'RECOMMENDATION
It is recommended that the City Council, at their meeting of October 2, 1995:
1. Approve the attached Amendment No. 2 to Cooperative Agreement No. D93-131; and
2. Adopt the attached Resolution 95-88 approving the Mitigated Negative Declaration for the
Seventeenth Street Widening Project (City of Santa Ana ER No. 93-5) pursuant to the duties
of a Responsible Agency.
FISCAL IMPACT
None. Total funding is provided under OCTA's Combined Funding Transportation Programs (Growth
Management Area No. 7 Funds).
BACKGROUND
Orange County Transportation Authority (OCTA) in cooperation with Caltrans is widening State Route
55 (SR-55) Freeway, which will require the reconstruction of the 17th Street approaches and
overcrossing at the SR-55.
On October 19, 1993, the City Council approved Cooperative Agreement No. D93-131 with the cities
of Tustin, Santa Ana-and the County of Orange to widen the 17th Street overcrossing approaches. On
April 14, 1994, the City Council approved Amendment No. 1 to the Cooperative Agreement to provide
for administrative costs for the City of Santa Ana as the Lead Agency.
After reviewing the preferred alternative for the widening of the 17th Street approaches, the cities and.
County agreed that it will be more cost effective and least inconvenient to the public and adjacent
businesses to request that OCTA include the construction of a westbound right-turn lane between Carroll
Way and the SR-55 Freeway within the City of Tustin as part of the OCTA/Caltrans Freeway
Construction Contract. The second amendment of the agreement authorizes Santa Ana to perform
necessary fight-of-way acquisition services and hazardous waste assessment for the proposed right-turn
lane.
DISCUSSION
The implementation Of the cooperative agreement, as well as its amendments, are considered a "project"
under the California Environmental Quality Act (CEQA) because it authorizes design and construction
of the widening project.
Since portions of the project are within the jurisdictions of the Cities of Tustin, Santa Ana and the
County of Orange, CEQA allows the agencies involved to designate the Lead Agency. The second
amendment to the cooperative agreement identifies the City of'Santa Ana as the Lead Agency and the
City of Tustin as a Responsible Agency for the environmental document.
As the Lead Agency, the City of Santa Ana prepared a Mitigated Negative Declaration (MND) for the
entire project (copy attached). As a Responsible Agency, the City of Tusfin is responsible for: 1)
considering and approving the MND; and 2) mitigating or avoiding the direct and indirect
environmental effects of the portion of the project that it implements, finances or approves.
Within Tustin, the project will modify street frontage along 17th Street and temporarily impact traffic.
Right-of-way acquisition and construction of an additional right turn lane on the north side of 17th Street
will result in: 1) removal of a landscape planter at the existing gas station on the northwest corner of
Carroll Way and 17th Street; and 2) alteration of landscaping, striping of the parking lot and removal
of one parking space at Mimi's Cafe on 17th Street.
Although these modifications are potentially significant, Mitigation Measure (MM) No. 7 requires the
City of Tustin to mitigate for right-of-way acquisition. Also, MM Nos. 13 and 14 require the
appropriate City to resolve Parking issues with affected property owners. In addition, MM No. 17
requires reconstruction or relocation of landscaping that is impacted. Temporary traffic impacts will
be minimized by MM Nos. 12, 15 and 16 which provide for continued signage and access to businesses
as well as devices to facilitate traffic flow during construction.
The Mitigated Negative Declaration was reviewed by City of Tustin staff and circulated for public
review and comment from August 8, 1995 through August 29, 1995. Two comments were received
from Caltrans and the Metropolitan Water District of Southern California. Both agencies requested that
they be consulted during construction of the project. The MND was revised accordingly on September
11, 1995..

OF THE APPROACHES TO THE SEVENTEENTH
STREET OVERCROSSING OF THE SR 55 FREEWAY
THIS AMENDMENT No. 2 to AGREEMENT No. D93-131 and AMENDMENT No. 1 is made
and entered into this day of , 19 by and
among the City of Santa Aha, a municipal corporation of the State of
California ("SANTA'ANA"), the City of Tustin, a municipal corporation of the
State of California ("TUSTIN"), and the County of Orange, a political

subdivision of the State of California ("CO~") .

Recitals:
A. SANTA ANA, TUSTIN and COUNTY entered into Agreement No. D93-131 on
August 31, 1993 and Amendment No. 1 on June 7, 1994 (collectively referred to
herein as the "Agreement") which provides funding for preliminary
engineering, right-of-way maps, legal descriptions and cost estimates for the
widening of 17th Street overcrossing approaches to SR 55 and provides
administrative costs for the lead agency.
B. SANTA ANA, TUSTIN and COUNTY desire to amend the agreement for the
second time to authorize SANTA ANA staff and/or consultants to perform
necessary right-of-way acquisition services and hazardous material assessment
within TUSTIN, and authorize SANTA ANA to enter into agreement with Orange
County Transportation Authority ("OCTA") and use GMA funds to .perform the
above services and pay for staff, others and/or consultants to perform
design, construction and construction engineering within TUSTIN. Also, this
Amendment authorizes the City Engineers of SANTA ANA and TUSTIN and Director
of Transportation of the COUNTY to allocate GMA funds to pay for said
activities.
NOW, THEREFORE, it . ,utually understood and agra Dy SANTA ANA, TUSTIN,
and COUNTY to amend the Agreement as follows:
Paragraph 1 of the Agreement is hereby amended to add the following:
" (e) The CITY of SANTA ANA is the lead agency for the preparing
,nmental Documents for the 17th. Street overcrossing approaches project.
and COUNTY shall each act as and have the power of a Responsible Agency
~suant to the California Environmental Quality Act (CEQA).*
Paragraph 3 of the Agreement is hereby amended to add the following:
"SA/~TA ANA, TUSTIN and COUN/"f agree after reviewing the preferred

"TURN LANE") on westbound 17th Stree5 between Carrol Way and Route 55 in

"7. Councils and Boards of TUSTIN, SANTA ANA and COUNTY authorize the City

Engineers and Director of Transportation to do minor modifications to the
23 Agreement or its Amendments on an as needed basis to expedite the project 'in a
timely manner by entering into a memorandum of understanding."

7. Except as amended, modified or supplemented by this Amendment No. 2, the
. 25 Agreement shall remain in full force and effect and the parties hereby
reaffirm all of its terms, contents and conditions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ACTING AS A RESPONSIBLE AGENCY IN APPROVING THE MITIGATF~
NEGATIVE DECLARATION FOR THE SEVENTEENTH STREET
WIDENING PROJECT, AS PREPARED BY THE CITY OF SANTA ANA,
WITH ALL FEASIBLE MITIGATION MEASURES INCORPORATED AS
REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:
A. That the Seventeenth Street Widening Project is considered a "project" pursuant
to the terms of the California Environmental Quality Act; and

A Mitigated Negative Declaration' has been prepared for this project and
circulated for a 21-day public review and comment period beginning August 8,
1995; and ending August 29, 1995.
C. The City Council of the City of Tustin has reviewed and considered the
Mitigated Negative Declaration.
II.
Mitigated Negative Declaration has been completed in compliance with CEQA and
State guidelines by the City of Santa Aha, acting as the Lead Agency. The City
Council, acting as a Responsible Agency, received and considered the information
contained in the Mitigated Negative Declaration, prior to approving the proposed
project, and found that it adequately discussed the environmental effects of the
proposed project.
On the basis of the initial study and comments received during the public review
period, the City Council finds that although the proposed project could have a
significant effect on the environment, implementation of mitigation measures will
reduce potentially significant environmental effects to a point where clearly no
significant impacts will occur. All mitigation ~ measures identified in the Mitigated
Negative Declaration have been incorporated into a Mitigation Monitoring Program
for this project.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin, held on the 2nd day of'October, 1995

8. LAND USE
The street widening will impact three properties in Santa Ana. A
gas station on the southeast corner of Tustin and Seventeenth
Street will be a full take. Parking spaces will be removed at a
Denny's restaurant and a vacant bank which are located on the south
side of Seventeenth Street between Tustin Avenue and State Route
55. Both properties are considered partial takes.
Two Properties in the City'of Tustin will also be affected: 1) A
landscape planter of an existing gas station on the northwest
corner of Carroll and Seventeenth; and 2) the alteration of
landscaping and or, restriping a parking lot and loss of one (1)
parking space at Tustin's Mimi's Cafe will be impacted by the
project. Both properties will be partial takes. No housing will
be affected as a result of this project. Implementation of the
following mitigation measures will reduce impacts to a level of
insignificance.

The additional alterations to patterns of circulation are
not considered, to be significant due to the scale of the
project and the integration of project generated traffic

which would burden residents and emPloyees in the project
vicinity.
Also, existing parking facilities may be impacted
creating a need for; redesigning the parking on-site,
variances or provision for off-site parking. The

We have received the Mitigated Negative Declaration (MND) for the Widening
of Seventeenth Street. The City of Santa Aha proposes to widen Seventeenth Street between
Yorba Street and Tustin Avenue. The comments herein represent the Metropoliian Water
District's (Melropolitan) response as a potentially affected public agency.
Our review of the MND indicates that Metropolitan's East Orange County
Feeder No. 2 traverses the proposed project site in a nortlV'south direction. The attached map
shows Metropolitan's facility in relation to the proposed project. It will be necessary for the City
to consider this facility in its project planning.
In order to avoid potential conflicts with Metropolitan's faci:lity, we request that
preliminary prints of all improvement plans for any activity in the area of Merropolitan's pipelines
