RECOMMENDATION
It is recommended that the City Council authorize the City Manager
to enter into a professional services contract with Ken Emanuels
and Associates for legislative advocacy services.
FISCAL IMPACT
The proposed fee for services is $1,500 a month which will be
reimbursable from the Redevelopment Agency once a MCAS, Tustin
Redevelopment Project Area is created and tax increment generated.
BACKGROUND
In conjunction with creation of a redevelopment project area to
facilitate the conversion of MCAS, Tustin to civilian use, the City
is desirous of sponsoring special urgency legislation which is
similar to special legislation recently adopted to assist
conversion of March Air Force Base (AB 3769), Mather Air Force Base
(33492.63) and Mare Island (SB 1035). It was originally
anticipated that any legislative issues that needed to be dealt
with would have been handled with AB 1648 which was introduced this
session by Assemblyman Conroy to benefit redevelopment at all base
closure sites in the State. Unfortunately, the Assembly Housing
and Community Development Committee review of AB 1648 resulted in
it being tabled at this time. The general sentiment on the part of
the key committee members and committee chairman Dan Hauser was
that the committee preferred to see special legislation for each
base.
With the delay in a determination of surplus property at MCAS,
Tustin and the beginning of realignment operations as early as
April 1996, staff believes it is urgent that we proceed with
special legislation to ensure capture of tax increment for any
initial interim leases that would be possible at the base.
Specifically, special legislation would primarily propose to:

clarify the definition of blight
redefine a definition of urbanization at MCAS, Tustin and
the required 80% urbanized requirement
authorize the Tustin Redevelopment Agency to include
limited areas outside of the base in Tustin's
jurisdiction (property north of the base to the railroad
right-of-way) under limited terms and conditions
authorize the deferral of low and moderate income fund
deposits for up to 10 years
defer the requirement that the redevelopment plan conform
to the General Plan
authorize the requirements to comply with the California
Quality Act. An EIR would not need to be certified until
18 months after the adoption of the Plan
The City has requested a proposal from Ken Emanue! and Associates
who is the most knowledgeable lobbyist in California on
Redevelopment Agency matters and who represents uhe California
