HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP 14934 (SHEA HOMES) RECOMMENDATION It is recommended that the City Council adopt Resolution No. 95-54 approving Final Tract Map 14934. FISCAL IMPACT The Final Map is an applicant initiated project. The applicant has paid application fees to recover the cost of processing this application. BACKGROUND On June 12, 1995, the Planning Commission adopted Resolution No. 3363 recommending to the City Council' approval of Final Tract Map 14934. On July 25, 1994, the Planning Commission adopted Resolution No. 3290 recommending to the City Council approval of Vesting Tentative Tract Map 14934. The City Council approved Vesting Tentative Tract Map 14934 on August 15, 1994, by adopting Resolution No. 94-101. These approvals included numerous conditions to be met prior to approval of the final map, with which the applicant has complied. The Final Map is now ready for recordation with the Orange County Recorders Office. Prior to recordation, the Final Map must be reviewed and approved by the Planning Commission and City Council. Final Map 14934 includes 145 numbered lots and 35 lettered lots to accommodate the development of 145 single-family dwellings on an 11.85 gross acre site. Final Map 14934 is located at the southerly terminus of Newport Avenue, bounded on the north by single and multiple family residential, AT&SF railroad and flood control channel on the south, the Tustin Unified School District Maintenance facility On the east and multiple family residential across Newport Avenue to the west. City Council Report Final Tract Map 14934 June 19, 1995 Page 2 CONCLUSION The resolutions approving the tentative tract map for this project included numerous conditions which were required to be satisfied prior to recordation. All required conditions have been met. Staff has determined that the Final Map is in conformance with the Vesting Tentative Tract Map approvals, the City's Zoning Code and Subdivision Code, and the State Subdivision Map Act. Based upon this conformance, it is recommended that the City Council approve Final Tract Map 14934. The City Council finds and determines as follows: ae That Final Tract Map 14934 has been submitted by Shea Homes. Be That a public hearing was held by the Planning Commission on July 25, 1994. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14934 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 14934 on August 15, 1994. Co The Final Map is considered ministerially exempt pursuant to Section 15268(b) of the California Environmental Quality Act. D· That the proposed subdivision is in conformance with the Tustin Area General Plan, the Tustin Zoning Code and Subdivision Map Act as it pertains to residential development. Ee That the proposed subdivision would not have an impact of'School District facilities. Fe That the site is physically suitable fOr the type of development proposed. Go That the site is physically suitable for the proposed density of development. Ho That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. I · That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision. Je That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. The City Council hereby approves Final Tract Map 14934, subject to final approval by the City Engineer.
