BENEFIT TRANSFER OF SURPLUS FEDERAL REAL PROPERTY
RECON ONDATION
It is recommended that the City Council adopt Resol_=ion No. 94-8,
approving an application to the U.S. Department of 0 ucation (DoE)
for the public benefit transfer of surplus -"Federal real property
(MCAS, Tustin) for educational use by the City.
FISCAL IMPACT
The application requesting the transfer of surplus orcperty from
MCAS, Tustin for public benefit will not result in a-. immediate
fiscal impact to the City of Tustin. Between the time of
application approval (estimated early 1995) to the t_: -1e that formal
property acquisition would occur (estimated in mid-1997), a
complete fiscal analysis would be prepared for zhe Council's
consideration and approval. The application request= ccnveyance of
two Child Development Centers at no cost to the C=zy. However,
each application is reviewed by the DoE. Based upon their
evaluation, final transfer of the property by the Dei rtment of the
Navy could result in the City being given the cpportunity to
acquire the facilities for anywhere between $0 and 300 of Market
Value. In addition, if the City were to acquire th= property, it
is anticiparted that an operator would be immediat-ey contracted
with through a lease agreement to provide the child development
services revenue that would compensate the City =or any costs
associated with the property's operation and maintenance.
BACKGROUND/DISCUSSION
As Council is aware, Marine Corps Air Station (MCAS), Tustin is
scheduled to close by July 1997. In compliance wit: federal base
closure law, the Navy has recently begun the process of advertising
the property for future conveyance to military branches, federal
agencies, and state and local entities. On October 20, 1993, the
City of Tustin responded to the Navy's state and 1ccal screening
effort by indicating a wide range of potential futu-e _nterest in
property and facilities at the base. Base disposal law provides

closing bases fcr below market value or for free when certain
categories of public benefit can be shown.
In response to the City's October 20, 1993 letter of interest, the
federal Department of Education (DoE) requested that a formal
application be submitted which detailed the City's interest in
future educational reuses of the property and identified the
specific public benefit which would occur from the transfer. Due
to the extremely short time frame afforded by the DoE and level of
detail required, on December 17, 1993, staff forwarded the
application without a resolution required to indicate City Council
support for the request (Exhibit A). Resolution 94-8 has been
prepared in accordance with DoE requirements to indicate this
support and, if approved by Council, will be forwarded to the DoE.
Public benefit transfer of this property would allow the City to
potentially obtain the land at below market cost. However, the
City will not be obligated to make a commitment to take control of
the property until such time that the U.S. Secretary of the Navy
notifies the City of acceptance of its request. It is important
for the City to participate in this phase of the Federal screening
process to ensure that base properties with potential public
educational re -use value are made available for potential
acquisition.
CONCLUSION
Since submission of the request to the DOE does not obligate the
City at this time but provides an opportunity for future public
benefit conveyance, it is recommended that the City Council adopt
Resolution No. 94-8, as submitted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
5 TUSTIN, CALIFORNIA, APPROVING AN APPLICATION TO THE
U.S. DEPARTMENT OF EDUCATION FOR THE PUBLIC BENEFIT
6 TRANSFER OF SURPLUS FEDERAL REAL PROPERTY FOR
7 EDUCATION USE BY THE CITY.
8 The City Council of the City of Tustin does hereby resolve as
9 follows: .
10 WHEREAS, certain real property owned by the United States
of America, located in the County of Orange, State of
11 California, has been declared surplus and is subject to
assignment for disposal for educational purposes by the
12 Secretary of the U. S. Department of Education, under
provisions of section 203 (k) (1) of the Federal Property and
13 Administrative Services Act of 1949, as amended (Act), (63
14 STAT. 377), and the rules and regulations promulgated pursuant
thereto, more particularly described as follows:
15 "Buildings 547 and 199 (two buildings), Child
16 Development Center, Marine Corps Air Station,
Tustin, northwesterly portion of base "Village"
17 area, City of Tustin, Orange County, California.
Total acreage requested: Building 547 - 2.81
18 acres, Building 199 - 2.40 acres. Land requested
is for Child Development Center, yard areas,
19 parking spaces, set -backs, and existing and future
right-cf-way and easement needs."

WHEREAS, the City of Tustin, needs and can utilize said
21 property for educational purposes in accordance with the
22 requirements of the Act and the rules and regulations
promulgated thereunder of which this City Council is fully
23 informed, including commitments regarding use and time within
which such use shall commence: (1) Within 12 months after the
24� date of conveyance; or (2) Within 36 months after the date of
conveyance where major construction or renovation is involved.
NOW, TKEREFORE, BE IT RESOLVED that the City of Tustin
20 shall make application to the Secretary of the U.S. Department
.of Education for the transfer of the above mentioned property
27 for said use subject to such exceptions, reservations, terms,
covenants, agreements, conditions and restrictions as the
28 Secretary o the U.S. Department of Education, or the
Secretary's authorized representative, may require in
connection with the disposal of said property under the Act
and the rules and regulations; and

BE IT FURTHER RESOLVED that the City of Tustin has legal
authority, is willing and is in a position financially and
otherwise to assume immediate care and, maintenance of the
property, and that William A. Huston, City Manager, is hereby
authorized, for and on behalf of the City of Tustin, to do and
perform any and all acts and things which may be necessary to
carry out this resolution, including the preparing and filing
of plans, applications, reports, and other documents, the
execution, acceptance, delivery, and recordation of
agreements, deeds and other instruments pertaining to the
transfer of said property and the payment of any and all sums,
fees, or. costs incurred in connection with the transfer of the
property for surveys, title searches, appraisals., recordation
of instruments, or escrow costs, together with any payments by
virtue of nonuse or deferral of use of the property. If the
applicant is unable to place the property into use within the
time limitations indicated below (or determines that a
deferral of use should occur), it is understood that the City
of Tustin will pay to the Department for each month on nonuse
beginning 12 months after the date of the deed, or 36 months
where construction or major renovation is contemplated, the
sum of 1/360th of the then current fair market value for each
month of nonuse; or, the applicant. agrees to abide by what
other terms the Department may require, which are consistent
with its Regulations in effect at the time of transfer.
If the application is approved, a copy of the application and
standard deed conditions will be filed with the permanent
minutes of the City Council.
PASSED AND ADOPTED at a regular meeting of the Tustin City
Council, held on the 3rd day of January, 1994.

The Community Services Department currently provides a
Child Development Program at a facility leased from the
Tustin Unified School District and operated under a
services contract through Mothers At Work (M.A.W.)
Children's Centers, a nonprofit corporation. This
program provides high quality child care and educational
development at prices affordable to low- and moderate -
income families. The cost for the City program is below
market rate.
The program, open to families with children ages two
through six years, operates Monday through Friday, from
6 a.m. to 6:30 p.m. Activities are geared toward monthly
or seasonal themes and provide a variety of experiences
including reading and math readiness, language
development, art, music, science and nature discoveries,
sharing cooking, games, dramatic play and special events.
Emphasis is placed on developing friendships, self
esteem, creativity and problem solving skills.
B. Geographic Area & Population Served:
Community programs operated by the City of Tustin are
designed to provide service to residents within the City
limits, in addition to residents of surrounding
unincorporated areas and neighboring cities. Tustin has
a land area of 11.02 square miles and a population of

54,000 residents; the population of. the surrounding
unincorporated area is 27,0000.
Families with children in the City's Child Development
Program reside or work within Tustin city limits.
C. Current Enrollment & Staffing Levels:
Currently, 36 children are enrolled in the Child
Development Program. Staff includes one director and
four teachers. The current economic situation has
resulted in a diminished enrollment. However, during the
past two years, enrollment has been at or near the
licensed capacity of 54 children.
D. Accreditation, Approval, Licensing, etc. of Program(s):
The State of California, Department of Social Services
has licensed the program for 54 children, as set forth by
regulations in the California Administrative Code, Title
22. The license was last renewed in March of 1993.

playground equipment, a parking area, cabinets, coat
racks and storage cubbies.
Current Usage: Child Development/Early Learning Center
Describe any inadequacies of the facility: The program
is located in a surplus Tustin Unified School District
elementary school currently used as an annex to Tustin
High School. Existing inadequacies are numerous. The
program is located near the Tustin High School campus and
during the school year, parking for students, parents and
staff is very limited. Expansion of the Child
Development/Early Learning Program beyond the 54 students
for which it is currently licensed is not feasible due to
inadequate restroom facilities. Building heating and
cooling systems are unreliable and the roof leaks.
Possibly, there is asbestos in the building. However,
the most important inadequacy is the facility lease. The
Tustin School District anticipates terminating the lease
and there are no alternate locations available for the
Child Development Program which are affordable to the
program.
Indicate how this property would be affected by an
acquisition of the property described in Part IV. of this
application: Acquisition of the property described in
Part IV. would provide a permanent location for the
City's Child Development/Early Learning Program. The
Tustin Unified School District is considering selling the
surplus elementary school facility housing the current
Child Development Program at market rates. Without the
acquisition of this federal surplus facility located on
the base property, the Child Development Program is in
Jeopardy of disbanding.

IV. DESCRIPTION OF FEDERAL SURPLUS REAL PROPERTY REQUESTED
A. Name & Location of Federal Civilian or Military Property
Requested By This Application:
Building 547 and Building 199, Child Development Center,
Marine Corps Air Station, Tustin, northwesterly portion
of base "village" area, City of Tustin, Orange County,
California, as indicated on the map attached as EXHIBIT
IV.A.
B. Indicate Whether This Request is for All or a Portion of
the Total Property Which Is Surplus:
Marine Corps Air Station (MCAS), Tustin was recommended
for closure as part of a federal Base Realignment and
Closure action of 1991. Therefore, the entire base is
scheduled to -close and disposal initiated by 1997-1999.
This request is for only the Child Development Center
buildings, a portion of the base property to be disposed.
C. Description of Acreage/Land Area Requested:
Approximately 122,500 -square feet (2.81 acres) which
accommodates Building 547, yard areas, parking spaces,
setbacks, and existing and future right-of-way and
easement needs. Approximately 105,000 square feet (2.4
acres) which accommodates Building 1.49, yard areas,
setbacks and existing and future right--of-way reeds.
Site plans have been provided as EXHIBI`1' #IV.C.

V. PROPOSED PROGRAM OF USE FOR PROPERTY REQUESTED
A. Narrative Description of Overall Proposed Educational"Use
For the Property Requested, Participation, etc.:

If the City were to acquire this -property an Early
Learning Center would be established. This program would
encompass the City's current Child Development Program as
described in Part II. A. Because the requested facility
is larger than the currently used facility, service would
be expanded to include more children. The current
program serves children ages two years through six years.
Acquisition of the surplus federal property would allow
expansion of the program to include children six weeks
through two years.
Populations served would include City of Tustin residents
and employees olf businesses located in rustin, as well as
_residents and employees of surrounding cities and
unincorporated areas.
In addition to the Child Development Program the City
currently offers, the Early Learning Center would include
new and expanded services.
The Early Learning Center could feature a care facility
for mildly ill children. Such a program would provide
families with licensed care for children too ill to
attend school or regular day care, but not sick enough to
require hospitalization or immediate medical care.

Physicians supervise such facilities with nursing staff
to supplement child care staff.
The Early Learning Center could also include licensed
care for children with disabilities. In addition to
specialized programs, all programs at the Center would be
adapted to make reasonable accommodations for any child
with disabilities.
Further, the Early- Learning Center could provide a
location for family education programs such as teen
mother programs, parenting classes and kindergarten
preparedness. - This center might also house resource
materials and provide technical support to Tustin -area
child care providers. The facility might also be a
location for training new child care workers and
professional development for those currently working in
the field of early child learning.
B. Specific Uses of Requested Property:

As necessary to bring property into conformance with
local zoning and in order to meet all State Building
Codes and regulations.

be used as a playground, as required by State of
California, Department of Social Services licensing
regulations. The existing parking area would continue to
serve as a parking area for the facility. -

'VI. JUSTIFICATION/PROOF OF NEED FOR THE PROPERTY REQUESTED
The reuse of MCAS, Tustin will result in a large-scale
development which will attract additional employees and
residents to the city and surrounding areas. There is a
direct connection between the proposed reuse plan and the need
for additional child care facilities in the City, particularly
child care facilities affordable to households of low and
moderate income.
Land uses in the reuse plan project area would be benefitted
by the availability of child care for persons living in or
employed in the vicinity, close to their place ;of work. Due
to a shortage of child care, future employers may have
difficulty in securing a labor force, and employees unable to
find accessible and affordable child care will be forced
either to work where such services are available outside of
Tustin, or leave the wcrk force entirely, in some cases
seeking public assistance to support their children. In
either case, there will he a detrimental effect on Tustin's
economy and its quality c = life.
Population projections fcY the base reuse indicate that there
could be an increase of u- to 6,900 residents. Future uses on
the site could also create between 6,600 - 8,700 new permanent
jobs. With the additic-:a1 employees attracted to the new

development and the scarcity of child care in _the city, these
new employees will be competing with current residents and
employees for the few openings in child care programs already
available in the city. Competition for child care algo
generates the greatest pressure on households of low and
moderate income.
The City is currently in the midst of its reuse planning
process for Marine Corps Air Station, Tustin. since closure
of the base was announced in 1991, the city of tustin and the
U.S. Marine Corps have been engaged in a cooperative effort to
plan for its conversion to a non-military use. A 17 member
base closure task force representing a wide range of public
and private interests was formed in February 1992 to provide
guidance on this planning effort. Community goals and a
Vision Statement for the future use of the site have been
established through community surveys, workshops and Task
Force meetings. A detailed Market Trend Analysis has been
completed and a preliminary survey and inventory of on -base
facilities has been completed to -date.
On December 71 1993, the Task Force reviewed and commented on
a preliminary draft Preferred'Reuse Plan for the site. The
Plan contained a number of characteristics which embraced the
goals and vision established by the community and the Task
Force. Specifically related to this public benefit conveyance
request, the Plan proposed a land use category, surrounding
the requested site, which would support a myriad of
educational, job training and vocational opportunities. In
addition, surrounding uses proposed would be designed to be
interdependent with the educational component of the Plan so
as to facilitate a connectedness between buildings and uses,
enabling people living or working on site to choose to meet a
significant part of their daily needs within the site.
We strongly believe that retention of the educational
opportunities afforded by the Child Development Center is
integral to the successful implementation of the Community's
Reuse Plan. We also believe that the City of Tustin is best
equipped to implement this plan and ensure the future reuse of
the center in a manner compatible with these efforts.
Through a contract for services, the City currently offers a
high quality Child Development Program at reasonable prices.
However, this program utilizes a facility leased from the
Tustin Unified School District. The District is anticipating
exercising a termination clause in the City's lease for this

building, and an alternate location for this Child Development
program has not been located.
Relocation of the program to the building at MCAS, Tustin
would provide several benefits including:
Continuation of the existing program
Expansion of the program from 54 children to 252
children
Expansion of available services through
establishment of an Early Learning Center. In
addition to the programs currently offered (see
Item #II.A.), the program could be expanded to
serve newborns and infants (ages 6 months to 2
years), teen mothers, parent training, child care
professional training, as well as provide a
resource center for parents and child care
providers
+, Establishment of a care center for mildly ill
children
The property is located in Tustin in an area where there are
very few licensed child care facilities. Currently, there are
no licensed care facility within the commercial and industrial
areas surrounding the property.
In spring of 1990, the Tustin City Council established an Ad
Hoc Child Care Committee to prepare "A Comprehensive Child
Care Report." This Committee consisted of local child care
professionals, parents, child care providers, city officials
and school district representatives. The Ad Hoc Committee
cited a need for local technical assistance for child care
providers. The proposed Early Learning Center would house a
"tone -stop" resource center for materials, equipment and
training. it is likely that care could also be provided on a
"drop in" basis for the children of those visiting the center
for }raining or to borrow materials or equipment.
The Ad Hoc Child Care Committee also recommended that the City
Council and School Board work together to find solutions to
child care issues facing families in the Tustin area. To
accomplish this task, the Council and Board appointed the
Tustin Child Care Coalition. The Coalition recommended
establishing a Teen Mother program to serve young people and

families in Tustin and surrounding school. districts. The
program could provide expectant high school students with pre-
natal care, parenting classes, practical infant care
experiences and child care during the remainder of their high
school careers. This specialized program could be
incorporated to the expanded new born and infant development
program which would be available with this facility.
The Coalition has also cited parenting classes and
Kindergarten preparedness classes as community needs. Such
classes would provide parents and child care professionals
with important information and skills in developing children's
readiness for school and cultivating self-esteem for all
members of the family.
The Tustin Child Care Coalition has cited a local need for
child care for mildly ill children. Currently, the nearest
center is located in Garden Grove, 15'miles from -Tustin. The
establishment of care serves for mildly ill children would
serve a regional population including families in cities and
unincorporated areas surrounding Tustin.
VII. SUITABILITY OF PROPERTY FOR THE USES PROPOSED
A. Describe How/Why the Property Requested is Suited to the
Uses Proposed:
The property is presently being utilized as a child
development center, licensed in accordance with State
requirements. The facility is suitable for continued
operation as a child development/early learning center
including the educational instruction of child care
providers.
B. Indicate Present Zoning of the Property and Whether the
Proposed Program of use Would Be Consistent With Such
Zoning, State and Local Law, Ordinances, Land Use
Planning, etc.:
The property, currently exempt from local zoning
requirements because of the military installation, has a
Public and Institutional Zoning District designation. If
the property were under local zoning control, the
proposed program and use would be subject to the approval
of a Conditional Use Permit. The City. of Tustin, in
conjunction with the Department of the Navy, is currently

preparing a Re-Use/Specific Plan for the entire base
property. Should the existing child care facility be
transferred to the City, the Re-Use/Specific Plan would
designate the child development center as an outrigOt
permitted use.

Which May Be Attached To the Property:
The base property is surroundedby urban development;
the child development site and vicinity have been fully
developed and are bounded by military roads-. There is no
known environmental or archeological significance
attached to the property.
D. Describe Any Known Environmental or Contamination
Problems Associated With the Property:
The property has no known environmental or contamination
problems.

An environmental analysis is not required for this
application.
IX. FINANCIAL ABILITY TO IMPLEMENT & OPERATE PROPOSED PROGRAM
A. Describe Sources and Amounts For All Funding Required to
Implement and Operate the Proposed Program of Use
Described Under Part. V. of This Application:
The City's current Child Development Center is operated
through a contract with an outside service provider.
Enrollment fees are paid by students directly to the
contractor who, in turn, pays the city a percentage of
those fees. The City applies those funds toward the cost
of the lease of the physical facility, and for a limited
amount of promotion, and advertising of the program.
Maintenance of the Facility is coordinated through the
Tustin Unified School District. The Child Development
Program is essentially self-sustaining and will operate
within a budget based on revenue taken in by the care
provider.

B. Identify and Explain ANY Income/Revenues Expected To Be
Generated Through Operation of the Proposed Program:
Not applicable. The City of Tustin is a non-profit
entity.
X. ASSURANCE OF COMPLIANCE WITH NONDISCRIMINATION REQUIREMENTS
The City of Tustin will not discriminate because of race,
color, national origin, sex or disability in the use of the
property, in keeping with Section 606 of the Federal Property
and Administrative Services Act of 1949, Title VI of the Civil
Rights Act of 1964 (P.L. 88-353), Title IX of the Education
Amendments Act of -1972 (P.L. 92-318), and Section 844 of the
Education Amendments of 1974 (P.L. 93-380) (in relation to
education), and Section 504 of the Rehabilitation Act of 1973
(P.L. 93-112) , Title II of the Americans With Disabilities Act
of 1990, and the Departmentes Regulations issued pursuant to
such Acts (34 CFR Part 12, 80, 84 and 86).
XI. INSURANCE PROVISION
This Applicant agrees, for itself, its successors and assigns,
that if any conveyed improvements are insured against loss,
damage or destruction shall occur during the period the
Grantee holds title to said property subject to conditions
subsequent 1, 21 3, 4 and 5 of the conveyance instrument, said
insurance and all money shall be held in trust by the Grantee,
its successors and assigns, and shall be property used by the
Grantee for the purpose of repairing such improvements and
restoring same to their former condition and use or for the
purpose of replacing said improvements with equivalent or more
suitable improvements, or, if not so used, shall be paid over
to the over to the Treasurer of the United States in an amount
no:: exceeding the unamortized public benefit allowance of the
buildings, structures, or improvements lost, damaged, or
destroyed.
XII. PROTECTION AND MAINTENANCE OF THE PROPERTY
The Grantee covenants and agrees for itself, its successors
and assigns, that in the event the Grantor exercises its
option to revert all right, title and interest in the property
to the Grantor, or the Grantee voluntarily returns title to
the property in lieu of reverter, then the Grantee shall
provide protection and maintenance of the property at all
times until such time as the title is actually reverted or

returned and accepted by the Grantor. Such_ protection and
maintenance shall, at a minimum, conform to the standards
prescribed by the General Services Administration in its

the date of the conveyance instrument, a copy of which is
attached to this application and -labeled EXHIBIT #XII.
