There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. · RESOLUTION NO. 94-22- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT, FY 1993-94 Recommendation: Adopt Resolution No. 94-22 approving plans and specifications and authorizing advertisement for bids for subject project as recommended by the Public Works Department/Engineering Division. m APPROVAL OF MINUTES- JANUARY 17, 1994 REGULAR MEETING Recommendation: Approve the City Council Minutes of January 17, 1994. 3, APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,461,812.85 and ratify Payroll in the amount of $623,425.93. · SOUTHERN CALIFORNIA EDISON COMPANY EASEMENT WITHIN LOT 22 OF TRACT 13627 Recommendation: Authorize the Mayor to execute subject Grant of Easement as recommended by the Public Works Department/Engineering Division. OF BONDS FOR TRACT NO. 14567 Recommendation: Authorize the release of the following bonds for the indicated amounts: Faithful Performance Bond No. 111 2715 4000, $20,060.40; Labor and Materials Bond No. 111 2715 4000, $10,030.20; and Monumentation Bond No. 111 2715 4018, $7,000.00 as recommended by the Public Works Department/Engineering Division. ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE OF BONDS FOR TRACT NO. 14610 Recommendation: Authorize the release of the following bonds for the indicated amounts: Faithful Performance Bond No. 10-96-69, $555,000.00; Labor and Materials Bond No. 10-96-69P, $277,500.00; and Monumentation Bond No. 10-96- 68, $5,000.00 as recommended by the Public Works Department/Engineering Division. COOPERATIVE AGREEMENT FOR THE RECONSTRUCTION OF THE SEVENTEENTH STREET OVERCROSSING AT SR-55 FREEWAY Recommendation: Approve subject agreement and authorize the Mayor and City Clerk to execute subject agreement as recommended by the .Public Works Department/Engineering Division. RESOLUTION NO. 94-21 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR PHASE III REGIONAL TRAILS, ASSESSMENT DISTRICT NO. 86-2 Recommendation: Adopt Resolution No. 94-21 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. CLOSED SESSION ACTION- January 3, 1994 Recommendation: Receive and file action statement from City Council Closed Session held January 3, 1994 as recommended by the City Attorney. PLANNING COMMISSION ACTION AGENDA- JANUARY 24, 1994 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of January 24, 1994. AGREEMENT WITH COUNTY OF ORANGE FOR TRAFFIC SIGNAL MODIFICATION AT RED HILL AVENUE AND IRVINE BOULEVARD Recommendation: Approve and authorize the Mayor and City Clerk to execute subject agreement as recommended by the Public Works Department/Engineering Division. AWARD OF GRAFFITI REWARD Recommendation: Award a $250.00 reward out of non-departmental funds to an anonymous witness for her actions leading to the issuance of citations to graffiti vandals as recommended by the Community Development Department. INVESTMENT REPORT AS OF NOVEMBER 30, 1993 AND DECEMBER 31, 1993 Recommendation: Receive and file subject report as recommended by the Finance Department. REGULAR BUSINESS (ITEMS 15 THROUGH 24 ) 1,5. CITY OF TUSTIN GENERAL PLAN REVISION AND FINAL PROGRAM ENVIRONMENTAL IMPACT REPORT On January 17, 1994, the City Council held a public hearing and accepted testimony on the City of Tustin Draft General Plan. Recommendation by the Community Development Department: a, Adopt the following Resolution No. 94-18 finding that the Environmental Impact Report (SCH #92101104) prepared for the Tustin Area General Plan Update is adequate with the incorporation of all responses to certifying Final Program Environmental Impact Report 94-01 and adopting a Mitigation Monitoring Program: RESOLUTION NO. 94-18 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE ENVIRONMENTAL IMPACT REPORT 94-01 (SCH #92101104) PREPARED FOR THE CITY OF TUSTIN GENERAL PLAN IS ADEQUATE WITH THE INCORPORATION OF ALL RESPONSES TO COMMENTS, CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT 94-01 AND ADOPTING A MITIGATION MONITORING PROGRAM bi Adopt the following Resolution No. 94-19 approving General Plan Amendment 94-01, with incorporation of the Errata to General Plan documents, updating all Elements of the Tustin Area General Plan: RESOLUTION NO. 94-19 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 94- 01, UPDATING ALL ELEMENTS OF THE TUSTIN AREA GENERAL PLAN 16. AWARD OF BID FOR CONSTRUCTION OF THE TUSTIN SPORTS PARK On November 15, 1993, the City Council approved plans and specifications and authorized advertisement for bids for the construction of the Tustin Sports Park. Recommendation: Award a contract for the construction of the Tustin Sports Park to E.A. Mendoza Contractors of Buena Park in the amount of $2,625,288.00 as recommended by the Community Services Department. 17. BUSINESS LICENSE AMNESTY PROGRAM At the January 17, 1994 City Council meeting, Councilmember Thomas requested staff to provide a report on the possibility of reinitiating a Business License Amnesty Program. Recommendation: That the following Ordinance No. 1120, declaring a Business License Program during the months of April, May and June 1994, have first reading by title only and introduction as recommended by the Community Development Department: ORDINANCE NO. 1120 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING A BUSINESS LICENSE AMNESTY PROGRAM DURING THE MONTHS OF APRIL, MAY AND JUNE, 1994 DECLARATION OF SURPLUS Inventory of all furniture remaining at the Del Arno facility that is currently in excess of any relocation and redesign needs for the Civic Center Expansion Project. Recommendation: Declare the furniture/equipment detailed in the report and not required for public use as surplus and authorize the City's purchasing agent to dispose of the items in accordance with Ordinance No. 871 as recommended by the Community Development Department. REQUEST THAT TUSTIN JOIN IN AN AMICI CURIAE BRIEF The City has received a request that Tustin join as a "friend of the Court" in support of the position of cities, fire districts, etc. regarding the attempts of some counties to preempt the providing of ambulance services county-wide through a contract between the county and a private ambulance company. Recommendation: Pleasure of the City Council. AMENDMENT OF ORDINANCE CONCERNING DOGS IN PARKS The Community Services Department has received a letter from a Tustin Sports Park neighbor regarding the prohibition of dogs in parks. Recommendation: Have first reading by title only and introduction of the following Ordinance No. 1121 approving dogs in parks under specified conditions as recommended by the Parks and Recreation Commission and the Community Services Department: ORDINANCE NO. 1121 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF THE TUSTIN CITY CODE TO PERMIT DOGS IN PARKS UNDER SPECIFIED CONDITIONS Council Agenda 4 February 9, 1994 22. U.S. DEPARTMENT :THE INTERIOR (DOI) APPLICA', N FOR PUBLIC BENEFIT TRANSFER - COUNTY OF ORANGE (URBAN REGIONAL PARK) Base disposal law provides specified agencies an opportunity to acquire property at closing bases for below market value or for free when certain categories of public benefit can be shown. Recommendation: Adopt the following Resolution No. 94-20 supporting an application to the U.S. Department of the Interior by the County of Orange for the public benefit transfer of surplus federal real property (MCAS-Tustin) for use as an Urban/Regional Park as recommended by the Community Development Department: RESOLUTION NO. 94-20 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SUPPORTING AN APPLICATION BY THE COUNTY OF ORANGE TO THE U.S. DEPARTMENT OF THE INTERIOR FOR THE PUBLIC BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY FOR PARKS/RECREATIONAL USE 23. TRAFFIC STUDY AT THE INTERSECTION OF EL CAMINO REAL AND ORANGE STREET Staff was directed by the City Council on December 6, 1993, to prepare a traffic study, utilizing existing City resources, investigating the possible installation of a crosswalk or additional traffic control devices at the subject intersection. Recommendation: Pleasure of the City Council. 24. PROFESSIONAL SERVICES AGREEMENT FOR PREPARATION OF A COMPUTER- BASED MAPPING SYSTEM FOR THE TUSTIN WATER SERVICE AREA This project consists of preparing a computer-based mapping system which will accurately depict parcel level data concerning addresses, assessor's parcel numbers, water mains, service laterals, main line valves and fire hydrants; and additional public right-of-way data. Recommendation: Authorize the Mayor and City Clerk to execute a Professional Services Agreement with KHR Associates for preparation of a computer-based mapping system for the Tustin Water Service area, pending City Attorney approval, as recommended by the Public Works Department/Water Division. CALL TO ORDER ROLL CALL REGULAR BUSINESS ( ITEMS I THROUGH 3 ) 1.. APPROVAL OF DEMANDS Recommendation: Approve Demands in the amount of $545,338.37. 2. APPROVAL OF MINUTES - JANUARY 17, 1994 REGULAR MEETING Recommendation: Approve the Redevelopment Agency Minutes of January 17, 1994. 3. 1987 TAX ALLOCATION BOND REFUNDING At their meeting of January 3, 1994, the Redevelopment Agency directed staff to expedite proceeding with the proposed refunding of the Agency's 1987 tax allocation bonds to take advantage of current Iow interest rates. Recommendation: Direct staff to proceed with the 1987 tax allocation bond refunding on a negotiated, fixed rate basis; approve Stone and Youngberg as Financial Advisor; and further approve the use of an independent pricing consultant to verify the fairness of underwriting discounts and proposed bond pricings as recommended by the Finance Department.
