HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION AUTHORIZATION FOR DIRECTOR OF PUBLIC WORKS/CITY ENGINEER TO SIGN CALTRANS DOCUMENTS RELATED TO RIGHT- OF-WAY CERTIFICATION SUMMARY Adoption of Resolution No. 03-52 will authorize the Director of Public Works/City Engineer to sign, on behalf of the City of Tustin, various documents required by Caltrans to process and obtain Right-of- Way Certifications for certain City improvement projects. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 03-52 authorizing the Director of Public Works/City Engineer to sign documents required by Caltrans related to Right-of-Way Certifications. FISCAL IMPACT There is no fiscal impact to the City with this action. BACKGROUND For projects that have Caltrans involvement or responsibility and where right-of-way is required, Caltrans requires an authorized signature on a series of documents in order to satisfy requirements for right-of- way acquisition. These documents include a "Right-of-Way Certification" form, which is a declaration that the City is conforming to Caltrans procedures in obtaining any needed right-of-way. A "Right-of-Way Certification" form is also required if utility companies have facilities within a project area for which Caltrans has involvement or responsibility. For projects that have Caltrans involvement or responsibility and where no right-of-way is required, Caltrans requires an authorized signature on a "No Right-of-Way Certification" form. For both types of projects, Caltrans involvement includes the need for a Caltrans Encroachment Permit. An authorized signature is currently required on the "Right-of-Way Certification" for the Red Hill Avenue Widening Project at the I-5 Freeway (CIP No. 7133) prior to Caltrans issuing the City an Encroachment Permit. A Right-of-Way Certification will also be needed in the future for the Newport Avenue/SR-55 Ramp Reconfiguration Project (CIP No. 7130). Therefore, it is recommended that the City Council adopt Resolution No. 03-52 authorizing the Director of Public Works/City Engineer to sign, on behalf of the City of Tustin, documents required by Caltrans to process and obtain Right-of-Way Certifications for certain City improvement projects. Attachment: Resolution No. 03-52 bar~a R(.,~asdan Engineering Services Manager RESOLUTION 03-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE PUBLIC WORKS DIRECTOR/CITY ENGINEER TO SIGN DOCUMENTS REQUIRED BY CALTRANS TO PROCESS AND OBTAIN RIGHT-OF-WAY CERTIFICATIONS FOR CERTAIN CITY IMPROVEMENT PROJECTS WHEREAS, for City improvement projects that have Caltrans involvement or responsibility and right-of-way is required, Caltrans requires the submittal of a Right-of- Way Certification form; and WHEREAS, for City improvement projects that have Caltrans involvement or responsibility and utility companies have facilities within the project area, Caltrans also requires the submittal of a Right-of-Way Certification form; and WHEREAS, for City improvement projects that have Caltrans involvement or responsibility and where no right-of-way is required, Caltrans requires the submittal of a No Right-of-Way Certification form; and WHEREAS, the Right-of-Way documents to be submitted to Caltrans must be signed by an individual authorized to certify these documents. NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Tustin that the Director of Public Works/City Engineer is hereby authorized to sign, on behalf of the City of Tustin, documents required by Caltrans to process and obtain Right-of- Way Certifications.
