ROLL CALL Present: Councilmen: Edgar, Sharp, Saltarelli, Welsh, Schuster Absent: Councilmen: None Others Present: William Bopf, City Administrator Ruth Poe, City Clerk James Rourke, City Attorney (arrived at 7:35 pm) V. PUBLIC HEARING 1. MARINE CORPS AIR STATION (HELICOPTER) ANNEXATION NO. 71B Mayor Edgar declared this to be the noticed time and place for the hearing on the Marine Corps Air Station (Helicopter) Annexation No. 71B and declared the hearing opened. There being no protests or comments, Mayor Edgar declared the hearing closed. Mr. Rourke explained the litigation pending with hearing to be held March 29. Mr. Rourke stated that the court has ordered and the City has agreed to take no further action on the annexation other than the holding of the hearing. Mr. Rourke recommended that any necessary resolutions and ordinances to complete this annexation be presented at the April 5 meeting. After further discussion and clarification of this point, it was moved by Sharp, secondedby Welsh that the record show the fact that a protest hearing was held, none of the property owners appeared and there were no written protests received, and that the hearing was then duly and properly closed and that the item awaits further action. Carried by roll call. Ayes: Edgar, Sharp, Saltarelli, Welsh, Schuster. Noes: None. Absent: None. VI. ORDINANCE FOR INTRODUCTION AND ADOPTION 1. ORDINANCE NO. 680 An Ordinance of the City Council of the City of Tustin, California, PREZONING THE MARIE CORPS AIR STATION (H) AND ELATED LANDS TO THE PUBLIC AND INSTITUTIONAL (P&I) DISTRICT. Moved by Welsh, seconded by Sharp that Ordinance No. 680 have first reading by title and be introduced. Carried unanimously. Moved by Saltarelli, seconded by Welsh that Ordinance No. 680 have second reading by title~ Carried u~animously. Moved by Welsh~ seconded by Saltarelli that Ordinance No. 680 be passed and adopted as an urgency measure. Carried by roll call. Ayes: Edgar, Saltarelli, Welsh, Sharp, Schuster. Noes: None. RELEASE OF BUILDING PERMITS FOR TRACT 8912 - (PEPPER TREE) Moved by Saltarelli, seconded by Sharp that paragraph 2e of Resolution No. 76-20, be amended as recon~nended by the Planning Corm~ission, and authorize staff to issue building permits on the basis of the wall plans and letters of consent that have been submitted by adjoining property owners. Carried. In answer to questioning, Mr. Bopf stated that there has been no additional correspondence from developer or three parcels that had not been heard from at date of report. We do have a depiction of how that area would be treated if agreement is not reached with those property owners. Notice was sent to homeowners association .of proposed Planning Commission and no one appeared at that meeting. This action would release the building permits for all the properties if he builds according to plans. Above motion carried. 2.PRESENTATION/REPORT BY MR. A. HOLUB, CITY REPRESENTATIVE TO HEALTH PLANNING COUNCIL Mr. Holub and Mr. Stan Matek of the Orange County Health Planning Council gave reports on activities for past year, medical costs, funding problems, and future plans including the efforts to have the Health Planning Council designated as the Health Service Area under the new Federal Law 93-641. Also explained the Council's 1975 Orange CoUnty Health Plan, a Responsibility booklet. Mr. Holub distributed packets of information on the year's activities to the Council. 3. RESOLUTION NO. 76-31 A Resolution of the City Council, City of Tustin, California, COMMENDING AND EXPRESSING APPRECIATION TO REX WALDO Moved by Sharp, seconded by Saltarelli, that R~solution No. 76-31 be read by title. Carried. Councilman Saltarelli stated he has had the opportunity through his business experience throughout the City to obsezve Mr. Waldo in the veEy diffficutt task of daily facing people who have problems with permits, etc. and he has always conducted himself in difficult situations in a manner that well represents the City. Moved by Welsh, seconded by Saltarellithat Resolution No. 76-31 be passed and adopted. Carried unanimously. VIII. OTHER BUSINESS 1. SENATE BILL 1510 Mr. Bopf explained the bill provides that under the proposed legislation a City upon receiving a petition from one or more property owners in a completely surrounded unincorporated island could then go to a protest hearing and if they failed to receive over 50% by assessed valuation of protests, the hearing could be terminated and the property annexed without the need of an election. Mr. Saltarelli commented on a rider that will go in this bill that a City Council could annex in absence of protest of 50% of the property owners or 50% of the voters. The LAFCO went on record in support~ Consensus of the Council that a letter be sent in support of this bill and copies be sent to other cities. City Council Minutes 3/25/76 Page 3. 2. TENTATIVE POPULATION REPORT Mr. Bopf reported that the tentative population estimate from the State is 29,400. The State shows a vacancy factor in excess of 6%. The City has checked the vacancy factor and can document a 1.1% factor. This information will be forwarded to Sacramento and hope we can strongly protest their findings. Mr. Bopf stated that a vacancy factor change from 6% to 1.1% would bring the population to the vicinity of 30,500 to 30,600. Council concurred that a very strong letter should be sent by staff and if not successful, staff to return the matter to the Council. 3. BICENTENNIAL 4TH OF JULY ACTIVITIES Mr. Bopf brought to the attention of the Council the estimated cost to the City to support the parade. It is estimated that the cost to the City would be $3,500 to $4,500. This will double police budget in this element. Mr. Bopf said he was bringing this to the Council's attention for their consideration prior to their seeing the budget about April 7. 4. LAFCO TERM Councilman Saltarelli advised Council that his term as a member of LAFCO would terminate at the first of May and asked Council to consider and inform him if he should seek the position again. IX. ADJOURNMENT Mayor Edgar declared the meeting adjourned to an executive session and then to the next regular meeting of April 5, 1976.
