INTERVIEWS- At 5:00 p.m., the City Council will conduct interviews to fill vacancies on the Planning Commissio.n, Parks and Recreation Commission, Audit Committee, Youth Issues Committee, and Water Corporation Board. The public is invited to attend these interviews. A Public Input portion is provided both at the beginning and end of the meeting. · PUBLIC HEARINGS (ITEMS I THROUGH 2 ) CODE AMENDMENT 95-03, REGULATIONS AFFECTING CAMPING AND STORAGE OF PERSONAL PROPERTY IN PUBLIC AREAS In 1992, the City of Santa Ana's ordinance regulating camping and storage of personal property in public areas such as public right-of-ways, city hall, city parks, etc. was challenged by representatives of the homeless as unconstitutional. The Supreme Court upheld Santa Ana's camping and storage prohibition, ruled it constitutional and enforceable. With the final ruling, it is now possible for the City of Tustin to enact a similar ordinance. Recommendation' Have first reading by title only and introduction of the following Ordinance No. 1154 to approve restrictions on camping and storage of personal property on public streets and other public property as recommended by the Community Development Department: ORDINANCE NO. 1154 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING CHAPTER 6 ENTITLED CAMPING AND STORAGE OF PERSONAL PROPERTY TO ARTICLE 7 OF THE TUSTIN CITY CODE Council Agenda 1 July 3, 1995 0 CODE AMENDMENT .002, REVISIONS TO SIGN CO. OR NON-COMMERCIAL SIGNS AND REMOVA--~OF POLITICAL CAMPAIGN SlGI~i~5" The intent of the proposed amendments are to: (1) set reasonable time, place and manner regulations for non-commercial signs; (2) to provide the City with reasonable enforcement and removal authority for signs that do not comply with these restrictions and; (3) to make the political sign approval process less cumbersome and more easily understood. Recommendation by the Community Development Department: 1. Approve the Environmental Determination for the project by adopting the following Resolution No. 95-59' RESOLUTION NO. 95-59 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR CODE AMENDMENT 95-002 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT 2, Have first reading by title only and introduction of the following Ordinance No. 1153 approving Code Amendment 95-002 as submitted or revised: .. ORDINANCE NO. 1153 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING AND ADDING SIGN REGULATIONS FOR NON-COMMERCIAL SIGNS INCLUDING THE TIMELY REMOVAL OF POLITICAL SIGNS IN THE CITY OF TUSTIN e Direct the City Clerk to include a handout to be prepared by the Community Development Department with all election handout materials p[ovided to political candidateS. Council Agenda 2 July 3, 1995 '155 (13331 · FOOTi-t.,..,tBOULEVARD) TO BE ANNEXE~-.,"O THE CITY OF TUSTIN Recommendation: Adopt Resolution No. 95-62 ordering the territory known as "Annexation No. 155" (13331 Foothill Boulevard, Rawlings Reservoir) to be annexed to the City of Tustin as recommended by the Community Development Department. 71 RESOLUTION NO. 95-65 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN REPLACEMENT PROJECTS, PROJECT NO. 600117, FOR ETHELBEE WAY, SANTA CLARA AVENUE, RALEIGH PLACE, DEBUSK LANE,. WALTER AVENUE, AND EL CAMINO LANE Recommendation: Adopt Resolution No. 95-65 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Water Division. Si ACCEPTANCE OF MONUMENTATION AND AUTHORIZATION FOR RELEASE OF MONUMENTATION BOND FOR TRACT NO. 12870 Recommendation: Accept the monumentation as set per the final map of Tract No. 12870 and authorize the City Clerk to release the Monumentation Bond as recommended by the Public Works Department/Engineering Division. · ACCEPTANCE OF IMPROVEMENTS AND AUTHORIZATION FOR THE RELEASE OF IMPROVEMENT BONDS FOR TRACT NO. 13990 Recommendation: Accept the public improvements for Tract No. 13990 and authorize the City Clerk to release the Faithful Performance, .Labor and Materials, and Monumentation Bonds for said Tract as recommended by the Public Works Department/Engineering Division. 10. ACCEPTANCE OF IMPROVEMENTS AND AUTHORIZATION FOR THE RELEASE OF IMPROVEMENT BONDS FOR TRACT NO. 13701 Recommendation: . ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO RELEASE IMPROVEMENT BONDS FOR 1100 EDINGER AVENUE (MICRO CENTER) Recommendation: Accept the public improvements for 1100 Edinger Avenue and authorize the City Clerk to release the Faithful Performance and Labor and Materials Bonds as recommended by the Public Works Department/Engineering Division. 12. RESOLUTION NO. 95-63 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND. SPECIFICATIONS FOR THE CONSTRUCTION OF STREET IMPROVEMENTS FOR SAN JUAN STREET WIDENING FROM NEWPORT AVENUE TO ORANGE STREET AND WALNUT STREET WIDENING FROM NEWPORT AVENUE TO ORANGE STREET Recommendation: Adopt Resolution No. 95-63 approving plans and specifications for the construction of street improvements for San Juan Street widening from Newport Avenue to Orange Street, and Walnut Street widening from' Newport Avenue to Orange Street and authorizing and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. AWARD OF CONTRACT FOR PHASE IV REGIONAL TRAILS, ASSESSMENT DISTRICT 86-2 (PROJECT NO. 700085) Recommendation: Award the contract for the Phase IV Regional Trails, Assessment District 86-2 (Project No. 700085) to Chase MCD, inc., Newport Beach, California, in the amount of $446,6443.01 as recommended by the Public Works Department/ Engineering Division. 15. AWARD OF CONTRACT FOR PINETREE PARK PARKING BAY IMPROVEMENTs, SOUTHSIDE OF BRYAN AVENUE ADJACENT TO PINETREE PARK BETWEEN UTT DRIVE AND RED HILL AVENUE (PROJECT NO. 700136) ...ReCommendation: Award contract for subject project to Gillespie Construction, Inc., Costa Mesa, California, in the amount of $64,572.70 as recommended by the Public Works Department/Engineering Division. 16. AWARD OF CONTRACT FOR INSTALLATION OF TRAFFIC SIGNAL AND' INTERCONNECT AT EL CAMINO REAL/ORANGE STREET Recommendation: Award the contract for subject project to Superior Signal Service Corporation in the amount of $84,218.00 as recommended by the Public Works Department/Engineering Division. 19. PLANNING COMMISSION ACTION AGENDA.- JUNE 26~ 1995 All actions of the Planning Commission become final unless appealed by the City Council-or member of the public.- Recommendation: Ratify Planning Commission Action Agenda of June 26, 1995. COMMISSION/COMMITTEE APPOINTMENTS Oral interviews of candidates will be held prior to the July 3rd meeting and the final step in the selection process, if the Council desires, would be completion of voting ballots by the City Council in open session. EVIEW 95-006 (THE HOME D~-,.~') On May 22, 1995, the Planning Commission conditionally approved outdoor displays at The Home Depot on a temporary basis through September 5, 1995. On May 26, 1995, the City received a request from Greenberg Farrow, representatives of The Home Depot, appealing several conditions of approval of Planning Commission Resolution No. 3358. PROJECT FUNDING FOR AB 2766 PROGRAM AB 2766 funds are made available to local governments for use in offsetting State mandated vehicle emissions reduction programs. Recommendation by the Community Development Department· I · Ratify the annual report and authorize the use of City AB 2766 funds to offset costs associated with the implementation of various programs designed to reduce vehicle emissions within the City of Tustin. Authorize the City Manager. to approve additional AB 2766 expenditures, consistent with Air Quality Management District guidance, throughout the 1995-96 program year as needed. TEMPORARY SIGN REGULATIONS FOR APARTMENT SIGNS (TUSTIN EFFECTIVE APARTMENT MANAGERS) At the June 19, 1995 City Council meeting, Regina Amthauer, PreSident of Tustin Effective Apartment Managers, addressed the'City Council with a proposal to make temporary changes to the Sign Code and to relax the enforcement of temporary on- site signs at apartment complexes until interim regulations could be adopted. Recommendation- Have first reading by title only and introduction of the following Ordinance No. 1155, as submitted or revised, as recommended by the Community Development Department: ORDINANCE NO. 1155 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY' OF TUSTIN, CALIFORNIA, ADOPTING REGULATIONS FOR TEMPORARY DECORATIVE FLAGS AND DISPLAYS FOR RESIDENTIAL APARTMENT COMPLEXES WiTH 20 OR MORE UNITS FIRE SERVICES AGREEMENT Prior to formation of the Fire Authority in March 1995, the City had contracted with the County of Orange. The agreement with the Fire Authority provides the same level of service that had been provided through the County and under essentially the same terms and conditions. Recommendation by the City Manager: Approve an agreement with the Orange County Fire Authority for fire suppression, prevention and paramedic services; and Council Agenda 5 July 3, 1995 it is further recomr led that Section 2(a) of thc reement be subject to clarification set forth 'a letter dated June 21, 1995, ,rom the Director of Fire Services in response to a letter dated June 7, 1995, from the Tustin City Manager. The agreement continues until terminated by either party. 25. GENERAL PLAN AMENDMENT 94-001, ZONE CHANGE 94-004, SECOND AMENDMENT TO THE EAST TUSTIN DEVELOPMENT AGREEMENT AND TENTATIVE TRACT MAP 15055 (THE IRVINE COMPANY) The applicant is proposing several amendments to the La'nd Use Plan and text of the East Tustin Specific Plan (ETSP) related primarily to three separate vacant parcels within the ETSP area. Recommendation: Continue this item to the July 17, 1995 City Council meeting as recommended by the Community Development Department. OTHER BUSINESS- City Manager, City Attorney, and City Council COMMITTEE REPORTS- City Council CLOSED SESSION-- The City Council will convene in closed session to confer with the City Attorney regarding: (1) litigation to which the City' is a party, Lindgren vs. City of Tustin; and (2) a claim'filed by Arnold McGuire. A copy of the claim may be obtained from the City Clerk. ADJOURNMENT - The City Council has scheduled a Budget Workshop on July 17, 1995, at 5:30 p.m. in the Council Chambers and the next regular meeting of the City CounCil is scheduled for Monday, July 17, 1995, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
