FISCAL IMPACT None BACKGROUND/DISCUSSION At the July 17, 1995 meeting of the City Council, City_ Building Official, Rick Brown, provided a report regarding compliance with the revised construction noise regulations that were adopted in February 1995. Following the presentation, Mr. Ralph Fellick of Tustin Roofing and Mr. James Kilbourne of Ross & Barrows Roofing, addressed the Council. Both contractors expressed concerns regarding the limitation of hours for construction noise and prohibition of construction noise on federal holidays. The Council directed the Building Official to meet with the contractors to further discuss their concerns and to survey Orange County cities regarding their regulations pertaining to reroofing and construction noise. Ail cities in the county and the County were sent surveys. Twenty one jurisdictions responded with completed surveys. The survey results are as follows: 1) Ail cities require reroofing permits; 2) All jurisdictions require reroofing inspections; 3) No special hours or days for reroofing are established beyond those allowed for other construction activity; 4) Six cities indicated that construction noise was not an issue within their community; City Council Report Construction Noise August 21, 1995 Page 2 5) Fifteen cities indicated that reroofing is not allowed on Sundays and federal holidays. Five cities indicated that reroofing (or other construction) could occur on Sundays or federal holidays if it did not exceed their noise ordinance decibel limits. One city responded that reroofing (or other construction) was prohibited on Sundays bun could occur on holidays that fall on a weekday. The cities who responded no the survey were Anaheim, Brea, Westminister, Orange, Los Alamitos, Santa Ana, Laguna Beach, Irvine, Laguna Niguel, FullerSon, Yorba Linda, San Juan Capistrano, Lake Forest, Newport Beach, San Clemente, Villa Park, Garden Grove, Placentia, Buena Park, Mission Viejo, and the County of Orange. On August 10, 1995, the City Building Official met with Mr. Fellick, as directed by the Council. Mr. Fellick requested that the Council consider the possibility of removing President's Day, Labor Day and Veteran's Day from the list of federal holidays for which construction noise is prohibited. The current noise ordinance language prohibits construction noise on all federal holidays. Upon direction from the Council, staff could draft such ordinance revisions for presentation at a future meeting. Mr. Fellick and the Building Official discussed the possibility of using "special inspectors" for roofing inspections during busy periods. The ability to use "special inspectors" for such inspections currently exists per Uniform Administrative Code Section 306(14). If such inspections are required, the Building Official may authorize such inspections without requiring additional Council action. The ordinance provisions for the approval of construction hours beyond regular hours were also explained to Mr. Fellick by the Building Official. The Building Official or Public Works Director may approve alternative construction hours for emergency situations or for work occurring in areas that are adequately separated from residential properties. City Council Report Construction Noise August 21, 1995 Page 3 CONCLUSION City staff will continue to enforce the noise ordinance in a reasonable manner. The Building Division will continue to provide the highest level of inspection service possible. The special needs of roofers are accommodated, especially during rainy periods, by prioritizing reroofing inspections to limit the time for which a building is exposed to the elements.
