WORKSHOP- At 5:30 p.m., the City Council will conduct a budget workshop and this workshop is open to the public. CALL TO ORDER / PLEDGE OF ALLEGIANCE / INVOCATION ROLL CALL PROCLAMATIONS- Man and Woman of the Year: Sam Randall and Laurie Gorham; Former Members of Commissions and Committees: Al Baker and Kathy Well, former members of the Planning Commission; Terri Neal, Ken Royal and Margarete Thompson, former members of the Parks and Recreation Commission; Daniel O'Connell, former member of the Audit Committee; and Tustin High School Boys~Varsity Volleyball Team PRESENTATION- Orange County Vector Control Update, Fabby Combs PUBLIC INPUT- At this time members of the public may address, the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO ACTION can be taken on off-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. PUBLIC HEARINGS (ITEMS I THROUGH 2 ) 1. PLACING ASSESSMENT FOR SOLID WASTE COLLECTION ON 1995-96 TAX ROLL Great Western Reclamation has requested an adjustment in the solid waste collection fees for 1995-96 of 10.26 percent, $1.14 per month per unit. Recommendation: Conduct first public hearing of Resolution No. 95-68 which directs the Finance Director to place the charges for sOlid waste collection on the tax roll for Fiscal Year 1995-96 as recommended by the Finance Department. Council Agenda I July 17, 1995 2. , FISCAL YEAR FOR THE LEVY OF ANNUA SSESSMENTS FOR THE 1991 TUSTIN LANDSCAr,= AND LIGHTING DISTRICT The Landscape and Lighting District provides for the maintenance of the perimeter landscaping on the arterial highways within Tustin Ranch area and for the operation and maintenance of the street lighting within the Tustin Ranch area and other locations within the City which were not included in the original Tustin Lighting District. The proposed levy of assessments for both the street lighting and landscaped elements remain unchanged for the 1995-96 fiscal year. Recommendation: Adopt the following Resolution No. 95-67 confirming the annual 1995-96 fiscal year levy of assessments for the Tustin Landscape and Lighting District as recommended by the Public Works Department/Engineering: RESOLUTION NO. 95-67 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING THE ANNEXATION OF ADDITIONAL TERRITORY TO AN EXISTING DISTRICT AND CONFIRMING THE ANNUAL 1995-96 FISCAL YEAR LEVY OF ASSESSMENTS FOR THE IMPROVEMENT, MAINTENANCE AND SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES WITHIN THE BOUNDARIES OF THE TERRITORY INCLUDED IN THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT CONSENT CALENDAR (ITEMS 3 THROUGH 8) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 3t APPROVAL OF MINUTES - JULY 3, 1995 REGULAR MEETING Recommendation: Approve City Council Minutes of July 3, 1995. t APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL : Recommendation: Approve Demands in the amount of $1,492,234.96 and ratify Payroll in the amount of $323,153.65. Bt AGREEMENT REGARDING RIDES AND CONCESSIONS AT TUSTIN TILLER DAYS Recommendation: Approve subject agreement with Hassett & Davis to operate a carnival at Tustin Tiller Days on October 6-8, 1995 as recommended by the Community Services Department. St CONFIRMATION OF PARKS AND RECREATION COMMISSION APPOINTMENT Recommendation: Confirm appointment of Robert Schultz to the Parks Recreation Commission as recommended by the City Attorney. and . RESOLUTION NO. 95-66 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION FoR INSTALLATION OF TRAFFIC SIGNAL AND SAFETY LIGHTING AT TUSTIN RANCH ROAD AND PIONEER WAY Recommendation: Adopt Resolution No. 95-66 accepting said work as complete and authorize the recordation of the Notice of Completion, and direct the City Clerk to Council Agenda 2 July 17, 1995 8. (1) Release the Labor and Materials Payment Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion and (2) Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion as recommended by the Public Works Department/ Engineering Division. PLANNING COMMISSION ACTION AGENDA - JULY 10, 1995 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify Planning Commission Action Agenda of July 10, 1995. REGULAR BUSINESS (ITEMS 9 THROUGH 14) 9, ORDINANCE NO. 1153 - SIGN CODE REVISIONS FOR NON-COMMERCIAL SIGNS AND REMOVAL OF POLITICAL SIGNS Ordinance No. 1153 had first reading by title only and introduction at the July 3, 1995 City Council meeting. Recommendation' Have second reading by title only and adoption of the following Ordinance No. 1153 (roll call vote)' ORDINANCE NO. 1153'- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING AND ADDING SIGN REGULATIONS FOR NON- COMMERCIAL SIGNS INCLUDING THE TIMELY REMOVAL OF POLITICAL SIGNS IN THE CITY OF TUSTIN 10. ORDINANCE NO.'1154 - CAMPING AND STORAGE OF PERSONAL PROPERTY IN PUBLIC AREAS Ordinance No. 1154 had first reading by title only and introduction at the July 3, 1995 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1154 (roll call vote)' 11. ORDINANCE NO. 1154 - AN ORDINANCE OF THE CITY' COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA., ADDING CHAPTER 6 ENTITLED CAMPING AND STORAGE OF PERSONAL PROPERTY TO ARTICLE 7 OF THE TUSTIN CITY CODE .. ORDINANCE NO. 1155 - TEMPORARY REGULATIONS FOR APARTMENT SIGNS Ordinance No. 1155 had first reading by title only and introduction at the July 3, 1995 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1155 (roll call vote): Council Agenda 3 July 17, 1995 ORDINANCE NO..' ~ - AN ORDINANCE OF THE Cl; ;OUNCIL OF THE CITY OF TUSTIN, CALIFORI~,~, ADOPTING REGULATIONS FOR I'EMPORARY DECORATIVE FLAGS AND DISPLAYS FOR RESIDENTIAL APARTMENT COMPLEXES WITH 20 OR MORE UNITS 12. STATUS REPORT ON CONSTRUCTION NOISE In response to a request from The Irvine Company for approval of Saturday construction hours, the City Council adopted Ordinance No. 1143 on February 6, 1995, authorizing Saturday construction between the hours of 9:00 a.m. and 5:00 p.m. Upon adoption of the new code provisions, the City Council requested a review of compliance with the new ordinance within approximately three months of its effective date. Recommendation: Receive and file subject report as recommended by the Community Development Department. 13. GENERAL PLAN AMENDMENT 94-001, ZONE CHANGE. 94-004, SECOND AMENDMENT TO THE EAST TUSTIN DEVELOPMENT AGREEMENT AND TENTATIVE TRACT MAP 15055 (THE IRVlNE COMPANY) The applicant is proposing several amendments to the Land Use Plan and text of the East Tustin Specific Plan (ETSP) related primarily to three separate vacant parcels within the ETSP area. Recommendation: Continue this item to the August 7, 1995 City Council meeting as recommended by the Community Development Department. 14. FEE WAIVER - DINOSAUR DASH The Tustin Public Schools Foundation will be holding the fourth annual Dinosaur Dash on November 12, 1995. In addition to utilizing City staff and equipment, the Foundation is requesting that the City Council waive all fees for permits. Recommendation: Pleasure of the City Council. RTS - City Council Council Agenda 4 July 17, 1995 'i ' ~ ' CLOSED SESSION- Th~ City Council will convene in closeu,~ession to confer with the City Attorney regarding pending litigation to which the City is a party: City of Tustin vs. GeoSoils, E. L. Yeager, and Sam Johnson, OCSC Case No. 73-27-66; and to confer with the City Attorney regarding anticipated litigation, the initiation of litigation pursuant to Government Code Section 54956.9(c), one potential case.
