HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - ACCESS RAMP INSTALLATION/MODIHCATIONS FOR COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT (ClP NOS. 200036 AND 200035) RECOMMENDATION It is recommei~ded that the City Council, at their meeting June 19, 1995, adopt the attached resolution accepting said work as complete and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: , Release thc Labor and Materials Payment Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and · , Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, that the Council authorize payment of the final 10% retention in the amount of $22,640.10. This amount together with previous payments of $203,760.86 represents 100% of the final contract amount. FISCAL IMPACT The f'mal cost of construction is $226,400.96 which is funded from the City's Capital Improvement Program/Budget 1994-95 FY as follows: $222,818.71 from CIP No. 200036, and $3,582.25 from CIP No. 200035. BACKGROUND AND DISCUSSION As a component of the City's Self-Evaluation and Transition Plan, to comply with the requirements of the Americans with Disabilities Act of 1990, these projects provide access ramps at various intersections within the public right-of-way and access to public facilities throughout the City. This work has been completed to the satisfaction of the Engineering Division. The final contract amount is $226,400.96. This represents an increase of 10.5 percent from the original contract amount of $204,868.51. The increase reflects final measured field quantities and additional access ramp locations added to the contract to meet the City's Maintenance of Effort requirement for the Measure M Program. Tim D. Serlet Director of Public Works/ City Engineer Nestor Mondok Assistant Civil Engineer TDS:NM:idb:~ccnun~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14, 15 16 17 18 19 20 21 24 25 26 27 28 RESOLUTION NO. 95-58 A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE ACCF_~S RAMP INSTALLATION/MODIFICATIONS FOR COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT (CIP NOS. 200036 AND 200035) WHEREAS, Lambaren Contractors, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and paym~n( of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be,'and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Access Ramp Installation/Modifications for Compliance with the Americans with Disabilities Act (CIP Nos. 200036 and 200035) PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 19th day of June, 1995.
