re -use value are made available for potential acquisition The subject site is a 25 -acre portion of the base as shown in Attachment A It is comprised of existing Marine Corps recreational facilities, buildings, and land area The facilities would be potentially suitable for re -use and include two softball fields, three tennis courts, a soccer field, a football field, picnic areas, playground equipment, a basketball court, and volleyball courts The subject site also contains within its boundary the existing officer's club, a youth center a weight room and racquet ball courts A preliminary Site Development Plan that was required as part of the application package has been provided as Attachment B CONCLUSION Since submission of the request to the DoI does not obligate the City at this time but provides an opportunity for future public benefit conveyance, it is recommended that the City Council adopt Resolution No 94- _ submitted ne E Bonner Associate Planner ab \CCREPORT \doiapp. aeb Attachments Resolution No 94 -26 . it / !.i —A-d tic ristine A Sh Assistant City gleton anager .gNIAI~I =fO ,~ZI,,3 ATTACHMENT A z I ! I.U k'- Z 0 ATTACHMENT B 1 RESOLUTION NO. 94-26 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN APPLICATION BY THE CITY OF TUSTIN TO THE U.S. DEPARTMENT OF THE INTERIOR FOR THE PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY FOR PARKS/RECREATIONAL USE The City Council of the City of Tustin does hereby resolve as follows: WHEREAS, certain real property owned by the United States of America, located in the City of Tustin, County of Orange, State of California, has been declared surplus and at the discretion of the General Services Administration, may be assigned to the Secretary of the Interior for disposal for public park or recreation purposes, under the provisions of Section 203(k) (2) of the Federal Property and Administrative Services Act of 1949 (63 Stat. 387), as amended, and rules and regulations promulgated pursuant thereto, more particularly described as follows: (1) Marine Air Corps Station (MCAS), Tustin (2) GSA Control Number: not assigned (3) Approximately 25 acres WHEREAS, the City of Tustin, needs and will utilize said property in perpetuity for a public park or recreation area as set forth in its application and in accordance with the requirements of said Act and the rules and regulations promulgated thereunder; NOW, THEREFORE, BE IT RESOLVED, that the City of Tustin shall make application to the Secretary of the Interior for and secure the transfer to it of the above mentioned property for said use upon and subject to such exceptions, reservations, terms, covenants, agreements, conditions, and restrictions as the Secretary of the Interior, or his authorized representative, may require in connection with the disposal of said property under said Act and the rules and-- regulations issued pursuant thereto; and BE IT FURTHER RESOLVED, that the City of Tustin has legal authority, is willing and is in a position to assume immediate care and maintenance of the property, and that William A. Huston, City Manager, or his designee, is hereby authorized, for and on behalf of the City of Tustin to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the preparing, making, and filing of plans, applications, reports, and other documents, the execution, acceptance, delivery, and recordation of agreements, deeds, and other instruments pertaining to the 10 1t 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 94-26 Page 2 trans=er of said property, including the filing of copies of the application and the conveyance documents in the records of the governing body, and the payment of any and all sums necessary on account of the purchase price thereof or fees or costs incurred in connection with the transfer of said propersy for survey, title searches, recordation or instruments, or other costs identified with the Federal surplus property acquisition.
