FISCAL IMPACT: The current uniform budget is $19,950.00 and is expected to remain the same or possibly decrease. BACKGROUND: The City is required by the 1995 Memorandum of Understanding to' supply uniforms to specified City employees (Field Services and Water Services). DISCUSSION: The current agreement has reached expiration and there is no clause for renewal. The best interests of the City would be served by competitively bidding this contract. Thc service to bc performcd hcreundcr consists of thc following: Supply uniforms and laundry service at various locations throughout thc City. Specifications and proposal forms to be used for bidding on this project can only I~ obtained by prospective biddexs at thc Public Works office, Tustin City Hall, 300 Centennial Way, Tustin, California 92680. In the case of City contracts that involve federal funds, thc contractor must bc propedy licensed at thc time of award of thc contract (Public Contract Code Section 20103.5) A contractor who is not properly licensed will have his bid declared non responsive. (Business and Professions Code. Section 7028.15(e)). Thc City Council of thc City of Tustin has obtained fi'om thc. Director of Indu.qdal Relations thc general prevailing rotc of per.diem wages and thc general prevailing rate for legal holiday and overtime work in thc locality in which the work is to be performed for each craft or type of work needed and a copy of the same is on file in the office of the City Engineer. Not less than said prevailing rat~ shall be paid the workers employed on this. public works contract as required by Labor Code Sections 1771 and 1774 of the Stale of California. The City of Tustin has implemented a 9~80 work schedule. This schedule means that City Hall Offices will be closed every other Friday. City Hall Offices are CUrrently opened from 7:30 a.m. to 5:30 p.m. Monday through Thursday and 8:00 a.m. to 5:00 p.m. on the Friday City Hall remains opened. The Contxactor's activities shall be confined to the hours between 7:30 a.m. and 4:30 p.m., Monday through Thursday and 7:00 a.m. to 3:30 p.m. on the Friday City offices are opened, ~xcluding holidays. Deviation from these hours will not be permitted without the prior consent of the Field Services Manager, except in emergencies involving immediate hs~rd to persons or property. In case of discrepancy between the unit price and tim total amount for a contract item, thc unit price shah prevail. SECTION C SERVICE CONTRACT UNIFORM RENTAL AND LAUNDRY I. PURPOSE OF CONTRACT The purpose of this contract is to state the terms and conditions upon which uniforms will be furnished to City of Tustin for use by City employees. II. SERVICES TO BE PERFORMED Contractor agrees to pexform the following services for City of Tustin: Ao Generally, Contractor will furnish uniforms for approximately ~ (50) City Employees for the period commencing approximately July 1, 1995, and continuing for two (2) years, with three (3) two year extensions. Contractor shall be required to furnish new uniforms at vaxious sites within the City of Tustin. Bo Specifically, Contractor shall furnish and maintain an inventory of eleven (11) uniforms per employee in order to pray/de five (5) changes'per employee every week. Contxac~r shall providc for orderly and timely delivery of the required uniform changes per week. Th/s inventory of un/forms shall be mainta/ned by Contractor during the life of the Agreement. C. Contractor shall measure each City ofTustin employg ofthe work force, of the City of Tustin, as - it is now, and shall herealer be constituted during the term of the Agreement, and shall be responsible for supplying and maintaining properly fitting uniforms for each employee. Do Contractor shall be responsible for maintaining the uniforms in good condition and repair. The garment life shall be figured on a normal wear basis of six (6) months. New replacement uniforms shall be prey/deal.bi-annually so that a first-class presentable appearance will be maintained as determined by the Field Services and Water Services Managers of the City of Tustin. E. Contractor shall deliver cleaned and pressed uniforms a minimum of once each week, to such sites within the City of Tustin as the Field Services and Water Services Managers shall direct. Soiled uniforms shall be picked up by Contractor at the same times and places and shall be returned to Contractor's place of business. F. Go Contractor shall launder and press or iron nH uniforms in Contractor's own plants in accordance with all applicable standards of nH County and State public health agencies' with no additional cost to the City other than the bid item. Uniform color combinations shall be determined by the Field Services and Water Services Managers and subject to change with a sixty (60) day notice. H. All uniforms shall remain the property of Contractor. Contractor shall install name tags and identifying patches as required by City of Tustin. Name tags and patches will be furnished by Contractor and shall be affixed by Contractor without extra charge. All required alterations will be at no cost to the City of Tustin. Jo Contractor shall send a monthly statement to City of Tustin each month at thc address hereinafter provided for notices, which shall be accompanied by an itemization together with control sheets itemizing the services furnished together with copies of signed delivery receipts showing the employee names and the number of uniforms furnished to each employee in theft respective divisions. IlL OBLIGATIONS OF CITY OF TUSTIN City of Tustin agrees to the following: ho City of Tustin shall pay contractor, for uniforms and services to be provided by Contractor, the amounts set forth in Exhibit 'A', attached hereto, and incorporated here by this reference. Weekly charges shall be based upon the number of employees recei~ services during the wedq multiplied by the unit cost per change as set forth on Exhibit 'A', a copy of which is attached and made a part hereof. B. The weekly charge shall he imposed for new employees that require uniforms. C. City of Tustin shall' be responsible for returning all uniforms to Contractor fOr any employee whose employment is terminated. De City of Tustin shall pay to Contractor the cost of each shirt or pair of trousers lost by City of Tustin and/or its employees, with the replacement charge to he prorated on a six (6) month life expectancy per shirt and/or pair of trousers. E° City of Tustin will he respo~ible for damage to uniforms in ex°ess of normal wear and tear. City of Tustin shall.pay to ConUactor a reasonable amount for necessary repairs to.such damaged uniforms in ex°ess of the repairs neeessi~ by normal wear and tear. However, such dmrges shall not in any ease exceed the depreciated cost of the uniform based on a six (6) month life expectancy. F. City of Tustin reserves the fight to add or delete uniforms, without penalty, if staff is increased or reduced. IV. TERM The term of this agreement shall be for the period commencing approximately July 1, 1995, for two (2) years, with three (3) two year renewals, provided however, that City of Tustin may cancel this · agreement upon thirty (30) days written notice to Contractor at any time. V. SPECIFICATIONS A. General - All uniforms shall be new and of good quality and suitable for the uses and wear intended. Bo Co. Trousers / Shorts - The uniform material of all trousers shall be sixty-five percent (65%) Dacron Polyester, thirty-five percent (35%)eottou Twill, seven (7) ounces per square yard, crease-resistant fabric, vat-dyed for maximum color retention and Sanfo~ with a maximum one percent (1%) shrinkage. They shall be of single needle open seamed construction, zipper fly, stop button through leR hip pocket, no button right hip pocket, 518" wide belt loop and double stitched without cuff. Levi cut shall be supplied over regular style except where not available in size. Shins - Shirt material shall be sixty-five percent (65%) Dacron Polyester, thirty-five percent (35%) Combed Cotton, 4.77 ounces per square yard, crease-resistant fabric, vat-dyed and Sanforized with maximum of one percent (1%) shrinkage. They shall have sport shirt'styling, six button front, convertible collar, button through breast pocket with long or short sleeves as selected by employee. Long sleeve shins shall have lined cuffs and all- shins will have long tails. IV. COMPLIANCE WITH APPLICABLE STATUTES, ORDINANCES AND REGULATIONS Contractor shall comply with all applicable Federal, State, County and City of Tustin statutes, ordinances and regulations. GOVERNING LAW - ENTIRETY OF AGREEMENT This agreement shall be governed by the laws of the State of California and constitutes the entire agreement between the parties regarding its subject matter and there have been no representatives, warranties, agreements or understandings not set forth herein. Any amendment, modification, change or revision of this Agreement shall be effective only if in writing and signed by both parties. If any provision in this Contract is held by a court to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect. VII.
