Background & Discussion cont. • September 18, 2014 - State Legislature revises SB731 through the adoption of AB 1147 - AKA the Massage Therapy Act (MTA). • October 21, 2014 — City Council Adopted Interim Urgency Ordinance No. 1451— creation of "The Moratorium". • December 2, 2014 - City Council Adopted Interim Urgency Ordinance No. 1452. Moratorium Report Committee Formed Potential revisions to the Land Use Code & Business Regulations Corresponded with local jurisdictions Assess massage establishments within Zoning Districts Prepared Code Amendment 2015-003 amending Land Use Code and Business Regulations Recommendation • Adopt Urgency Ordinance No. 1463 for the following reasons: • Provide City Council time to consider Code Amendment 2015-003 • Planning Commission adopted Resolution No. 4296 • Introduction of Ordinance No. 1462 at the October 20, 2015 meeting Recommendation Cont. • The Moratorium Expires on October 22, 2015. • Necessary to prevent the establishment of new or expansion of existing massage establishments. • Conditions still exist for the need of a Moratorium.
