SUBJECT: TUSTIN BRANCH SPUR BIKETRAIL
RECOMMENDATION
That the City Council adopt Resolution No. 95-107, authorizing the
Public Works Director to apply as a co-applicant for funds for the
Transportation Enhancement Activities Program.
FISCAL IMPACT
In the status of co-applicant, the City of Tustin will not be
responsible to provide any funding or contribution match for
project implementation. Once the right-of-way is acquired and the
trail constructed, the City of Tustin would assume maintenance and
liability responsibilities for the portion of trail within Tustin.
On-street striped bikelanes maintenance costs will be absorbed as
part of the City's regular road maintenance.
BACKGROUND/DISCUSSION
Caltrans has been working for over two years on the acquisition of
a 7 mile section of abandoned Southern Pacific Railroad (SPRR)
Tustin Branch Spur right-of-way for the development of a multi-
purpose bicycle trail. The SPRR right-of-way extends through a
small section of Tustin, Unincorporated North Tustin, Villa Park
and the City of Orange. The SPRR corridor when combined with the
existing multi-use trails would provide a continuous uninterrupted
trail from the City of Orange to the Newport Avenue trail north of
Irvine Boulevard in the City of Tustin. The trail project as
originally envisioned included the full available segment of right-
of-way which terminated north of Irvine Boulevard, behind La
Fayette Plaza Center. The portion of trail within the corporate
boundaries of Tustin only included a 30' x 40' area. The trail in
Tustin has been realigned to transition from the SPRR right-of-way
to Warren Avenue (east) to Newport Avenue (south) linking to the
existing Newport off-road biketrail south of Irvine Boulevard. (See
Exhibit A - Proposed Tustin Branch Trail Alignment).

Last year Caltrans requested a letter of support from the cities
affected by the proposed trail project in order to proceed with the
project application. On December 5, 1994, the City Manager
proVided a letter to Caltrans committing to and supporting the
trail project contingent upon the completion of the environmental
document and resolution of issues identified by residents at local
workshops. The letter also confirmed that the City of Tustin would
accept ownership, maintenance and liability responsibilities 'upon
completion of the trail portion within Tustin. ~-
Funding for the acquisition and improvement of the bicycle trail is
to be provided through the Federal Transportation Enhancement
Activities (TEA) Program. Caltrans is no longer able to secure the
20% match funds required of the grant program and has withdrawn as
the applicant for the TEA grant. The City of Orange is being asked
by Caltrans to assume the role of applicant~for the TEA application
since the majority of the trail project lies within Orange. Since
the SPRR bicycle trail, if developed, would affect the Cities of
Tustin, Villa Park and the County of Orange unincorporated area,
the City of Orange has requested these entities.to participate as
co-applicant on the grant request for the project. In addition,
grant requests are scored/ranked based on a number of criteria.
Participation and co-sponsorship by a number of entities in this
project improve the chances of a higher ranking/score and funding
of the project.
Caltrans has.prepared a Negative Declaration for the project and
held a public hearing on November 9, 1995. Public comments on the
Negative Declaration are due by November 29, 1995. Caltrans will
prepare response to comments and the final Negative Declaration.
Because the Cities of Tustin, Orange, Villa Park and County of
Orange will assume sponsorship of the project, each city may decide
to hold a public hearing to adopt the Negative Declaration prior to
· proceeding with development of the biketrail improvements, should
the grant be approved.
Adoption of Resolution No. 95-107 would authorize the City of
Orange to pursue the TEA grant in behalf of the City of Tustin as
a co-applicant. TEA applications are due to the Federal Highway
Administration by November 27, 1995. The 20% match funds is still
a requirement of the grant, however neither the County nor any of
the cities are being requested to contribute match funds.

Southern Pacific Railroad as the landowner will be accepting less
than market value for the land. This write-down will serve at the
20% match of funds request through the grant application.
CONCLUSION
Adoption of Resolution No. 95-107 Will allow the City of Tustin to
participate in the extension of the SPRR multi-purpose'~rail to
Tustin by applying as co-applicant along with the City of Orange on
the pending Transportation Enhancement Activities (TEA) grant.

RESOLUTION NO. 95-107
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, AUTHORIZING THE CITY OF ORANGE
TO APPLY FOR FUNDS FOR THE TRANSPORTATION
ENHANCEMENT ACTIVITIES PROGRAM UNDER THE INTERMODAL
SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991, IN
BEHALF OF THE CITY OF TUSTIN AS CO-APPLICANT FOR
THE TUSTIN BRANCH TRAIL BIKEWAY PROJECT.
WHEREAS, 'the United States Congress has enacted the
Intermodal Surface Transportation Efficiency Act of 1991,
which is to make available over $200 million over a six year
period as funds to the Department of Transportation for
transportation enhancement activities; and
WHEREAS, the Department of Transportation has'~stablished
the procedures and criteria for reviewing proposals and, along
with the Regional Transportation Agencies, will submit to the
California .Transportation Commission a list of recommended
projects from which the recipients will be selected; and
WHEREAS, said procedures and criteria established by the
California'Department of Transportation call for the approval
of an application by each applicant or co-applicant's
governing body before submission of said application to the
California Transportation Commission; and
WHEREAS', the City of Tustin as co-applicant along with
the other co-applicant cities, will enter into an agreement
with the State of California to carry out the transportation
enhancement activities project identified as the Tustin Branch
Trail Bikeway; and
WHEREAS, the City of Tustin makes no commitment to
provide funding or match funds for the project implementation,
but would make adequate .provisions for the operation and
maintenance of the portion of the project within the
jurisdictional boundaries of the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of
Tustin:

Approves the filing of an application for the
Transportation Activities Enhancement Grant Program for
the Tustin Branch Spur Line Bikeway Project Acquisition
and Development; and

Appoint the Director of Public Works as an agent of the
City of Tustin to sign and execute all documents
including applications, agreements or amendments which
may be necessary for the project.
