LEVY OF ANNUAL ASSESSMENTS FOR THE 1995-96 FISCAL YEAR FOR THE
TUSTIN LANDSCAPE AND LIGHTING DISTRICT
RECOMMENDATION
It is recommended that the City Council, at their meeting of June 19, 1995, adopt the following
resolutions:
I. Resolution No. 95-56 approving the Engineer's Report for the Fiscal Year 1995-96; and
,
Resolution No. 95-57 declaring its intention tO annex additional territory, levy
assessments for Fiscal Year 1995-96 and set a Public Hearing for July 17, 1995.
FISCAL IMPACT
None. All City costs will be recouped through the levy of the annual assessments for the district.
BACKGROUND AND DISCUSSION '
The Engineer's Report prepared by BSI Consultants, Inc., has been filed with the City Clerk and
contains the proposed levy of assessments for Fiscal Year 1995-96. There are two new parcels
proposed for annexation to the district this upcoming fiscal year and are identified as follows:
Assessor Parcel No. 401-122-18 - 14442 Holt Avenue
Assessor Parcel No. 500-082-18 - 13652 Green Valley Avenue
These annexations were conditions of approval for projects filed this past fiscal year and will only be
assessed for street lighting costs.
The recommended 1995-96 Fiscal Year assessments are shown below:

The landscape maintenance segment of the district covers only the areas within the Tustin Ranch area
between the curbline and the perimeter walls along the arterial street system, the landscaping adjacent
to the regional trails and the slopes along Jamboree Road between Tusfin Ranch Road and the northerly
city limits. The maintenance of median islands within the East Tusfin area as well as the remainder of
the City is funded from the general fund. Developed commercial frontages and local street landscaping
are maintained privately by associations, either business or homeowners.
The street lighting segment of the District includes both the East Tusfin area and various other locations
throughout the City which were not previOusly included in the original Tusfin Lighting District. These
locations/areas are shown on the maps marked "Exhibit B" of the Engineer's Report.
The proposed levy of assessments has remained the same for both the street lighting and landscaped
elements for the 1995-96 Fisc~ Year as compared to last year as follows:

The total costs to be assessed for lighting and landscape maintenance for fiscal year 1995-96 are
$97,355.00 and $288,117.00 restx~tively.
CONCLUSION
The two attached resolutions require adoption by the City Council at their June 19, 1995 meeting.
These resolutions provide for the following:
Resolution No. 95-56 approves the Engineer's Report for the 1995-96 Fiscal Year for
the levy of annual assessment for the Tustin Landscape and Lighting District and for the
annexation of additional territory to said existing district.
Resolution No. 95-57 declares the City Council's intention to order the annexation of
additional territory to an existing district and to provide for an annual levy of assessment
for said Landscape and Lighting District to levy and collect assessments pursuant to the
Landscape and Lighting Act of 1972. Resolution No. 95-57 also sets the date, time, and

plaCe for a public hearing concerning the annual levy of assessment for the District and
all other matters related thereto. The hearing is scheduled for Monday, July 17, 1995
at 7:00 p.m. in the City Council Chambers, 300 Centennial Way, Tustin California.

RESOLUTION NO. 95-56
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ORANGE COUNTY, CALIFORNIA, APPROVING THE ENGINEER'S
REPORT FOR THE 1995-96 FISCAL YEAR FOR THE LEVY OF ANNUAL
ASSESSMENT FOR THE TIJSTIN LANDSCAPE AND LIGHTING DISTRICT
AND FOR THE ANNEXATION OF ADDITIONAL TERRITORY TO SAID
EXISTING DISTRICT
WHEREAS, by Resolution 95-47, the City Council initiated proceedings for the
1995-96 Fiscal Year for the levy of annual assessments and for the annexation of
additional territory to said existing district and ordered the Engineer to prepare a report
in accordance with Section 22565 of the State of California Streets and Highways Code;
and
WHEREAS, pursuant to said resolution, the Engineer has filed the report with
the City Clerk; and
WHEREAS, the City Clerk has submitted the report to the City Council and the
City Council now has reviewed and examined the report as so submitted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin determines and orders as follows:
Section 1; The report prepared by the Engineer including description of the
improvement, estimated costs and diagram, as filed with the' City Clerk, is hereby
approved.
Section 2:
Clerk.
A copy of this report shall remain on file in the office of the City

of Tustin on the 19th day of June 1995.

A RF~OLUTION OF THE CITY COUNCII~ OF THE CITY OF TUSTIN,
ORANGE COUNTY, CALIFORNIA, DECLARING ITS INTENTION TO
ORDER THE ANNEXATION OF ADDITIONAL TERRITORY TO AN
EXISTING DISTRICT AND TO PROVIDE FOR AN ANNUAL LEVY OF
ASSESSMENT FOR THE IMPROVEMENT, MAINTENANCE AND
SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES
WITHIN THE BOUNDARIF_~ OF THE TERRITORY INCLUDED IN THE
TUSTIN LANDSCAPE AND LIGI-rrING DISTRICT AND TO LEVY AND
COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND
LIGHTING ACT OF 1972 AND GIVING NOTICE THEREOF
WHEREAS, the City Council by Resolution 95-47 initiated proceedings for the
annual levy of assessments and annexation of additional territory to an existing district
for the Tustin Landscape and Lighting District pursuant to the provisions of the
Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the California Streets and
Highways Code) as mended; and
WHEREAS, by said' Resolution 95-47, the City Council ordered the City
Engineer to prepare a report pursuant 'to Section 22565 of said Code; and
WHEREAS, the City Engineer did prepare and file such a report and the same
was approved by the City Council on the 19th day of June 1995, with the passage and
adoption of Resolution of 95-56,
NOW, THEREFORE, BE IT RESOL~ by the City Council of the City of
Tustin determines and orders as follows:
Section 1: That the public interest and convenience require and it is the
intention of the City Council of the City of Tustin to order the annexation of additional
territory to an existing district and to order the annual levy of assessments and to levy
and collect said assessments pursuant to the provision of said Landscaping and Lighting
Act of 1972 (Part 2 of Division 15 of said Streets and Highways Code) as amended.
Section 2: That the improvements to be undertaken consist of the installation,
maintenance, servicing and operations of those certain public landscaping and lighting
facilities located within the Tustin Landscape and Lighting District. The Assessment
District designed as Tustin Landscape and Lighting District generally encompasses that
portion of the City known as East Tustin, being north of I-5 Freeway and east of
Browning Avenue except the areas of all public streets, avenues, lanes, alleys, rights-of,
way, parks and all publicly owned property being used for public purposes, provided,
however notwithstanding property owned by railroad and public utility companies not

used for public purposes shall be included in the district and not be excluded pursuant
to the aforesaid exceptions. Additional parcels are located throughout the City as
depicted on a map contained within the Engineer's Report.
~ That reference is hereby made to the Engineer's Report on file with
the City Clerk and open to inspection for a fully detailed description of the improvement,
the boundaries of the Assessment District and any zones therein, and the proposed
assessments upon assessable lots and parcels of land within the District.
Section 4: That said proposed maintenance,, servicing and operation of
landscaping and lighting, in the opinion of the City Council of the City of Tustin will be
to the benefit of the property lying within the described boundaries of the Assessment
District as said Assessment District is described and defined in said Engineer's Report.
~ Notice is hereby given that Monday, July 17, 1995, at the hour of
7:00 p.m. at the Tustin City Council Chambers, 300 Centennial Way, Tustin, California
29680 are hereby fixed as the time and place where all interested persons may appear
before the City Council and be heard concerning the annual levy of assessments of the
District, and extent of the District, the services to be performed, and the proposed
assessment and all other matters relating thereto.
Protests must be .in writing and must be filed with the City Clerk prior to the
conclusion of the hearing. Any such protest shall state all grounds of the objection and,
if filed by the property owner, shall contain a description sufficient to identify the
property.
Section 6; The City Clerk shall cause notice of the hearing to be given by
causing the Resolution of Intention to be posted and published in the manner required by
Part 2 of Division 15 of the Streets and Highways Code.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Tustin held on the 19th day of June 1995.
