This was corrected prior to the meeting to show Commission Lunn absent instead. Motion carried 5-0. Commissioner Bone moved, Vandaveer seconded, to approve Variance 95-003 by adopting Resolution No. 3378 as submitted. Motion carried 5-0. Commissioner Bone moved, Vandaveer seconded, to recommend to the City Council approval of Tentative Parcel Map 95-115 by adopting Resolution No. 3379 as submitted. Motion carried 5-0. 3. Presentation: Greg Gubman, Assistant Planner Commissioner Lunn moved, Vandaveer seconded, to certify the Final Negative Declaration for the project as adequate by adopting Resolution No. 3382 as submitted. Planning Commission Action Agenda August 28, 1995 Page 4 Commissioner Lunn moved, Mitzman seconded, to approve Conditional Use Permit 95-001 and Variance 95-008 by adopting Resolution No. 33S3 as submitted. Motion carried 5-0. REGULAR BUSINESS: 4. Sign Code Exception 95-001 APPLICANT: OWNER: LOCATION: ZONING: REQUEST: SUPERIOR ELECTRICAL ADVERTISING, INC. 1700 WEST ANAHEIM STREET LONG BEACH, CA 90813-1195 GEORGE W. WILLIS, TRUSTEE 660 LOS ALTOS DRIVE LONG BEACH, CA 90814 14152 NEWPORT AVENUE COMMERCIAL RETAIL (C-i) DISTRICT TO REDUCE THE HEIGHT AND MODIFY THE SIGN CABINET OF AN EXISTING NONCONFORMING POLE SIGN Recommendation -It is recommended that the Planning Commission approve Sign Code Exception 95-001 by adopting Resolution No. 3380, as submitted or revised. Presentation: Greg Gubman, Assistant Planner Commissioner Vandaveer moved, Bone seconded, to approve Sign Code Exception 95-001 by adopting Resolution No. 3380 revised as follows. Condition 1.3 shall read, "Sign Code Exception approval shall become null and void unless a sign permit and building permit are issued for the monument sign and construction of the monument sign is completed within sixty (60) days of the date of this exhibit. Time extensions may be granted by the Director of Community Development if a written request is received by the Community Development Department within five (5) days prior to expiration." Motion carried 5-0. 5. Status Report Receive and File Commissioner Vandaveer moved, Mitzman seconded, to receive and file this report. Motion carried 5-0. Planning Commission Report Sign Code Exception 95-001 August 28, 1995 Page 5 STAFF CONCERNS: 6. Report on Actions taken at the August 21, 1995 City Council Meeting. Staff reported on the subject agend&. COMMISSION CONCERNS: Commissioner Vandaveer - None Commissioner Mitzman Inquired of the City Attorney about his conflict of interest concern on the East Tustin Specific Plan amendments and what was the correct procedure to follow in order to express his personal concerns to the Irvine Company on this issue. The City Attorney informed Commissioner Mitzman that he would not be violating the conflict of interest regulations and had the right to meet with the Irvine Company about his own interests as a homeowner as long as he did not represent himself as speaking for the Planning Commission. Commissioner Bone Asked for a map which would identify existing tracts in East Tustin. Staff will provide an exhibit which will show the tract numbers and names of developments for all of the Commissioners. Was concerned that the Planning Commission does not currently have representation on the Task Force Committee for the Base Closure. The Director stated that the Task Force Committee at present is limited to 17 members. Former Planning Commissioner members had been retained on the Committee, leaving no representation from the present Commission membership and if they wanted to be adequately represented the City Council should be approached by the Commission to request that the matter be agendized. Planning Commission Report Sign Code Exception 95-001 August 28, 1995 Page 6 The next Task Force meeting is scheduled for September 7th at 4:00 p.m. and the Director suggested that any Commission members who were available attend the meeting as a member of the audience even before an appointment by the City Council is made. The City Attorney suggested that any of the Commission members who are interested in being appointed to the Task Force, contact the Director in the morning. Commissioner Lunn - None Commissioner Kasalek - None Commissioner Lunn moved, vandaveer seconded, to adjourn the meeting at 7:40 p.m. Motion carried 5-0. ADJOURNMENT: The next regularly scheduled meeting of the Planning Commission is on September 11, 1995 at 7:00 p.m. in the City Council Chambers at 300 Centennial Way, Tustin.
