CALL TO ORDER Meeting called to order at 8:05 a.m.

NEW BUSINESS 1. RESOLUTION NO. 76-15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY
THE COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, TO ANNEX TO SAID
CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND
DESGINATED "MARINE CORPS AIR STATION (HELICOPTER) ANNEXATION
NO. 71B TO THE CITY OF TUSTIN" AND GIVING NOTICE OF THE
PROPOSED ANNEXATION.
City Attorney James Rourke requested that the City Clerk give
report of notices given.
City Clerk reported that notices had been hand delivered to and
receipts obtained from The Tustin News, The Register, and the Los
Angeles Times Friday, February 6, and that all Councilmen had
signed granting permission for this meeting.
Mr. Rourke stated that the Local Agency Formation Commission has
given its approval for the annexation of Territory known as Marine
Corps Air Station (Helicopter) Annexation No. 71-B to the City of
Tustin and an investigation has been made of the number of resident-
registered voters in this territory.
The Registrar of Voters information disclosed that there were some
57 registered voters who gave addresses within this territory as of
54 days prior to today, which is under the Code the requisite of
the determination of the number of registered voters within the
territory to determine whether it is an inhabited or uninhabited
annexation. The registration list has been checked with the people
that actually live in that territory and Mr. Snyder, who is here,
has prepared his report and statement and he has determined that of
the registered voters as of Friday there were only 10 of those people
who still resided, actually resided or actually were billeted in
that territory. Therefore the territory is uninhabited as that
term is used in the Government Code and we have prepared a
Resolution which I believe the Council has copies, Resolution No.
76-15 for the initiation and cormmencement of proceedings for
the annexation of the territory. The date that would be
appropriate to set for the protest hearing would be March 25, 1976.
Mr. Rourke filed, with the Clerk, Mr. Snyder's memorandum and the
'copies of the Registrar of Voters affidavit.
In answer to questioning as to resolving the question of the
registrar of voters list and those residing in the area, Mr. Snyder
stated that as to the registrar of voters list he could not
testify to that but that he does know the number of those
remaining on the Helicopter Base -- either residents or billeted.

Councilman Welsh questioned Section 4 of Resolution relative
to school districts. After Council discussion and clarifi-
cation by Dr. Fleagle this section was changed to read as
follows:
4. That the major portion of said territory is now and
will upon annexation be a part of the Tustin Unified
School District and the balance is in and will be in
the Irvine Unified School District and the Santa Aria
Unified School District.
Moved by Sharp, seconded by Edgar that Resolution No. 76-15 be
read by title only. Carried unanimously.
Title of Resolution read by Clerk.
Moved by Sharp, seconded by Welsh that Resolution No. 76-15
be passed and adopted. Carried by roll call. All Councilmen
voting aye.
Moved by Welsh, seconded by Edgar that this annexation be referred
to the Planning Commission with request that they review
and make recommendation to the Council regarding this annexation
and take under consideration the prezoning of this property.
Motion carried by roll call, all Councilmen voting aye.
There being no further business the meeting was adjourned to
the next regular Council meeting, February 17, 1976.
