CALL TO ORDER / PLEDGE OF ALLEGIANCE ROLL CALL PROCLAMATION- Tree City USA PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO ACTION can be taken on off-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. PUBLIC HEARINGS (ITEMS I THROUGH 2 ) 1. VESTING TENTATIVE TRACT MAP 1~.~.10 (LEWIS HOMES) The applicant.is proposing modifications to the original project and is requesting authorization to subdivide the 38-acre site into 171 numbered lots and 52 lettered lots for the purposes of developing 171 single-family detached dwelling units instead of the 146 units originally proposed on the site bordered by Pioneer Road on the east, Peters Canyon Road on the south and west, and Lot 9 of Tentative Tract 14397 to the north. Recommendation by the Community Development Department: 1. Approve the Environmental Determination for the project by adopting the following Resolution No. 95-97: RESOLUTION NO. 95-97 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85- 2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE TRACT MAP 14410 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Council Agenda I October 16, 1995 15. Recommendation: Ratify Planning Commission Action Agenda of OctOber 9, 1995. REGULAR BUSINESS (ITEMS 16 THROUGH 20 ) 16. ORDINANCE NO. 1156, PROPERTY MAINTENANCE EQUIPMENT Ordinance No. 1156 was introduced at the October 2, 1995 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1156 (roll call vote): ORDINANCE NO. 1156 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF ARTICLE 4 OF THE TUSTIN CITY CODE, HEALTH AND SANITATION 17. LEGAL SERVICES AGREEMENT At the October 2, 1995 meeting, Mayor Potts requested that this item be continued so that questions he had concerning the agreement could be answered. Because the responses are not completed, staff is recommending continuance of this item. Recommendation" Continue this item to the November 6, 1995 City Council 'meeting as recommended by the City Manager. 18. GENERAL PLAN AMENDMENT 94-001, ZONE CHANGE 94-004, SECOND AMENDMENT TO THE EAST TUSTIN DEVELOPMENT AGREEMENT (IRVINE COMPANY) Staff is requesting that the City Council provide direction on whether they wish the Planning Commission recommendation determined at their October 9, 1995 meeting, be defined as the project (Alternate 3 as modified) or The Irvine Company modified proposal (Alternate 4) be defined as the project for purposes of completing the environmental documentation and public noticing for the project. Recommendation: Provide direction to staff on the preparation of the environmental documentation and public noticing for the project as recommended by the Community Development Department. 19. FACILITY USE POLICIES Councilmember Saltarelli requested that facility use policies and field allocation practices be agendized for discussion. Recommendation: Receive and file subject report as recommended by the Community Services Department. Council Agenda 4 October 16, '1995 20. TERM EXPIRATION, )R TUSTIN COMMUNITY FO TION Of the original seven member Foundation Board, four vacancies exist as of October 12, 1995; and, following expansion of the Board and the addition of Mr. Hirasuma, the Board has eight vacancies to fill. Recommendation: Reappoint Margarete Thompson to a one-year term and Cheryl Bell to a two-year term; and direct the City Clerk to advertise for applicants to fill the remaining Board vacancies as recommended by the Community Services Department. OTHER BUSINESS- City Manager, City Attorney, and City Council COMMITTEE REPORTS- City Council CLOSED SESSION - The City Council will convene in closed session to confer with the City Attorney regarding pending litigation to which the City is a party: Michael'J. Ryerson vs. City of Tustin, William A. Huston, and W. Douglas Franks, OCSC Case No. 739082; and to confer with Nick Nichols, the City's labor negotiator. The employee organizations involved in potential negotiations are Tustin Municipal Employees Association and Tustin Police Officers Association. Unrepresented employees are management and confidential units.
