As contract City Attorney, I will no longer have any employee fringe benefits at the close of January 31, 1994. Rourke, Woodruff & Spradlin and I will continue to provide the City with the same services as before and at the same fee schedule as has been in effect for the past almost five years, $120 per hour for partners of the firm and $110 per hour for associate attorneys, for all services, inCluding attendance at all meetings, general counsel work, litigation, etc. with the monthly retainer of $4,000 fully credited to the City upon all hourly billed fees. We may in the future ask the Council to re-evaluate the fee schedule, which is below the regular rate in Southern California for such services, particularly considering the relinquishment of all fringe benefits. If I may be permitted to say so, all surveys and studies have shown that I and the other lawyers of Rourke, Woodruff & Spradlin serve the City extremely well and at an extremely competitive'cost to the City and have done so for many years. From February 1, 1994 to the present the fee arrangement is $120 per hour for partners and $110 per hour for associates for all services with a $4, 000 retainer (paid at the beginning of each month) which is fully credited upon the hourly billed fees as prescribed in the memorandum received and filed by the City Council on February 9, 1994 (copy attached) . elf 4 J. ROURKE City Attorney 7OR:jab:R1:041894(1G641.jeb) cc: William Huston 110 41/1 1 92-155 RESOLUTION NO. 21 3 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PRESCRIBING THE 4 EMPLOYMENT AND COMPENSATION OF THE CITY ATTORNEY 511 6 The City Council of the City of Tustin hereby resolves as 7 follows: 8 WHEREAS, the retainer and compensation of the City Attorney for basic legal services has been prescribed by Minute Orders and 9 Resolutions of the City Council from time to time; and 101 WHEREAS, recent interpretations of the Public Employees Retirement System ("PERS") Board and staff have created ambiguities 11 about the proper construction of city attorney compensation for Public Employees Retirement System purposes; and 12 WHEREAS, for purposes of clarification, the City Council by 13 this Resolution restates the terms of the compensation of the City Attorney for basic services . 14 NOW, THEREFORE, the City Council of the City of Tustin, 15 California, hereby resolves as follows: 16 1. The monthly salary of the City Attorney for the performance of basic services is Six Thousand Dollars ($6, 000) per 17 month. 18 2 . For the prescribed monthly salary, the City Attorney shall continue to provide to the City each month services of 19 attendance at all regular meetings of the City Council and Planning Commission and thirty-five (35) hours of basic legal services. 20 3 . Any and all legal services as may be required by the City 21 in addition to those specified above shall be billed to City at the rate of One Hundred Twenty Dollars ($120) per hour. 22 4 .
