BACKGROUND: As directed by the City coUncil at their meeting of May 1, 1995, staff submitted press releases to the Tustin News and Tustin Weekly informing residents of vacancies on the Planning Commission, Parks and Recreation Commission, Audit Committee, Youth Issues Committee, and Water Corporation Board. The Tustin News and Tustin Weekly published articles during the month of May informing the public of these vacancies, provided information on qualifications and duties, and candidates were requested to submit their applications by June 1st. As Litigation Manager my office was charged with supervision of the inventory of · contractual litigation on the behalf of WIIC, overseas subrogation in Taiwan, Hong Kong and Mainline China, and the inventory of defensive litigation on the behalf of the insureds throughout the United States. The pending included business, construction defect, product liability, invasion of the right of Private occupancy, copyright & trade dress, first and third party coverage analysis and unfair competition matters as well as the obligatory premise liability and personal injury matters. INDUSTRIAL INDEMNITY: SENIOR CLAIMS EXAMINER, May 1989 to September 1990 Reason for Leaving: he carder reduced the claims staff due to restrictions placed on underwriting by.Department of Insurance. The Claims operation was moved to the Los Angeles facility and I Was offered the position at WIIC. Page 3 The litigation caseload included the defense of municipalities, water districts and major business. Cases included construction defect, water rights, sexual harassment and molestation, wrongfifi tenninati°n, copyright and patent infringement, unfair competition, and coverage issue analysis. I directed declaratory relief actions for both General Liability and Workman Compensation policies. The caseload also contained significant exposure personal injury cases involving commercial premises, truck and autos and construction site locales. GREAT AMERICAN INSURANCE COMPANY: LITiGATiON SPECIALIST February 1988 to May 1989 Reason for Leaving: Great Amen'can consolidated its wOrk force in Utah m~d closed the California Litigation Unit. The position with Industrial Indemnity was . offered and accepted during the transition. - -. My assignment at Cai Lit was Litigation Specialist. The pending assigned to my office consisted of business litigation and construction defect cases in California, Nevada, Colorado, Arizona and Hawaii. The matters included extensive business travel throughout those regions while attending settlement conferences and mediations. The cases load consisted of 100 to 125 cases, the majority of which contained significant coverage and legal issues handled in house.. TEMPORARY ASSIGNMENTS: INDEPENDENT ADJUSTER, August' 1987 to February 1988 . Reason for Leaving: Offer of Great American Insurance Company I accepted assignments at Hartford Insurance, Unigard Insurance company and' the cities of Manhattan and Redondo Beach as a member of a resolution team to reduce the pending of the company adjusters. The cases were inclusive of standard construction defect matters, premise liability and fouled food product matters. The cases for the cities were composed of matters involving the defense of the Municipalities related to eminent domain, police shootings, civil rights violations as well as standard I/ability matters. The duties included presentations to the City Page 4 Counsel members regarding exposures and tactics for resolution in both open and closed sessions. NORTHBROOK INSURANCE COMPANY: SENIOR COMMERCIAL CLAIMS REPRESENTATIVE, September 1986 to August 1987 Reason for Leaving: Disagreement with Management over application of 790.03 This case load consisted of major bodily injury, business litigation and construction defect litigation. AUTOMOBILE CLUB OF SOUTHERN CALIFORNIA: SENIOR LITIGATION SPECIALIST, EAST LITIGATION, September 1969 to August 1987 Reason for Leaving: I desired to expand the area of involvement to include commercial cases. My emplo)maent with ACSC concluded in the East Litigation Unit located at the Processing Center in Costa Mesa. I handled cases concerning the application of Insurance Code 790, as well as the standard matters involving insurance coverage applicable to automobiles. My duties included presentations to the senior staff including the Claims Director, Mr. Tom Dolkas, and the regional 'staff.'i als~ presented cases in mediation, settlement conferences .and represented the interests of the carrier in arbitration without counsel. FISCAL IMPACT: None. BACKGROUND: The City of Tustin and Tustin Unified~ School District signed a Memorandum of Understanding in April 1993, which established the Tustin Area Youth-Issues Committee. This document was recently amended by the City Council and the School Board to allow for one member from the respective elected bodies and three members from the community for each organization to serve on the Committee. A1 Murray was appointed by the City Council to be their third community member for a two year term. Cathy deMayo and Gwen FerguSon were' appointed in April 1993 as the City's original appointees. Their two year terms expire in April of 1995. Staff has contacted the two representatiVes regarding the expiration of their terms. Cathy deMayo is notable to Continue to serve on the Committee at this time. Gwen Ferguson has indicated that she is interested in another term. The City Council should direct staff to' advertise for applicants. Once the applications are received, staff can set up interviews for the City Council to meet the candidates.
