The Pledge of Allegiance was led by Councilmember Doyle. INVOCATION The Invocation was given by Dr. Marj Britt, Unity Church of Tustin. ROLL CALL Council Present:' Thomas R. Mayor Saltarelli read and presented a proclamation to Dorene Pease Ruse proclaiming April 23-29, 1995 as "Week of the Young Child." TUSTIN HIGH SCHOOL VARSITY BASKETBALL TEAM Mayor Saltarelli read and presented proclamations to the Tustin CITY COUNCIL MINUTES Page 2, 4-17-95 High School Boys Varsity Basketball team players: Huy Do, Doug Gottlieb, Sam Greis, Robert Griffin, Aaron Kraus, Matt Kraus, Raffi Lalazarian, David Lalazarian, Luke Loveless, Ellis Merritt; and Coaches Andy Ground and Steve Herley, for advancing to the CIF finals and State Regional competition. Andy Ground thanked Council for the proclamations. Councilmember Doyle noted that he had played on the Tustin High School Basketball team when they advanced to the CIF finals in 1956. PUBLIC INPUT AMATEUR ADVERTISIN~ SIGNS - SEVENTEENTH STREET Helen Edgar, Tustin, complained about the amateur signs advertising flowers for sale placed in the medians on Seventeenth Street. Mayor Saltarelli stated staff would investigate the matter. PUBLIC HEARING - None CONSENT C~T.~ND/%R ( ITEMB I THROU~ 12 ) Item No. 3 was removed from the Consent Calendar by Mayor Saltarelli, and he announced that Councilmember Thomas would abstain on Item No. 4. It was moved by Potts, seconded by Worley, to approve the remainder of the Consent Calendar as recommended by staff. Motion carried 5-0. 1. APPROVAL OF MINUTES - APRIL 3, 1995 REGULAR MEETING Recommendation: Approve City Council Minutes of April 3, 1995. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,139,149.87 and ratify Payroll in the amount of $315,234.60. REJECTION OF CLAIM NO. 95-5 - CLAIMANT, DWIGHT AVERY; DATE OF LOSS, 1/27/95; DATE FILED WITH CITY, 2/21/95 Recommendation: Reject subject claim for general damages in the amount of $39.00 as recommended by the City Attorney. RESOLUTION NO. 95-40 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION OF CERTAIN RECORDS Recommendation: Adopt Resolution No. 95-40 allowing for destruction of applications and testing materials for recruitments which have been closed for over two years as recommended by Personnel Services. · PLANNING COMMISSION ACTION AGENDA - APRIL 10, 1995 Ail actions of the Planning Commission become final unless appealed by the City Council or member of the public. INVESTMENT SCHEDULE AS OF FEBRUARY 28, 1995 Recommendation: Receive and file subject report as recommended by the Finance Department· 11. NOTICE OF SALE OF SURPLUS STREET SWEEPERS Recommendation: Receive and file notice of sale of surplus street sweepers as recommended by the Public Works Department/Field Services. lZ. AWARD OF CONTRACT FOR COLUMBUS TUSTIN WELL EMERGENCY POWER RETROFIT - CITY PROJECT NO. 600112 ReCommendation: Award contract for subject project to American Electric Company, Orange, California, in the amount of $122,640.00 as recommended by the Public Works Department/Water Division. CONSENT CALENDAR ITEM NO. 3 - MASTER PLAN DESIGN CONTRACT - TUSTIN RANCH TREE PARK Mayor Pro Tem Potts requested staff investigate building a temporary parking area during the Tustin Ranch Tree Park construction, and provide for adequate parking in the Master Plan. He announced Peter's Canyon Regional Park would eventually connect hiking/biking/equestrian trails to Newport Beach Back Bay. Council/staff discussion followed regarding community involvement in naming the new park; Master Plan budget; and existing parking and temporary parking alternatives. It was moved by Potts, seconded by Thomas, to (1) appropriate $192,160.00 from the Park Development Fund into the Capital Projects Fund; (2) approve the consultant services agreement with RJM Design Group in the amount of $31,500.00 for the development of a Master Plan for the Tustin Ranch Tree Park and authorize the City Manager to execute subject agreement; and (3) in the event services of RJM are satisfactory, authorize the City Manager to broaden the scope of work with RJM to include preparation of construction documents (scope of work for construction documents.would be handled by a change order). ~tion carried 5-0. CONSENT CALENDAR ITEM NO. 4 -REJECTION OF CLAIM NO. 95-8 - CLAIMANT, GREGORY VAUGHAN; DATE OF LOSS, 3/11/95; DATE FILED WITH CITY, 3/17/95 CITY COUNCIL MINUTES Page 4, 4-17-95 It was moved by Potts, seconded by Worley, to reject subject claim for property damages of an undetermined amount as recommended by the City Attorney. Motion carried 4-0, Thomas abstained. REGULAR BUSINESS ( ITEMS 13 THROUGH 16 ) 13. GANG VIOLENCE SUPPRESSION PROGRAM RESOLUTION William Huston, City Manager, reported that the Tustin Unified School District had requested the County Probation Department, District Attorney's Office, and the City cooperate in development of a gang suppression program. The proposed program provided funding for one year during which the City would be committed to "in-kind" services and a maximum $15,000 match. He stated the grant application requested funding for two police officers who would be assigned to the program and if the grant was approved, it was probable the City would assume full cost of the police officers after one year. Upon termination of the funding period, the City could decide to continue the program or reassign the officers to other police activities. Mayor Pro Tem Potts stated it was important that candidates for the proposed police officer positions were aware that the program was funded' for one year only and that the positions could be eliminated upon termination of the gang suppression program. Council/staff discussion followed regarding the feasibility of hiring the police officer positions on a contract basis. It was moved by Potts, seconded by Worley, to adopt the following Resolution No. 95-42 authorizing participation in a joint School District, County Probation Department, District Attorney's Office and City application for grant funds through the California Office of Criminal Justice Planning: RESOLUTION NO. 95-42 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITY'S PARTICIPATION IN AN' APPLICATION FOR FUNDING OF A GANG VIOLENCE/SUPPRESSION PROGRAM Motion carried 5-0. 14. GRAD NITE 1995 REQUEST FOR CONTRIBUTION, FOOTHILL HIGH SCHOOL The fOllowing member of the audience requested a $3,000 donation for Foothill High School 1995 Grad Nite: Dan Rothblum, Foothill High School Grad Nite Committee Council/speaker discussion followed regarding ratio of Tustin residents attending Foothill High School; merchant and parent contributions; and decrease in donations for the event. CITY COUNCIL MINUTES Page 5, 4-17-95 15. .6. It was moved by Potts, seconded by Thomas, to authorize a $3,000 donation to Foothill High School 1995 Grad Nite. Councilmember Worley stated she was opposed to utilizing taxpayer money for graduation night activities. Motion carried 4-1, Worley opposed. ORANGE COUNTY BANKRUPTCY STATUS Mayor Saltarelli stated that the County InvestmentPool repayment process was proceeding rapidly and it was essential Council review the repayment options. Lois Jeffrey, Interim City Attorney, stated that because of the timeframe, Council must approve a repayment option at the May 1, 1995 Council meeting. She noted that an opportunity would be available between June 5-8'allowing agencies who chose Option A to select Option B if the County could not cash the recovery notes on June 5, 1995.' Council discussion followed regarding the City supporting Option A; the County's financial uncertainty if the sales tax measure was not passed by the voters; and passage of Option A. SELECTION OF MAYOR AND MAYOR PRO TEM Mayor Saltarelli expressed appreciation to Council for selecting him to serve as Mayor for the past year; the support of shared fellowship while facing the County crisis; optimism that Council would work together for the betterment of the City; and he encouraged continued support and participation of residents to assist the Council in reaching their goals. He noted the importance of issues affecting the City including: continued focus on fiscal strength; gang violence; annexation of North Tustin; cooperation between the City and the Tustin Unified School District; continued redevelopment of the City; development projects for seniors; expansion of the Tustin branch library; and closure of Marine Corps Air Station, Tustin. He thanked Council and staff for their support during the past year. It was moved by Worley, seconded by Doyle, to nominate Mayor Pro Tem Potts as Mayor. Motion carried 4-1, Thomas opposed. It was moved by Potts, seconded by Doyle, to nominate Councilmember Worley as Mayor Pro Tem. Motion carried 4-1, Thomas opposed. Mayor Potts, on behalf of the Council, presented a plaque 'to Councilmember Saltarelli commemorating his year as Mayor from April 1994 to April 1995, and commended him on an excellent Mayoral term. CITY COUNCIL MINUTES Page 6, 4-17-95 Mayor Potts voiced his support for using Redevelopment Agency funds to expand the Tustin branch library; pledged to fight blight in the City; and anticipated Council working as a team during his term as Mayor. Mayor Pro Tem Worley stated she looked forward to serving as Mayor Pro Tem and commended former Mayor Saltarelli's mayoral term. PUBLIC INPUT - None OTW~R BUSINESS COMMENDATION - POLICE DEPARTMENT Councilmember Doyle commended the Police Department for the arrest of the suspects involved in the 7-11 Store shooting within nine hours. LOCAL REPUBLICAN ELECTED OFFICIALS MEETING Councilmember Thomas noted that the Local Republican Elected Officials would meet on April 22, 1995. CITY FOCUS CABLE TELEVISION PROGRAMS Councilmember Thomas reported that City Focus Cable television programs would feature the Adam Walsh Children's Center during April and the Tustin Pride Committee's activities. COMMENDATION COUNCIL/AUDIT COMMITTEE/STAFF Councilmember Saltarelli thanked Councilmember Thomas, Finance Director Nault, and the Audit Committee for averting a City financial disaster during his term as Mayor; and extended his appreciation to staff for their support in the completion of his Mayoral duties. SPRING EGG HUNT Mayor Pro Tem Worley commended staff on a successful Spring Egg hunt and their last-minute improvising due to weather conditions. CITIZEN POLICE ACADEMY PROGRAM Mayor Pro Tem Worley commended the Citizen Police Academy Program and caliber of police officers. LOWER PETER'S CANYON PROJECT Mayor Pro Tem Worley expressed disappointment that the Lower Peter's Canyon project was scheduled for Board of Supervisors' approval and noted the unfavorable impact upon the City of Tustin. CITY COUNCIL MINUTES Page 7, 4-17-95 OI~)INANCE BVISION Mayor Potts noted that the City Attorney's office was in the process of strengthening a City ordinance that had previously been under scrutiny. CLOSED SESSION - None ~)JO~NT Mayor Potts adjourned the meeting at 7:55 p.m. The next regular meeting of the City Council was scheduled for Monday, May 1, 1995, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
