HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION PREPARATION OF A/q ENGINEER'S REPORT FOR THE LEVY OF AlqNUAL SUBJEC~ ASSESSMENTS FOR THE 1995-96 FISCAL YEAR FOR THE TUSTIN L;kNDSCAPE AND LIGHTING DISTRICT RECOMMENDATIONS: It is recommended that the Tustin City Council, with the adoption of Resolution No. 95-47 order the preparation of an Engineer's Report for the levy of annual assessments for the 1995-96 fiscal year for the Tustin Landscape and Lighting District. FI.SCAL IMPACT: None. All City costs will be recouped through the levy of the annual assessments for the District. BACKGROUND: This action will be the initial phase of the process to levy annUal assessments for Fiscal Year 1995-96 for the Tustin Landscape and Lighting District and orders the preparation of the Engineer's Report. The District provides funding for the maintenance of the perimeter landscaping on the arterial highways within the Tustin Ranch area and for the operation and maintenance of the street lighting within the Tustin Ranch area and other locations within the City. Three additional City Council actions will be required as the process proceeds: First the adoption of a resolution approving the Engineer's Report which is tentatively scheduled for June 5, 1995. Secon~ the adoption of a resolution declaring the City Council's intention to annex additional territory to the district and to provide an annual levy of assessment which is also tentatively scheduled for June 5, 1995. This resolution will set the date for a public hearing in early July 1995. The territory to be annexed consists of two parcels that have been approved for development this past year in various parts of the City and as part of the approval process were conditioned to be annexed to the Tustin Landscape and Lighting District. The third resolution will order the annexations and the levy of annual assessments to be outlined in the Engineer's Report and will be available for City Council action in July 1995. DISCUSSION: The attached Resolution No. 95-47 orders the preparation of the Engineer's Report for the levy of annual assessments for the 1995-96 fiscal year for the District. It is requested that the City Council pass and adopt this resolution. Tim D. Serl Director of Public Works/City Engineer TDS: ccg: engrpt 11 Attachment YJm~ry Otteson Associate Civil Engineer 6 ? 9 12 14 l? 21 24 RESOLUTION NO. 95-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ORANGE COUNTY, CALIFORNIA, ORDERING THE PREPARATION OF AN ENGINEER'S REPORT FOR THE LEVY OF ANNUAL ASSESSMENTS FOR THE 1995-96 FISCAL YEAR FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT WHEREAS, it is the intention of the City Council of the City of Tustin to leVy annual assessments for the 1995-96 fiscal year for the Tustin Landscape and Lighting District; and WHEREAS, substantial changes in existing improvements have occurred by reason of new subdivided parcels, new landscaped areas and new street light facilities to be maintained by said District; and WHEREAS, BSI Consultants, Inc., doing business as Berryman and Henigar (B&H), is under contract to provide professional engineering services in connection of said District under the direction of the Director of Public Works/City Engineer. NOW, THEREFORE, BE'IT RESOLVED by the City Council of the City of Tustin that the Director of Public Works/City Engineer is hereby ordered to prepare and file, through BSI Consultants, Inc., the 'Engineer's Report for the levy of annual assessments for the 1995-96 fiscal year for the Tustin Landscape and Lighting District.
