candidate interviews.
BACKGROUND:
As directed by the City coUncil at their meeting of May 1, 1995, staff
submitted press releases to the Tustin News and Tustin Weekly informing
residents of vacancies on the Planning Commission, Parks and Recreation
Commission, Audit Committee, Youth Issues Committee, and Water
Corporation Board. The Tustin News and Tustin Weekly published articles
during the month of May informing the public of these vacancies, provided
information on qualifications and duties, and candidates were requested
to submit their applications by June 1st.
The following individuals have expressed interest and their applications
are attached for City Council consideration:

BACKGROUND:
Following is a list of Commission/Committee term expirations that will
occur on July 19, 1995. Those members whose terms will expire continue
to serve until the City Council finalizes the appointment or
reappointment process.

In addition to the above term expirations, there are currently two (2)
vacancies on .the Tustin Water Corporation Board due to resignations.
CONCLUSION:
The City Council may desire to have staff contact members whose terms
will expire to determine if they are interested in reappointment and/or
direct staff to begin the recruitment process by issuing a press release
(Attachment A) requesting candidates submit applications (Attachment B)
for consideration by the City Council.

CURRENT ENGAGEMENT
I am the principle of Beringer & Associates, which is a mediation and litigation
management firm created to assist counsel with resolution of prelitigation and
litigation matters within limited~ or no, discovery schedule. Our clients include both
defense attorneys, plaintiff attorneys, insurance carriers and brokerage firms. We
have assisted in resolution of construction defect cases, product liability, copyright
infringement, unfair competition, insurance coverage issues, breach of California
Code of Regulations, Title 10. Chapter 5, 2695.1 & Ins. Code 790.03, and
employee vs employer sexual harassment and discrimination disputes.
I am also a parmer with Michael C. Sagar, Esq., and Lisa McCulloch in Mediation
Associates. This organization was created to provide mediators and mediation
services to counsel for the resolution of disputes. We are affiliated with Judicial
Dispute Resolution,. an association of retired judges that provide arbitration services
to the legal community. I am the sole non-ju'dicial officer approved as a mediator
for this organization.
Construction Litigation Management, another partnership of which I am a founding
member, creates agreements between developers and Homeowners Associations to
define resolution protocols by an addendum to the CC&R's. This company
manages trust accounts for the compensation of the homeowners derived fi.om
construction defect, conducts investigations into the propriety of construction defect
allegafioni and mediates to resolution disputes that arise.
I am also associated with Antoinette Del Peral of Orange County Financial Services
for mediation and negotiation of Structured Trust Settlements. This organization
arranges with both plaintiff and defense counsel to preserve tax flee status through
trust arrangements approved under Internal Revenue Codes 104a & 130.

SCHIFRIN, GAGNON AND DICKEY: INDEPENDENT LITIGATION
MANAGER, October 1992 to July 1993
During my employment with SG&D I worked' as an independent Litigation
Manager for insurance carders without local preserice in California. The cases
included first party and third party litigation, construction defect litigation and
coverage analysis. I also conducted mediations, presented matters in arbitration
representing the interests of the insureds and carriers at Judicial Arbitration &
Mediation and in the Small Claims Court venues.

WESTERN INTERNATIONAL INSURANCE COMPANY: LITIGATION
MANAGER, September of 1990 to August of 1992
Reason for Leaving: Western Intemational Insurance Company was placed in
conservation due to losses incurred during the Los Angeles riots.
As Litigation Manager my office was charged with supervision of the inventory of
· contractual litigation on the behalf of WIIC, overseas subrogation in Taiwan, Hong
Kong and Mainline China, and the inventory of defensive litigation on the behalf of
the insureds throughout the United States. The pending included business,
construction defect, product liability, invasion of the right of Private occupancy,
copyright & trade dress, first and third party coverage analysis and unfair
competition matters as well as the obligatory premise liability and personal injury
matters.
INDUSTRIAL INDEMNITY: SENIOR CLAIMS EXAMINER, May 1989 to
September 1990
Reason for Leaving: he carder reduced the claims staff due to restrictions placed
on underwriting by.Department of Insurance. The Claims operation was moved to
the Los Angeles facility and I Was offered the position at WIIC.

The litigation caseload included the defense of municipalities, water districts and
major business. Cases included construction defect, water rights, sexual harassment
and molestation, wrongfifi tenninati°n, copyright and patent infringement, unfair
competition, and coverage issue analysis. I directed declaratory relief actions for
both General Liability and Workman Compensation policies.
The caseload also contained significant exposure personal injury cases involving
commercial premises, truck and autos and construction site locales.
GREAT AMERICAN INSURANCE COMPANY: LITiGATiON
SPECIALIST February 1988 to May 1989
Reason for Leaving: Great Amen'can consolidated its wOrk force in Utah m~d
closed the California Litigation Unit. The position with Industrial Indemnity was .
offered and accepted during the transition. -

My assignment at Cai Lit was Litigation Specialist. The pending assigned to my
office consisted of business litigation and construction defect cases in California,
Nevada, Colorado, Arizona and Hawaii. The matters included extensive business
travel throughout those regions while attending settlement conferences and
mediations.
The cases load consisted of 100 to 125 cases, the majority of which contained
significant coverage and legal issues handled in house..
TEMPORARY ASSIGNMENTS: INDEPENDENT ADJUSTER, August' 1987
to February 1988

Reason for Leaving: Offer of Great American Insurance Company
I accepted assignments at Hartford Insurance, Unigard Insurance company and' the
cities of Manhattan and Redondo Beach as a member of a resolution team to reduce
the pending of the company adjusters. The cases were inclusive of standard
construction defect matters, premise liability and fouled food product matters.
The cases for the cities were composed of matters involving the defense of the
Municipalities related to eminent domain, police shootings, civil rights violations as
well as standard I/ability matters. The duties included presentations to the City

Counsel members regarding exposures and tactics for resolution in both open and
closed sessions.
NORTHBROOK INSURANCE COMPANY: SENIOR COMMERCIAL
CLAIMS REPRESENTATIVE, September 1986 to August 1987
Reason for Leaving: Disagreement with Management over application of 790.03
This case load consisted of major bodily injury, business litigation and construction
defect litigation.
AUTOMOBILE CLUB OF SOUTHERN CALIFORNIA: SENIOR
LITIGATION SPECIALIST, EAST LITIGATION, September 1969 to August
1987
Reason for Leaving: I desired to expand the area of involvement to include
commercial cases.
My emplo)maent with ACSC concluded in the East Litigation Unit located at the
Processing Center in Costa Mesa. I handled cases concerning the application of
Insurance Code 790, as well as the standard matters involving insurance coverage
applicable to automobiles.
My duties included presentations to the senior staff including the Claims Director,
Mr. Tom Dolkas, and the regional 'staff.'i als~ presented cases in mediation,
settlement conferences .and represented the interests of the carrier in arbitration
without counsel. I assisted with development of the Mini/Maxi arbitration forum
associated with Judicial Arbitration and Mediation in Orange.
Subsequent to that time, I was located in the Central Litigation Unit in Los Afigeles.
. This unit concerned itself with the issues of fraud in the plaintiffs bar professional
community. The investigations included the identification of mill operations,
including both attorney and medical professionals, and culminated in the
prosecution of a RICO lawsuit.
Prior to my involvement with the Litigation Units, I performed as a field adjuster in
the South Orange County region and an inside adjuster in the South Laguna Office.
My career started with the Automobile Club as a dispatcher of tow trucks for
emergency roadservice while I was attending school. I advanced through the

management team until I was supervisor of Southwest Dispatch in the East Bay
and South Los Angeles area.

Specifically, lam applying for these appointments to offer my expertise and abilities to assist this
wonderful city to continue providing the community a fine place to reside like I have resided
since 1965.
I semi-retired in October 1989 from Aerojet Ordnance Company along with the president and
comtroller for the Gencorp division. (Defense contract was not renewed)
Even though lam 62 years of age in perfect health and receiving Social Security, I call myself
semi-retired as my rental properties and other financial investments keep me very busy from
time to time.
I spend a lot of time on the computer with stock transactions and spreadsheet analysis, lam very
computer knowledgeable. This came about from controlling a 200 million dollar Air Force
program and of course, being responsible for its success both profit and performance wise.
You will notice i have not updated my resume since 1989 due to the fact lam no longer
interested in outside corporate employment. I now enjoy my golf and big game fishing.
I should also mention my wife of 40 years is currently supervisor at the Orange County
Sheriff/Coroner office and has been employed by The County of Orange for 22 years plus. She

As City Engineer of National City, Mr. Stracker was in charge of design and
construction of two rail bridges over Paradise Creek on the MTDB Trolley Line to
San Ysidro. He also served as Resident Engineer with Caltrans District 11
personnel as construction inspectors. The second phase included roadway
reconstruction at 24th Street and I-5, and a subsequent six-foot vertical alignment
change to the 1-5 northbound ramps.

Departments within the Civil Engineering Division under my direct supervision

1915 Act bonds. Project totaled approximately $24 million and included street

As the Director of the Department, I was involved on a daily basis with City
committees and Commissions, the makeup of which included leading citizens,
appointed officials, and council members. Mv duties included the review of
proposed City projects with homeowner associat'ions, special interest committees,
and specific retail activity groups, i.e., restaurant associations, Rodeo Drive
Committee, etc.
Beverly Hills is an extremely citizen-oriented community with a great number of
services being performed with assistance of a small staff. My role was that of a
problem solver and facilitator among the City's departments.
The City was undergoing heavy, development activity in the downtown and
residential areas, requiring upgrade of traffic control facilities, street widenings, and
review/analysis of older infrastructures. To increase efficiency in the
development/improvement process, standard construction drawings were revised,
older procedures were reviewed and updated, and mapping/drafting standards were
implemented.
A heavy emphasis was placed on Department organizational review/reVisions,
planning of future services to be provided within the Department, and development.

I administered a $3,000,000 annual Capital Improvement program; directed

funded through Measure M, GMA, Public Utilities Commission, Railroad and City.
The project includes realignment of Dale Street to Burlingame Avenue at' Malvern,
design for four tracks, shOofly, pump station, drainage improvements, retaining
walls, water and sewer line relocation, bridge over Brea Creek Channel, three traffic
signals, and private property modifications. The project design included a value
engineering type analysis to reduce costs through reduction in bridge girder depth
and raising the tracks, thus raising the street to lessen the impact on private property
and reduce the retaining walls, excavation andlandscape.
Member of the Total Service Organization (TSO) Committee to develop a more
client-friendly approach to business. This committee evaluated client serviceS
within HDR and with our contract services to propose alternatives to being more
"friendly" and available to our clients.

reporting to the City Manager. As Director of the Department of Tranportation and
Engineering (City Engineer/Transportation Engineer), I was responsible for the

office of the Art Director for the City of Beverly Hills.
'The Parking Enterprise and Water Enterprise activities were included within my

adjacent streets and facilities. Assisted in obtaining funding under the Federal
IS'lEA program (1991) as a demonstration prOject. Additionally, assisted in
transferring demonstration funds from a separate project to the I-5 project for the
Carmenita Bridge. Worked with Caltrans and FHWA on the process to release

Project Manager for three Value Engineering Workshops and Report for nine miles
of SR 71 within the County of San Bemardino for the San Bemardino Associated
Governments. The results included many recommendations for operational
improvements and cost reductions. The total potential cost reductions amounted to
approximately $10, 000, 000.
Project Manager for five Value Engineering Workshops and Report for 23 miles of
SR 30 from the Los Angeles County line to east of 1-215. The results included
many recommendations for operational improvements on and off the freeway, and
cost reductions. Additionally, the report suggested further improvements to the
area's local arterial circulation system. The total potential cost reductions amounted
to $48,000,000.

My employment with ACSC concluded in the East Litigation Unit locatedat the
Processing Center in Costa Mesa. I handled cases concerning the application of
Insurance Code 790, as well as the standard matters involving insurance coverage
applicable to automobiles.
My duties included presentations to the senior staff including the Claims Director,
Mr. Tom Dolkas, and the regional staff. I also presented eases in mediation,
settlement conferences and represented the interests of the carder in arbitration
without counsel. I assisted.with development of the Mini/Maxi arbitration forum
associated with Judicial Arbitration and Mediation in-Orange. .
SubseqUent to that time, I was located in the Central Litigation Unit in Los Angeles.
This unit concerned itself with. the issues of fraud in the plaintiffs bar professional
community. (Th6 investigations inClUded the identification of mill operations, - ~
including both att0meY and medical professionals, and culminated in the ". '
prosecution of a RICO lawsuit.

Prior to my involvement with the Litigation Units, I Performed as a field adjuster in
the South Orange County region and an inside adjuster in the South Laguna Office.
My career started with the Automobile Club as a dispatcher of tow tracks for
emergency roadservice while I was attending school. I advanced through the

BACKGROUND:
The City of Tustin and Tustin Unified~ School District signed a
Memorandum of Understanding in April 1993, which established the
Tustin Area Youth-Issues Committee. This document was recently
amended by the City Council and the School Board to allow for one
member from the respective elected bodies and three members from
the community for each organization to serve on the Committee.
A1 Murray was appointed by the City Council to be their third
community member for a two year term. Cathy deMayo and Gwen
FerguSon were' appointed in April 1993 as the City's original
appointees. Their two year terms expire in April of 1995.
Staff has contacted the two representatiVes regarding the
expiration of their terms. Cathy deMayo is notable to Continue to
serve on the Committee at this time. Gwen Ferguson has indicated
that she is interested in another term.
The City Council should direct staff to' advertise for applicants.
Once the applications are received, staff can set up interviews for
the City Council to meet the candidates. If the City Council
prefers, staff could review applications with the Youth Issues
Committee, interview potential candidates, and recommend to the
City Council which candidates to appoint.
