HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FROM: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO RECORD SUBJECT: NOTICE OF COMPLETION FOR PHASE III REGIONAL TRAILS, ASSESSMENT DISTRICT NO. 86-2 RECOMMENDATION It is recommended that the City Council, at their meeting of February 7, 1994, adopt the attached resolution accepting said work and authorizing the recordation of the notice of completion. Assuming no claims.or stop payment notices are filed, it is further recommended that 35 days after the date of recordation of the notice of completion, that the Council authorize payment of the final 10% retention amount of $33,102.63. This amount together with the previous payments totaling $297,923.62 represents 100% of the final contract amount of $331,026.25. FISCAL IMPACT The final contract amount of $331,026.25 represents an increase of $26,026.25 or 8.5% over the original contract amount of $305,000.00. Funding is provided by Assessment District 86-2 and this project has adequate funding for these expenditures. The additional construction costs were related to the following: Additional excavation required to locate the existing water service; construction of sidewalk on Tustin Ranch Road; locate and tap reclaimed water main; increase in various bid quantities to reflect as built field quantities. BACKGROUND This project provided for the construction of sidewalk, regional bicycle and equestrian trails, irrigation and landscaping along the westerly side of Jamboree Road from 1100'± southerly of Champion Way to Portola Parkway and along the southerly side of Portola Parkway from Jamboree Road to Tustin Ranch Road. Ledendecker Director of Public Works/ city Engineer RSL: JO:ktb:re§tr[s At tachment Jerr~ Otteson Associate civil Engineer 1 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 ~21 24 26 27 28 RESOLUTION NO. 94-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR PHASE III REGIONAL TRAILS, ASSESSMENT DISTRICT 86-2 -- WHEREAS, Tracy and Ryder Landscape,Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Co~cil of the City of Tustin; and WHEREAS, the City Council finds that said contractor hah completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the notice of completion, and acceptance of said public work and improvement should be. filed and payment of the balance due to said contract authorized, in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Phase III Regional Trails, Assessment Dis5rict 86-2.
