RECOMMENDATION:
That the Tustin City Council continue the Public Hearing for the
potential formation of the Red Hill Avenue Underground Utility District
No. 14 to Tuesday, February 22, 1994.
BACKGROUND:
On December 6, 1993, the City Council held a Public H~aring on the
potential formation of the Red Hill Avenue Underground Utility District
No. 14. Input was received from the affected property owners along Red
Hill Avenue between Copperfield Drive and the I-5 Freeway an~: the
Southern California Edison Company. Due to concerns received fr~m the
affected property owners, with respect to the estimated costs of the
service conversions from overhead to underground, the City Council
continued the Public Hearing to January 17, 1994 so staff could provide
additional information on the service conversion costs.
DISCUSSION:
On January 3, 1994, staff received a verbal request from Mr. Berklee
Maughn to continue the Public Hearing to either February 7th or 22nd'due
to the recent holiday season. Staff is in concurren6e with this request
and suggests that the Public Hearing be continued to the City Council
meeting of Tuesday, February 22, 1994. Mr. Maughn, as well as all of
the affected residents has been sent a copy of this report.
Prior to the February 22, 1994 meeting, Mr. Maughn and all affected
property owners and the affected utility companies will be mailed a copy
of~the meeting notice, revised engineer's report and staff report.

UNDERGROUND UTILITY DISTRICT NO. 14

At their meeting of November 1, 1993 , the City Council of the City
of Tustin, California passed and adopted Resolution No. 93-121
calling for a public hearing at 7: 00 p.m. on December 6, 1993, to
consider the merits of establishing an underground utility district
along Red Hill Avenue between Copperfield Drive and Nisson Road,
and more particularly described and shown on Exhibit "A" attached
hereto.
The City Council, at their meeting of December 6, 1993 , continued
the public hearing to the City Council meeting on January 17, 1994
and ultimately to February 22 , 1994.
Meetings have been held with both the Southern California Edison
Company and Pacific Bell to determine costs involved. Continental
Cablevision has some overhead facilities within the district, but
per the terms of the City' s Franchise Agreement, they will be
required to underground their facilities at no cost to the
district. Funding will be provided by the Edison Company with Rule
20A Funds for their facilities and Pacific Bell will provide
funding for all of their company-owned facilities. The City of
Tustin will provide funding for five new street lights, which are
not eligible for Rule 20A Funds. The estimated cost of the
proposed underground work is as follows:
Edison Company cost for conduit structure
and cable (Rule 20A) $250,000.00
Cost for street lights 6, 000. 00

The above mentioned costs were estimated by an electrical
contractor and include both the electrical and telephone service
conversion costs.
There will be no other property owner conversion expense other than
those noted above. All other existing private utility service
lines are presently undergrounded and/or are ready to accept
underground service.

Initial indications by the utility companies are that their work
can be completed in 12 to 18 months.
This district will provide for the removal of all wood utility
poles and street lights with overhead wires along both sides of Red
Hill Avenue from Copperfield Drive to Nisson Road.

12 affected property owners, if any, as such are shown on the
last equalized assessment roll and to all utilities concerned
13 in the manner and time required by law; and
14 WHEREAS, such hearing has been duly and regularly held
and all persons interested have been given an opportunity to
15 be heard.
16 NOW, THEREFOR, the Council of the City of Tustin does
hereby ordain;

1. The Council hereby finds and determines that the
18 public necessity, health, safety and welfare require the
removal of poles, overhead wires and associated structures, 1)
19 to eliminate concentrations of overhead distribution
facilities, 2) to clear streets used extensively by the
20 general public, which carry a heavy volume of vehicular
traffic, and to clear streets which pass through a civic area,
21 and 3) to facilitate the underground installation of wires and
facilities for supplying electric, communication or similar or
22 associated service in the underground district described in
Exhibit "A' attached hereto and made a part hereof by this
23 reference, and pursuant to the provisions of Ordinance No. 411
of the City of Tustin, such area is hereby established as
24 Underground Utility District No. 14 , Red Hill Avenue.
25 II. The City Council hereby declares its intention to
order the conversion.

date on which affected property owners, if any, must be ready

IV. The City Clerk is hereby instructed to notify all
6 affected utilities and all persons owning real property, if
any, within Underground Utility District No. 14, Red Hill
7 , Avenue, of the adoption of this ordinance within ten (10) days
after the date of such adoption. Said City Clerk shall
8 further notify said property owners, if any, of the necessity
that, if they or any person occupying such property desire to
9 continue to receive electric, communication, or other similar
or associated service, they or such occupant shall, by the
10 date fixed in this ordinance provide all necessary facility
changes on their premises so as to receive such service from
11 the line of the supplying utility or utilities at a
new location, subject to applicable rules, regulations and
12 tariffs of the respective utility or utilities or file with
the Public Utilities Commission of the State of California.
13 Such notification shall be made by mailing a copy of this
ordinance together with a copy of said Ordinance No. 411,
14 together with a statement that the City Engineer's Report
containing details of the district is available for inspection
15 by the public in the office of the City Clerk, to all affected
property owners as such are shown on the last equalized
16 assessment roll and to all utilities affected by this
ordinance.

V. The City Council hereby requests that all utilities
18 which provide service within the Red Hill Avenue Underground
Utility District No. 14 underground up to one hundred (100)
19 feet of each property owner's service lateral, at the

SUBJECT: Prposed Red Hill Ave. Underground Util . Dist . # 14
This letter will formally convey my protest of the above
proposed Underground Utility District . As the property
owner of 14322 Green Valley, I feel the probable assessment
of approximately $ 1200 .00 ($600 .00 per unit) per parcel is
grossly unfair in light of todays economic times.
Based upon the average southern California property owners
circumstances in todays difficult economy, I recommend that
either the proposal be postponed for a minimum of three to
five years. Or , alternatively, the city of Tustin pay for
such improvements out of its continuing increase in sales
taxes generated by the new businesses that continue to
relocate into Tustin. This latter alternative makes the
most sense especially since the proposed change offers no
economic benefit to subject property owners but does
continue to make Tustin more aestheticly attractive to out
of town customers enjoying our many commerical interests.
Furthermore, adjacent property owners would aestheticly
benefit but bear none of the cost. As a result , the
principal gainer of such a change is the city of Tustin and
not just a few adversely affected property owners .
Via this letter , I am also requesting that you keep me
apprised of the status of other probable property protesters
and what ether recourse may be available to us including
legal recourse should that become necessary. Should you

Dear Mr. Ledendecker,
I own the property at 14292 Green Valley,'one of nine owners being ask
to bear the burden for the aesthetics of underground utilities.-- ---.-
I attended the December 6th meeting. I did not address the council be-
cause I felt I needed more information. After Listening to all parties,
I must agree with Mr. Kovac. After the discussion he gave me a copy of
his letter dated Nov. 23rd. which says it as well as I could.
I believe that the council stated that it would send letters stating
cost to owners, I haven't recieved any information. Also the council
stated that they couldn' t fund" the underground work,why? I do not be-
lieve that this is a necessity to the health, safety, or welfare of the
city. But, a beautification-project, which could be paid for by the
city.
I am protesting the proposed Underground Utility District #14
I am a concerned absentee owner.

My wife and I are the owners 14312 Green Valley Ave., Tustin, CA 92680 and have been since
March 23, 1993. We only recently heard about Proposed Underground Utility District No. 14 but
have never been officially informed about it. From what I have heard, it appears that it does not
specifically benefit only the few properties whose owners will be financially impacted by it. Unless
the total costs are born by all of the property owners in the City of Tustin, my wife and I oppose it.

I am writing this letter on behalf of my parents, Mr.and Mrs. A.
Medina. My mother is out of town and my father is ill. They are the
owners of the property located at 14262 Green Valley Avenue,
Tustin, Ca. 92680. I am sending this letter in regards to the
amount the city has asked the property owners to pay for the
project mentioned above. We feel this charge is invalid and we
should not be asked to absorb this charge. The property owners did
not ask for this project to take place. I will be attending the
meeting on February 22 , 1994 with my father to further our protest
of these charges.
