CALL TO ORDER/PLEDGE OF ALLEGIANCE/INVOCATION
The meeting was called to order by Mayor P0tts at 7:00 ~.m. at the
Council Chambers, 300 Centennial Way, Tustin, California. The
Pledge of Allegiance was led by Councilmember Pontious and the
Invocation was given by Mayor Pot,s.

PROCLAMATION - BLACK HISTORY PARADE
Mayor Potts read and presented a proclamation to representatives
of the Black History Parade Commistee announcing that the Black
History Parade would be held on February 5, 1994.
Chuck Mosley and Ernesta Wright, Black HiStory Parade Committee
members, thanked the Council for the proclamation and invited
everyone to attend the parade and festivities.
PRESENTATION
1. OLD TOWN EDUCATIONAL VIDEO PROJECT
christine shingleton, Assistant City Manager, stated creation
of the Old Town video was funded by a grant from the
C~lifornia office of'HistOric Preservation available to local
cities to generate interest in historic preservation. She
said the video's purpose was to concentrate on the City's
older areas and document the historic assets as well as
educate residents and business owners on grOwth and
development in Old Town. She thanked everyone involved in the
video's production, notably the Cultural Resources Committee,
and announced that the video ~as available to the public.

The Old Town Educational Video was shown depicting the
downtown shopping area; architectural styles; residential
areas; interviews with residents, business owners, a local
historian, design professionals, and the "Man on the Street;"
-and aerial ~footage of the City-and.surrounding communities.
Mayor Potts requested Dimension Cable broadcast the video for
local residents.
Counc~lmember Puckett noted Councilmember Pontious' and his
involvement in establishment of the Cultural Resources
District, and stated he was pleased to view the culmination
of efforts in preserving the City's heritage.
Councilmember Pontious requested a copy of the video be
donated to the school district.
Mayor Pro Tem Saltarelli and Councilmember Thomas commented
that the video was an excellent tool to promote and attract
new businesses to the Old Town area.
It was moved by Puckett, seconded by Thomas, to receive and
file subject report.
Motion carried 5-0.
ANNOUNCEMENT
Mayor Potts announced that the City's water supply was safe and
had not been affected by the earthquake.

PUBLIC HEARING
1. RED HILL UNDERGROUND UTILITY DISTRICT NO. 14
It was moved by Puckett, seconded by Saltarelli, to continue
the Public Hearing for the potential formation of the Red Hill
Avenue Underground Utility District No. 14 to the February 22,
1994 Council meeting.
Motion carried 5-0.
2. CITY OF TUSTIN GENERAL PLAN REVISION AND ..FINAL PROGRAM
ENVIRONMENTAL IMPACT REPORT (FINAL PROGRAM ENVIRONMENTAL
IMPACT REPORT IS NOT A PUBLIC HEARING ITEM)
Rita Westfield, Assistant Director of Community Development,
reported staff had initiated an update to the City's General
Plan and summarized-the update process including: public
hearing/participation for the General Plan and Draft
Environmental Impact Report (EIR); preparation of an Errata
to the General Plan identifying recommended modifications and -
revisions to the General Plan and Final EIR; North Tustin
community concerns regarding the Errata and its lack of
ensuring maintenance of the area's character in the event of
annexation to the City, and other issues not responded to in

the proposed General Plan; North Tustin Specific Plan used as
a regulatory tool in the event of annexation; final
determination on City policy regarding commercialization of
Marine Corps Air Station, Tustin; EIR complianQ~ with the
"California~i Environmental' Quality~ Act; and Statement of
Overriding Consideration regarding long-term air quality
impacts.
Councilmember Thomas requested modification of the Errata to
include "participate in and monitor the planning process for
John Wayn~ Airport and reuse on Marine Corps Air Station, E1
Toro."
Mayor Potts opened the Public Hearing at 7:32 p.m.
The following member of the audience spoke in opposition to-
the City of Tustin General Plan Revision:
Neil Harkleroad, 10562 Mira Vista, Santa Ana
Christine Shingleton, Assistant City Manager, stated that the
General Plan revision adequately addressed North Tustin
community concerns regarding proposed land use densities;
possible annexation; utilization of the North Tustin Specific
Plan; and the necessity to include the sphere of influence in
the General Plan.
The following member of the audience spoke in favor of the
City of Tustin General Plan Revision and Final Program
Environmental Impact Report, and the importance of including
sphere of influence language:
John Bridges, Cotton Beland Consultants representative
~[ayor Potts stated that it was not cost effective for the City
to annex the North Tustin area.
There were no other speakers on the subject and the Public
Hearing was closed at 7:43 p.m. -
Council/staff discussion followed regarding the sphere of
influence/planning area requirements.
Mayor Pro Tem Saltarelli stated the County of Orange services
in unincorporated areas continued to decline and the
probability existed that in the future the North Tustin area
would be annexed into the City of Orange or Tustin. He said
that because of concerns raised by Mr. Harkleroad, the
Foothill Communities Association, and to review the final EIR,
he requested continuing Council action on this item to allow
further review.
Mayor Potts stated that he supported North Tustin remaining
in the unincorporated area.

Christine Shingleton, Assistant City Manager, noted that the
Public Hearing portion of this item was closed; however,
Council action on the item could be continued.
'It was-moved by Saltarelli, seconded-by Thomas, to continue
Council action on the General Plan Revision and Final Program
Environmental Impact Report to the February 7, 1994 Council
meeting.
Motion carried 5-0.
PUBLIC INPUT - None
CONSENT CALENDAR
It was moved by Puckett, seconded by Pontious, to approve th~
Consent Calendar as recommended by staff. Motion carried 5-0.
1. APPROVAL OF MINUTES - JANUARY 3, 1994 REGULAR MEETING
Recommendation: Approve the City Council Minutes of
January 3, 1994.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of
$877,394.50 and ratify Payroll in the amount of
$308,107.74.
3. REJECTION OF CLAIM NO. 93-53 - CLAIMANT, SOUTHERN CALIFORNIA
GAS CO.; DATE OF LOSS, 9/14/93; DATE FILED WITH CITY, 11/5/93
Recommendation: Reject subject claim for property damage
in the amount of $554.71 as recommended by the City
Attorney.
4. REJECTION OF CLAIM NO. 93-52 - CLAIMANT, UC VAN NGUYEN; DATE
OF LOSS, 10/27/93; DATE FILED WITH CITY, 11/3/93
Recommendation: Reject subject claim for property damage
in the amount of $1,136.00 as recommended by the City
Attorney.
5. RESOLUTION NO. 94-9 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, MODIFYING THE DESIGNATED POSITIONS
CONTAINED IN THE CONFLICT OF INTEREST CODES OF THE CITY OF
TUSTIN
Recommendation: Adopt Resolution 94-9 modifying the
Designated Positions (Appendix A) contained in the City's
Conflict of Interest Codes as recommended by the Office of
the City Clerk.
6. AWARD OF CONTRACT'FOR'ANNUAL ASPHALT CONCRETE PAVEMENT REPAIR
PROGRAM
Recommendation: Award subject contract to Ail American
Asphalt in the amount of $199,900.00 as recommended by the
Public Works Department/ Engineering Division.
7. RESOLUTION NO. 94-16 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS

FOR TRAFFIC SIGNAL MODIFICATION AT RED HILL AVENUE AND IRVINE
BOULEVARD
Recommendation: Adopt Resolution No. 94-16 approving plans
and specifications and authorizing the advertisement for
bids- for the modifi'cation ~bf' ~he~ traffic signal at the
intersection of Red Hill Avenue and Irvine Boulevard as
recommended by the Public Works Department/Engineering
Division.
8. RESOLUTION NO. 94-15 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO.
93-7
Recommendation: Adopt Resolution No. 94-15 approving ~ot
Line Adjustment No. 93-7 as recommended by the Public Works
Department/Engineering Division.
9. RESOLUTION NO. 94-17 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
FOR SIDEWALK, CURB & GUTTER, AND INTERLOCKING PAVER REPAIR
PROJECT 1993-94 FY
Recommendation: Adopt Resolution No. 94-17 approving plans
and specifications for subject project and directing the
City Clerk to advertise for bids as recommended by the
Public Works Department/Engineering Division.
10. COOPERATIVE AGREEMENT NO. D93-179 WITH THE COUNTY OF ORANGE
TO PROVIDE FOR THE RESURFACING OF NEWPORT AVENUE
Recommendation: Authorize the Mayor to sign and the City
Clerk to attest to the subject Cooperative Agreement as
recommended by the Public Works Department/Engineering
Division.
11. COUNTY OF ORANGE AGREEMENT D93-142
Recommendation: Approve Agreement No. D93-142 with the
County of Orange Environmental Management Agency as
recommended by the Public Works Department/Engineering
Division.
12. RENEWAL OF CONTRACT FOR TREE TRIMMING SERVICES
Recommendation: Renew the contract for contract tree
trimming with West Coast Arborists in the amount of
$198,666.00 including two (2) minor changes as recommended
by the Public Works Department/Field Services Division.

It was moved by Pontious, seconded by Thomas, that Ordinance -
No. 1118 have second reading by title only. Motion carried

by the City Clerk, it was moved by Puckett, seconded by
Pontious, to adopt the following Ordinance No. 1118:

CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 93-002 TO
AMEND THE EAST TUSTIN SPECIFIC PLAN TO INCREASE THE MAXIMUM
ALLOWABLE HEIGHT OF OPEN TRELLIS AND BEAM CONSTRUCTION IN SIDE
YARDS FROM SEVEN AND ONE HALF (7-1/2) FEET TO TWELVE (12)
FEET,~AND TO PROVIDE UPDATED STREET NAMES IN SECTION 3.5.G OF
THE SPECIFIC PLAN
Motion carried 5-0 (roll call vote).
OLD BUSINESS - None
NEW BUSINESS
1. REVISED AGENDA FORMAT
It was moved by Puckett, seconded by Thomas, to approve the
consecutive numbering format and place Public Input prior to
Public Hearing on the revised agenda.
Motion carried 5-0.
REPORTS
1. PLANNING COMMISSION ACTION AGENDA - JANUARY 10, 1994
It was moved by Pontious, seconded by Thomas, to ratify the
Planning Commission Action Agenda of January 10, 1994.
Motion carried 5-0.
2. TUSTIN SPORTS PARK DESIGN UPDATE
It was moved by Pontious, seconded by Thomas, to receive and
file subject report.
Motion carried 5-0.
Christine Shingleton, Assistant City Manager,. reported that
the Tustin Sports Park construction bid opening scheduled for
January 18, 1994, was postponed to January 21, 1994 due to the
earthquake. She stated that a majority of the contractors who
purchased bid documents were based in Los Angeles County and
were experiencing difficulty in reaching their sub-contractors
b~ telephone to obtain cost'estimate information.
Council/staff discussion followed regarding maintaining the
contract award date of February 7, 1994; and the option of
adjourning to a special meeting to award the contract if
necessary.

AIRPORT STATUS REPORT
It was moved by Pontious, seconded by Thomas, to receive and
file subject report.
Motion carried 5-0.
4. REPORT ON FARMERS MARKET BUSINESS LICENSE REQUIREMENT
Christine Shingleton, Assistant City Manager, reported that
the Orange County Farm Bureau operated in Costa Mesa and
Huntington Beach and she summarized the business license ~ees
per vendor for both cities.
Council/staff discussion followed regarding business license
fee options.
It was moved by Thomas, seconded by Pontious, to approve
Option No. 2, requiring Farm Bureau to obtain sole business
license and vendors would be considered employees; individual
vendors would be exempt from taxation.
Motion carried 5-0.
PUBLIC INPUT
1. UNDERGROUND UTILITY DISTRICT NO. 14/PREVIOUS OLD TOWN
REPORT/MEETING WITH CHIEF OF POLICE
Jim Rems, P. O. Box 1706, Tustin, noted he was not notified
of the Underground Utility District No. 14 Public Hearing
continuance; questioned if all utility undergrounding would
be done simultaneously; stated disapproval of the previous Old
Town report describing "orchids and onions;" and reported his
scheduled meeting with Police Chief Franks had been canceled.
Robert Ledendecker, Director of Public Works, responded to
questions regarding the Underground Utility District No. 14
and explained that each utility company wOuld underground
their equipment. He s~ated it was possible the undergrounding
could be done by a joint trench.
Council/staff discussion followed regarding utility companies
using a joint trench; and notifying utility companies and
property owners regarding the continued Public Hearing.
Christine Shingleton, Assistant City Manager, responded to the
speaker's comments regarding the 1991 Old Town Charette report
d~picting buildings as "onions or orchids." She stated the
most recent report was the Regional Urban Design Assistance
Team report which offered recommendations regarding the Old
Town area.
William Huston, City Manager, explained that due to Chief
Franks becoming ill, the meeting with Mr. Rems had been
canceled; however, the meeting would be re$cheduled.

2. SOUTHERN CALIFORNIA EDISON COMPANY EARTHQUAKE POWER OUTAGE
Pat Buttress, Southern California Edison representative,
reported approximately.15,000 Orange County Edison customers
were WithoUt poWer due to the Northridge earthquake.
OTHER BUSINESS
1. "DESK TOP" DISASTER PREPAREDNESS
Mayor Pro Tem Saltarelli suggested Council participate in a
City "desk top" disaster preparedness simulation.
William Huston, City Manager, noted the City's disaster
preparedness plan met State requfrements and that staff
continued to attend disaster preparedness seminars and
training programs. He said a "desk top" disaster simulation
would be prepared and presented for Council review.
2. TOWN HALL MEETING
Councilmember Thomas thanked the public for attending the Town
Hall meeting on January !1, 1994.
3. BUSINESS LICENSE PENALTY AMNESTY PROGRAM
Councilmember Thomas suggested an annual business license
penalty amnesty program.
Christine Shingleton, Assistant city Manager, stated that
staff would submit recommendations for Economic Development
Council review and Council action.
Mayor Pro Tem Saltarel!i stated his concern regarding the
city's assessment of a business license penalty without prior
billing notification.
4. LAURELWOOD HOMEOWNERS' ASSOCIATION LETTER
Councilmember Thomas noted he would submit a letter from the
Laurelwood Homeowners' Association president to staff for
their review and comment.
5. ADJOURN IN MEMORY OF EARTHQUAKE VICTIMS
Councilmembers Thomas and Puckett noted the Northridge
earthquake disaster and requested adjournment in memory of the
victims and their families.

6. CITY HALL DEDICATION CEREMONY - JANUARY 21, 1994
Councilmember Puckett nosed the City Hall Dedication Ceremony
would be held January 2!, 1994, from 4-00 to 6:30 p.m., and
invited everyone to attend.

7. TRAFFIC CONCERNS
Mayor Potts reported on a letter from Pat Niles indicating
residents should call .0range qounty Transit AuthQ~ity or the
mayor' With traffic concerns, and noted traffic congestion
would not ease until freeway construction was completed.

8. CITIZEN LETTER - POLICE UNIT VIDEO CAMERAS
Mayor~ Potts thanked Allan Frankle for his letter regarding
police unit video cameras.
CLOSED SESSION - None
ADJOURNMENT
Mayor Potts adjourned the meeting at 8:25 p.m. in memory of
earthquake victims. The next regular meeting of the City Council
was scheduled for Monday, February 7, 1994, 7:00 p.m., at the
Council Chambers, 300 Centennial Way.
