_RECOMMENDATION:
It is recommended that the City Council:

Appropriate $192,160 from the Park Development Fund into the
capital Projects Fund.
·
Approve the consultant Services Agreement with RJM Design
Group in the amount of $31,500 for the development of a Master
Plan for the Tustin Ranch Tree Park and authorize the City
Manager to execute the attached agreement.
·
In the event services of RJM are satisfactory, authorize the
CitY Manager to broaden the scope of work with RJM to include
preparation of construction documents. The scope of work for
construction documents would be handled by a change order.
FISCAL IMPACT
Since this project was not included in the 1994-95 Capital
Improvement Budget, funding for preparation of the Master Plan and
preparation of construction drawings needs to be appropriated for
the project from the Park Development Fund. The $192,160 requested
appropriation includes $118,000 for preparation of the Master Plan
and construction documents and $74,160 for project management
services, during Master Plan preparation through phased
construction. The authorization for Project Management Services by
HNTB was-approved by the City Council. in March, 1995, but had not
actually been appropriated.
The balance of the Park Development Fund as of January 31, 1995 was
$550,433. Of that amoun% $75,000 is earmarked for other projects
and cannot be used for the park.
BACKGROUND AND DISCUSSION
The city Council responded to the residents in the vicinity of the
proposed Tree Park by requesting that staff expedite the schedule
for park design and construction. In October 1994, a Request for
Qualifications (RFQ) was distributed for the development of a
master plan and phased construction plan for the Tustin Tree Park.
Thirteen firms submitted statements of qualifications. A staff
committee representing Community Development, Public Works and
Community Services reviewed and scored the responses to the RFQ.
Seven firms were invited to make presentations and were ranked
according to the quality of their presentation and related
experience. At the conclusion of this interview process, RJM
Design Group of Mission Viejo was determined to be the most
qualified firm.
RJM comes with excellent references having completed similar
projects in the Cities of Temecula and Rancho Cucamonga. The firm
has also done master plans for many of the County Regional Parks
such as Whiting Ranch and Laguna Coast Wilderness Parks that have
a natural theme.
With City Council approval of the contract, staff can contact the
neighbors to continue with the public input and master plan
process~ The anticipated costs for preparation of the master plan
and construction documents is estimated at $118,000. Once RJM is
on board, staff will transmit a detailed schedule for developing
the master plan to the City council.

CONSULTANT SERVICES AGREEMENT
This Agreement for Contract Services (herein "Agreement"), is made and entered
into by and between t.he CITY OF TUSTIN, a municipal corporation ("City"), and
RJM , ("Consultant").
WHEREAS, Consultant is qualified to provide the necessary services and has agreed
'to provide such services; and
WHEREAS, Consultant has submitted to City a proposal, dated November 28~ 1994,
a copy of which is attached hereto as Exhibit "B", and is by this reference incorporated
herein as though set forth in full here at (the "Proposal").
NOW, THEREFORE, in consideration of the premises and mutual agreements
contained herein, City agrees to employ and does hereby employ Consultant and Consultant
agrees to provide consulting services as follows:
1. SERVICES OF CONSULTANT
1.1 Scope of Services. In compliance with all terms and conditions of this
Agreement, Consultant shall provide those services specified in the "Request for
Qualifications" attached hereto as Exhibit "B" Master Plan design and incorporated herein
by this reference, (the "services" or the "work").
1.2 Consultant's Proposal. The scope ofservices shall include Consultant's
Proposal for Master Plan design incorporated herein as Exhibit "B". In. the event of any
inconsistency between the ter~ns contained in Exhibit'"B" and the terms set forth in this
Agreement, the terms set forth in this Agreement shall govern.
1.3 Compliance with Law. All services rendered hereunder shall be
provided in accordance with ali laws, ordinances, resolutions, statutes, rules, and regulations
of the City of Tustin and of any federal, state or local governmental agency of competent
jurisdiction.
1.4 Licenses and Permits. Consultant shall obtain at its sole cost and
expense such licenses, permits and approvals as may be required by law for the
performance of the services required by this Agree~nent.
1.5 Familiarity with Work. By executing this Contract, Consultant
warrants that Consultant (a) has thoroughly investigated and considered the work to be
performed, (b) has investigated the site of the work and become fully acquainted with the
conditions there existing, (c) has carefully considered how the work should be performed,
and (d) fully understands tile facilities, difficulties and restrictions attending performance
of the work under this Agreetnent. Should the Consultant discover any latent or unknown
conditions materially differing from those inherent in the work or as represented by the
City, Consultant shall immediately inform City of such fact and shall not proceed with any
work except at Consultant's risk until written instructions are received IYom the Contract
Officer.
1.6 Care of Work. Consultant shall adopt and follow reasonable
procedures and methods during the teton of the Agreement to prevent loss or damage to
materials, papers or other components of the work, and shall be responsible for all such
damage until acceptance of the work by City, except such loss or da~nages as may be caused
by City's own negligence.
1.7 Additional Services. Consultant shall perform only services in addition
to the Master Plan design specitied itl the Proposal when directed to do so in writing by the
Contract Officer, provided that Consultant shall not be required to perform any additional
services without compensation. Any additional compensation not exceeding ten percent
(10%) of the Contract sum set l'orth in Section 1 of Exhibit D must be approved in writing
by the Contract Officer. Any greater increase must be approved in. writing by the City
Manager.
1.8 Special Requirements. Any additional terms and conditions of this
Agreement, are set forth in Exhibit "C" hereto, "Special Requirements" and incorporated
herein by this reference. Itl the event ora contlict between the provisions of Exhibit "C"
and any other provision or provisions of this Agreement, the provisions of Exhibit "C" shall
govern.
2. COMPENSATION
2.1 Co~npensation of Consultant. For the services rendered pursuant to
this Agreement, the Consultant shall be compensated only in such amounts as are
prescribed in the Exhibit "D".
2.2 Method of Paytnent. Itl any month in which Consultant wishes to
receive payment, Consultant shall no later than the first working day of such month, submit
to City in the lbrm approved by City's Director of Finance, an invoice for services rendered
prior to the date ol' the invoice. City shall pay Consultant for all expenses stated thereon
which are approved by City consistent with this Agreement, no later than the last working
day of said month.
2.3 Payment for Changes. Changes approved in writing in accordance
with Section 1.7 shall be compensated at the personnel hourly rates prescribed in Exhibit
"D" hereto (where applicable, rates shall apply to travel time).
2.4 Statement of Costs. Pursuant to the provisions of California
Government Code Section 7550, the total amount expended by City relating to the
preparation of any report or documents prescribed herein shall be set forth within the final
edition thereof, in a separate section, in a statement substantially as follows:

3. PERFORMANCE SCHEDULE
3.1
Agree~nent.
Time of Essence. Time is of the essence in the performance of this

Agreement shall be performed within any time periods prescribed in any Schedule of
Performance attached heret° marked Exhibit "E". Extension of any time period specified
in the Exhibit ,'E" must be approved itl writing by the Contract Officer.
3.3 Force Maieure. Time for perfornmnce ot' services to be rendered
pursuant to this Agreement may be extended because of any delays due to unforeseeable
causes beyond the control and without the fault or negligence of the Consultant, including,
but not restricted to, acts of God or ol'a public enemy, acts of the government, fires,
earthquakes, floods, epidemic, quarantine restrictions, riots, strikes, freight embargoes, and
unusually severe weather il' the Consultant shall within ten (10) days of the commencement
of such condition notify the Contract Officer who shall thereupon ascertain the facts and
the extent of any necessary delay, and extend the titne I'or performing the services for the
period of the enforced delay when and if in the Contract Officer's judgme0t such delay is
justified, and the Contract Officer's determination shall be final and conclusive upon the
parties to this Agreement.
3.4 Term. Unless earlier terminated in accordance with Section 7.7 of this
Agreement, this Agreement shall continue in l'ull force and effect until completion of the
services but not exceeding one (1) year l'rom date hereof.
4. COORDINATION OF WORK
4.1 Representative ot' Consultant. Tile following Principal of the
Consultant is hereby designated as being the principal and representative of Consultant
authorized to act in its behalf with respect to the work specitied herein and make all
decisions in Connection therewith: .
It is expressly understood that the experience, knowledge, capability
and reputation of the foregoing Principal is a substantial inducement for City to enter into
this Agreement. Theretbre, the foregoing Principal shall be responsible during the term of
this Agreement tbr directing all activities of Consultant and devoting sufficient time to
personally supervise the services hereunder. The foregoing Principal may not be changed
by Consultant without the express written approval of City.
4.2 Contract Officer. The Contract Officer shall be the Director of
Community Development of City unless otherwise designated in writing by the City
Manager of City. It shall be the Consultant's responsibility to keep the Contract Officer
fully informed of the progress of the performance of the services and Consultant shall refer
any decisions which ~nust be made by City to the Contract Officer. Unless otherwise
specified herein, any approval of City required hereunder shall mean the approval of the
Contract Officer.
4.3 Prohibition Against Subcontracting or Assignment. The experience,
knowledge, capability and reputation of Consultant, its principals and employees were a
substantial inducement for the City to enter into this Agreeme~lt. Therefore, Consultant
shall not contract with any other entity to perform in whole or in part the services required
hereunder without the express written approval of the City. In addition,. neither this
Agreement nor any interest herein may be assigned or transferred, voluntarily or by
operation of law, without the prior written approval of City.
4.4 Independent Contractor. Neither the City nor any ot' its employees
shall have any control over the manner, mode or means by which Consultant, its agents or
employees perform the services required herein, except as otherwise set forth herein.
Consultant shall perform all services required herein as an independent contractor of City
and shall remain at all times as to City a wholly independent contractor with only such
obligations as are consistent with that role. Consultant shall not at any time or in any
manner represent that it or any of its agents or e~nployees are agents or employees of City.
City shall not assu~ne any duties or obligations under federal or state law to consider
consultant or consultant's employees as employees of City.
5. INSURANCE, INDEMNIFICATION AND BONDS
5.1 Insurance. Consultant shall procure at its sole cost and maintain
comprehensive general liability, and automobile liability insurance against all claims for
injuries to persons or damages to property resulting from Consultant's performance under
this Agreement. The amount of insurance required hereunder shall be at least One Million
Dollars ($1,000,000) combined single limit per occul'rellce. In addition, Consultant shall
obtain at its sole cost, professional liability coverage with limits of at least Five Hundred
Thousand DollarS ($500,000) per occurrence. City shall have the right to review and
approve deductible a~nounts, il' any. In the event that Consultant is unable to obtain
occurrence based professional liability insurance, prior to rendering services hereunder,
Consultant shall agree in writing to maintain professional liability insurance wlth the same
insurer for at least three (3) years alter services rendered under this Agreeznent have
ceased. Consultant shall also carry workers' compensation endurance in.accordance with
California worker's compensation laws. All insurance required by this Section 5.1 shall be
kept in effect during the term of this Agreement, shall be issued by Admitted Insurers, and
who shall each be rated "A" in the .Best Rating Guide. Certificates evidencing the
foregoing insurance and endorsements designating City as an additional named insured on
the comprehensive general liability and automobile liability insurance (only), and providing
that each policy of insurance shall not be cancelable, without thirty (30) days advance
written notice to City, shall be delivered to and approved by. the City prior to
commencement of the services hereunder. The procuring of such insurance and the
delivery of policies, certilicates or endorsements evidencing the same shall not be construed
as a limitation of Consultant's obligation to indemnit'y the City, its Consultants, officers, and
employees.
5.2 Indemnilication. The Consultant shall defend, indemnify and h'old
harmless the City, its ofticers and employees, from and against any and all actions, suits,
proceedings, claims, demands, losses, costs, and expenses, including legal costs and
attorneys' fees, for injury to or death ol' person or persons, for damage to property,
including property owned by City, and for errors and omissions committed by Consultant,
its officers, employees and agents, arising out of or related to Consultant's performance
under this Agreement, except for such loss as may be caused by the sole negligence or sole
willful misconduct of City or that of its officers or employees.
6. RECORDS AND REPORTS
6.1 Reports. Consultant shall periodically prepare and submit to the
Contract Officer such reports concerning the performance of the services required by this
Agreement as the Contract Officer shall require.
6.2 Records. Consultant shall keep Such books and records as shall be
necessary to properly perforzn the services required by this Agreement and enable the
Contract Officer to evaluate the performance o1' such services. The Contract Officer shall
have full and free access to such 'books and records at all reasonable times, including the
right to inspect, copy, audit and make records and transcripts fi'om such records.
6.3 Ownership of Documents. All drawings, specilications, reports,
records, documents and other materials prepared by Consultant in the performance of this
Agreement shall be the property ol' City and shall be delivered to City upon request of the
Contract Officer or upon the termination o1' this Agreement, and Consultant shall have no
claim for further employment or additional compensation as a result o1' tile exercise by City
of its full rights or ownership 9t' the documents and materials hereunder. Consultant may
retain copies of such documents I'or its own use. Consultant shall have an unrestricted right
to use the concepts embodied therein.
6.4 Release of Docu~nents. All drawings, specitications, reports, records,
documents and other materials prepared by Consultant in the performance of services
under this Agreement shall not be released publicly without the prior written approval of
the Contract Officer, except that such documents shall be released in accordance with the
California Public Records Act.
7. ENFORCEMENT OF AGREEMENT
7.1 California Law. This Agreement shall be construed and interpreted
both as to validity and to performance of the parties in accordance with the laws of the
State of California. Legal actions concerning any dispute, claim or matter arising out of
or in relation to this Agreement shall be instituted in the Superior Court of the County of
Orange, State of California, or any other appropriate court in such county, and Consultant
covenants and agrees to submit to the personal jurisdiction of such ci~urt in the event of
such action.
7.2 .Disputes. In tile event of any dispute arising under this Agreement,
the injured party shall notify the i~iuring party in writing of its contentions by submitting
a claim therefor. The.injured party shall continue perl'or~ning its obligations hereunder so
long as the injuring party cures any default within ninety (90) days after service of the
notice, or if the cure of the default is commenced within thirty (30) days after service of
said notice and is cured Within a reasonable time alter commencement; provided that if the
default is an ilnmediate danger to the health, safety and general welfare, the City may take
immediate action under Section 7.5 of this Agreement. Compliance with the provisions of
this Section shall be a condition precedent to any legal action, and such compliance shall
not be a waiver of any party's right to take legal action in the event that the dispute is not
cured.
7.3 Waiver. No delay or omission in tile exercise ot' any right or remedy
of a non-defaulting party on any delhult shall impair such right or remedy or be construed
as a waiver. No consent or approval of City shall be deemed to waive or render
unnecessary City's consent to or approval of ally subsequent act of Consultant. Any waiver
by either party of any default must be in writing and shall not be a waiver of any other
default concerning the same or any other provision of this Agreement.
7.4 Rights and Remedies are Ct;mul:~tive. Except with respect to rights
and remedies expressly declared to be exclusive in this Agreement, the rights and remedies
of the parties are cumulative and the exercise by either party of one or znore of such rights
or remedies shall not preclude the exercise by it, at the same or different times, of any other
rights or remedies for the same default or any other default by the other party.
7.5 Legal Action. In addition to any other rights or remedies, either party
may take legal action, in law or in equity, to cure, correct or remedy any default, to recover
damages for any default, to compel specilic performance of this Agreement, to obtain
injunctive relief, a declaratory judgment or any other remedy consistent with the purposes
of this Agreement.
7.6 Termination Prior to Expiration of Term. Tile City reserves the right
to terminate this Agreement at any time, with or without cause, upon thirty (30) days
advance written notice to Consultant, except that where terznination is due to the fault of
the Consultant and constitutes an imznediate danger to health, safety and general welfare,
the period of notice shall be such shorter time as may be appropriate. Upon receipt of the
notice of temnination, Consultant shall immediately cease all services hereunder except such
as may be specitically approved by the Contract Officer. Consultant shall be entitled to
compensation for all services rendered prior to re. ceipt of the notice of termination and for
any services authorized by the Contract Officer thereafter.
7.7 Termination t'or Del'ault of Const, ltant. I1' termination is due to the
failure of the Consultant to fullill its obligations under this Agreement, City may take over
the work and prosecute the same to completion by contract or otherwise, and the
Consultant shall be liable to the extent that the total cost I'or completion o1' the services
required hereunder exceeds the compensation herein stipulated, provided that the City shall
use reasonable eff'orts to mitigate damages, ,and City may withhold any payments to the
.Consultant for the purpose of set-oil' or partial payment of the amounts owed to City.
7.8 Attorneys Fees. It' either party commences an action against the other
party arising out of or in connection with. this Agreeznent or it subject matter, the
prevailing party shall be entitled to recover reasonable attorneys' fees and costs of suit from
the losing party.
8. CITY OFFICERS AND EMPLOYEES; NON-DISCRIMINATION
8.1 Non-Liability ()f' Cit~' Officers and EmPh)yees. No officer or employee
of City shall be personally liable to the Consultant, or any successor-in-interest, in the event
of any default or breach by the City or f'or any amount which znay become due to the
Consultant or its successor, or I'or breach of any obligation of the terms of' this Agreement.
8.2 Covenant Against Discriznination. Consultant covenants that, by and
for itself, its heirs, executors, assigns, and all persons claiming under or through them, that
there shall be no discrimination or segregation in the performance of or in connection with
this Agreement regarding any person or group of persons on account ol' race, color, creed,
religion, sex, marital status, national origin, or ancestry. Consultant shall take affirmative

action to insure that applicants and employees are treated without regard to their race,
color, creed, religion, sex, marital status,, national origin, or ancestry.
9. MISCELLANEOUS PROVISIONS
9.1 Notice. Any notice, de. mand, request, consent, approval, or
communication either party desires or is required to give to the other party or any other
person shall be in writing aud either served personally or sent by pre-paid, lirst-class mail
to the address set forth below. Either party may change its address by notifying the other
party of the change of address in writing. Notice shall be deemed comtnunicated forty-eight
(48) hours from the time of mailing if mailed as provided in this Section.

9.2 Integrated ARreement. This Agreement contains the entire agreement
of the parties as to the subject matter herein, notwithstanding other contemporaneous or
prior oral statements or writings.
9.3 Amendment. In addition to the provisions of Section 1.7 , this
Agreement may be amended at any time by the mutual consent of the parties by an
instrument in writing.
9.4 Severabilitv. In the event that any one or more o1' the phrases,
sentences, clauses, paragraphs, or sections contained in this Agreement shall be declared
invalid or unenforceable by valid judgment or decree ol'a court of competent jurisdiction,
such invalidity or unenforceability shall not affect any of the remaining phrases, sentences,
clauses, paragraphs, or sections of this Agreement, which shall be interpreted to carry out
the intent of the parties hereunder.
9.5 Corporate Authority. The persons executing this Agreement on behalf
of the parties hereto warrant that they are duly authorized to execute this Agreement on
behalf of said parties and that by so executing this Agreement the parties hereto are
formally bound to the provisions of this Agreement.

REQUEST FOR PROPOSAL
REQUEST FOR QUALIFICATIONS
Tus'rlN RANCH TREE PARK
The City is requesting statements of qualifications and an estimate of cost fr~m design
firms for preparation of a Master Plan and Design Development Report for the Tustin
Ranch Tree Park.
Those firms responding to this request for qualifications will be evaluated and screened
by a selection committee on the basis of the qualification statement submitted. The
previous experience of key personnel, the relevance of the team's projects .and products,
favorable responses from references regarding the firms performance will be weighed
as well as creativity in solving problems, soundness in planning processes and methods.
Previous experience in developing a Master Plan fOr park facility and construction
documents for a mid-size community level and natgral/passive park is mandatory. A
tmowledge of tree maintenance and preservation is highly desirable. Respondents are
encouraged to suggest approaches to minimize the cost of the study and construction
of the facilities.
Consultant team shall consist of a registered landscape architect, licensed arborist a
licensed architect and registered civil' engineer. Those teams ranked highest will be
invited to an interview. Please note that this proposal request is not to be a cost.
competitive bid request but a cost estimate including task and manhours of services is
being requested. The cost effectiveness of the response will be considered in future
contract n. egotiations, with the consultant selected as most qualified. The city reserves
the right to. contract with the second-ranked team if a fair and reasonable price cannot
be negotiated with the selected' consultant.
BACKGROUND
The East Tustin Specific Plan identifies a passive nature park to be located on the 9 acre
community pm'k site on Pioneer Road in the Tustin Ranch area. (See attached map.)
This park features a 100 year old redwood and cedar stand of about 350 trees.. The City
wishes to develop a Master Plan for phased development of the tree park with County
Regional Trail access and anticipated improvements which might include rest room
facilities, picnic and play areas, benches, play equipment and lighted parking lots. A
small community building of less than 5,000 square feet might also be possible but has
been identified as secondary level improvements subject to reevaluation by .the
community.
Any construction phasing will be dependent on the available funding and the
developing needs of the community. However, the City anticipates that design and
constrUction should not exceed, with all 'phases, a .cost estimate of 1.3 million dollars.
This is based on a concept that would include parking lots, a maintenance plan to
protect and preserve the grove of trees, benches and play equipment, picnic areas,
appropriate landscape and hardscape. The City is not committed to this concept but is
providing this background information for a general scale of the project only.
SCOPE OF WORK
The Consultant will prepare a Master Plan for the proposed project which will include
a Design Development Report (DDR) for the project. The Design Development is that
portion of the design process that establishes the ultimate scope, functional requirements
and arrangement of facilities in the project. The DDR is to identify a program for a
phased development process relating the amenities for each phase.in accordance with
the needs of the community.
The City's philosophy is that citizen participation is extremely important. Thus, the City
expects the consultant to attend a minimum of two meetings with the neighbors of the
park and other interested parties and to obtain a consensus of the desired elements
recommended in each phase of park development.

Using the consensus, the consultant is required to develop a program to be included in
the DD~ A draft of the DDR will be reviewed by the Design Review Committee staff,
Planning Commission, City Council and the Parks and Recreation Commission (a
minimum of 4 meetings are anticipated). The Consultant is to also meet with the City
Staff on as needed, on going basis. Upon receiving review comments, the Consultant
is to draft the final Master Plan and DDR for final review bythese agencies as well as
the City Council,
The DDI~ should include a phasing schedule, background information developed from
the neighbor meetings consensus, factors identifying .the users' needs for each phase, key
elements of the East Tustin Specific Plan concerning development standards and
'guidelines, maintenance considerations and operational costs for each phase, potential
revenue.sources to offset operational costs and preliminary construction cost estimates
for each phase. The typical level of analysis and information requested for a Master Plan
DDI'~ Report is included as Attachment I of this report.
Upon review and approval of the Master Plan and DDi~ the City will identify available
funds for construction. A decision will be made as to whether, the consultant should
proceed with the working drawings for the first construction phase or stop at the Master
Plan le-Sel, the consultant would be compensated per the agreed upon fee schedUle for
the Master Plan and all work product Will become the property of the City.
Should the City decide to proceed with the fu-st construction phase, a separate
Architectural Se~ices Agreement would be negotiated at that time based upon the first

ADDITIONAL INFORMATION
Attached for your information in preparing your proposal is a sample "CertifiCate of
InsUrance" used by the City. Should your firm be awarded the contract, use of this form
will be necessary for '$1 million for Master Plan 'and up to $4 million.for final
construction design for general liability. The consultant is also advised that if selected,
a policy for errors and omissions coverage in the amount of $500,000 will be required.
All insurance must be provided by admitted insurers in the State of California with at
least at A V~ rating.
This .request for statement' of qualifications does not commit the City; to award a
contract, to any costs incurred in the preparation of the qualifications statement, or to
procure 'a contract for services or supplies.
The City reserves the fight to accept or reject any or all statements received as result of
this request, to negotiate with any qualified source or to cancel in part or in whole this
request if it is in the best interest of the City to do so.
Should the City decide to proceed with the first construction phase, the City reserves the
right to negotiate with any qualified source. Preparation of the Master Plan documents
does not automatically commit the consultant or the City to each other for this phase of

outlining our methodology for the preparation of a community driven park master plan for Tustin Ranch Tree
Park. In addition, per your request, we have also included optional services for construction drawings and
construction observation. We believe that upon review of our approach and past experience, you will find our
proposal custom tailored to the needs and desires required for the success of this exciting project. The design
of parks and community/recreational facilities is a specialty of our team.
We understand that this is a high priority project for the City of Tustin, and time is of the essence. With this
in mind, we have assembled a comprehensive, well rounded team of accomplished and recognized professionals
to fully meet the consulting requirements for developing the Master Plan and Design Development Report for
Tustin Ranch Tree Park. Due to the nature of this project, the team's expertise encompasses community based
park-planning and design, landscape architecture, architecture, engineering, horticulture and maintenance
specialists. Each team member was selected on the basis 'of direct and related experience to focus on this
assignment. This manner of team assembly assures our commitment to providing the finest available professional
services for the best possible results.
In order to demonstrate our sincere interest in assisting the City in transforming this exciting project into reality
within the specified time flame, we propose a unique process in which we would conduct an intensive 'in-house'
design workshop with the community of Tustin. This manner of Master Plan Development insures that the
ultimate plan represents the needs and desires of the community and local residents of Tustin Ranch. This would
serve to combine the collective talents and information available from the City staff, and members of the
community.together the expertise and enthusiasm of the Design Team into a 'focus session' consisting of two
half day design workshops.
The design of park facilities that "-fit' within the environmental context of the site is a specialty of our team. One
of our current projects, Rancho California Sports Park, located in Temecula, has recently . opened for use.
Primary program elements for this project included the provision for major community sports facilities within
the flood plane of an existing blue line stream. The Project was designed to minimize impact to less than one
acre, which falls under the 'Nationwide Permit" resulting in .minimum processing time. Similar issues were also
encountered with Andulka Park in the City of Riverside and with Centennial Park Soccer Complex in the City
of Santa Ana. Our design team possesses extensive experience on projects that are designed to accommodate and
showcase existing trees. Smithcliffs, a residential project located in north Laguna Beach, required extensive
coordination and design efforts to preserve an existing grove (approximately 75 trees) of 85 year old pine trees.

This 10,000 acre regional wilderness park is rich in natural resource diversity and provides the County
with a much needed wilderness oriented recreational opportunity. RIM Design Group has provided
recreational planning, interpretive programs, resource management and park management and control
programs. In addition, RIM Design Group teamed with Lawrence Halprin to conduct awareness tours
and community participation workshops to form consensus on park issues which in turn provided a
foundation for design solutions. .

2.4 DESIGN TEAM
The design for Tustin Ranch Tree Park will be a collaborative effort between the city
staff, community representatives,, and design team members.
RJM Design Group has planned and organized a project team selected 'from the best
talent available. The Project Team will include key members of RIM's staff having a
combination of immediate and prior experience with the design of similar facilities.
R,~ Design Group and Consultant team members have extensive local knowledge and
a desire to continue our close working associations with the City of Tustin.
The project will be the responsibility of R,~ Design Group as the primary firm with
Bob Mueting as Principal-in-charge.
We have selected our team members in consultation with the other principals, drawing
on the best expertise available which provides the highest relationship between experience
and the proposed project facilities.
Each team member was selected on the basis of direct and related experience to focus
on this assignment. This manner of team assembly assures our commitment to providing
the finest available professional services for the best possible results.

Robert I. Mueting of R.~I will be the Project Director and will maintain
continuous contact with the City's Project Representative. He will direct the
project from start to finish and will keep design team members informed of all
matters effecting the impact on the client requirements, i.e. design conformance,
budgets and schedules. He will be especially mindful of the political and public
attitudes regarding the project. This effort will require that he maintain close
communication with the City's Project Representative.
RJM has assembled a comprehensive, well rounded team of accomplished and
recognized professionals to fully meet the consulting requirements for the design
of Tustin Ranch Tree Park. Due to the importance,' and the community impact
of this project, the team's expertise encompasses park planning and design,
landscape architecture, architecture, engineering and horticultural specialists.
Each team member was selected on the basis of direct and related experience, to
enable the firm and its associated individuals to focus on this particular
assignment. This manner of team assembly assures our commitment to providing

experience Mr. Ryan has been involved with a wide variety of planning and landscape architectural

I. Randall Ismay has more than 25 years of education and experience in horticulture and related
fields. Randall is probably best known for his work with the Mission Viejo Company .in South
Orange County'. During his eight years with the Mission Viejo Company, he was responsible
for the development and implementation of a community-wide water management program. His
responsibilities included horticultural consulting to homeowner associations, the developer, lake
association, recreation associations, equestrian associations and government agencies. Mr.
Ismay's education in limnology (fresh water biology) has been utilized by a number of lake

ten years. He has been active in building and grounds management and wholesale nursery

M~ETHODOLOGY
Our firm offers a unique and comprehensive approach to preparing the Master Plan and Design
Development Report fi)DR) for Tustin Ranch Tree Park. This approach is based upOn past
involvement in the successful completion of the Master Planning and Design of numerous similar
facilities.

The approach incorporates techniques which we have used successfully on similar projects
including extensive coordination with the City Staff, City Boards and Commissions, and
integration of their expertise into the design process; as well as meetings structured to receive
input from community and neighborhood groups to establish consensus on program and facility
requirements for the project.

cOoRDINATION WI'iII CITY STAFF
RJ1Vl's Design Team, individually and collectively, has directed many interdisciplinary
planning and design projects. We have found that team work and close coordination
between the client, consultants and~public agencies is essential to a.successful project.
We recognize that the design team will be responsible for ensuring that a high degree of
coordination occurs and the project milestones are met. A major priority of the design
team will be to establish a regul~ dialogue with the City Staff and interested parties so
that our products reflect project goals and City policie, s.
CITY MEETINGS AND NEIGHBORHOOD INPUT
The Design Team suggests a program of City meetings to establish project goals,
introduce alternative plans and Obtain neighborhood and community comment. We
propose to work closely with the City Staff to organize and further define the approach
to be used in this element of the design program. A properly designed meeting program
will ensure that opportunities~ for City and neighborhood review and comment occur at
the appropriate stage in the design process.
The utilization of a Project Committee will provide for a smaller scale group of
concerned community members to meet with and review the design alternatives prior to
and following the citywide workshops. They will provide the necessary continuity from
beginning to .end. We' suggest working with a Project Committee made up of
representatives from the City Staff, Council/Commissions, and individuals from the
community and residents near the proposal park site that have a special interest or
background related to the specific facilities in Tustin Ranch Tree Park.. We propose
extensive coordination between the Project Committee and the Design Team and
integrating their expertise into the design process.

5.3 PROJECT MANAGEMENT

The importance of this project demands an organizational framework which focuses
specialists in varied disciplines towards one common goal. Our Design Team has been
specially selected from the best talent available. Our approach to this project is based
on a strong relationship of the team members'and a thorough understanding of the project
r.equirements.
We suggest working with a representative from the City that will form the conduit
through which all project information is exchanged and relayed to the proper City
Agencies and neighborhood groups.
Our objective is to define the problem, gather all pertinent facts, analyze the information,
develop the best alternatives, and select the most viable solutions for implementation.
It is the responsibility of our project director to ensure that the team is efficiently moving
in the right directions in accordance with the project requirements and the desires of the
City of Tustin.
DESIGN ALTERNATIVES
The Design Team has found that alternative plans are developed more efficiently through
a systematic process of concept development, interdisciplinary review/critique and
refinement. Frequent dialogue among the City Staff and Design Team Members is a
dynamic and effective way to structure efficient design concepts. This process results in
rapid consensus on the major components of alternative plans. Refinement of program
elements will result in one design alternative which will be reviewed with the community
and adjacent neighborhood(s). Once consensus is gained we suggest that appropriate city
agency review and approval is obtained prior, to final refinement. Throughout the design
process, the protection of the existing tree grove, interface/relationship to the proposed
adjacent school site, park security and visibility will be of utmost importance. The
proposed design solutions will provide for adherence to current ADA requirements,
minimize maintenance costs, and provide maXimum protection from vandalism.

SECTION 7.0 SCOPE OF WORK
PART I: MASTER PLAN
PHASE 1.0 RF.~OURCE DOCUMENTATION
In collaboration with City Staff, our Design Team shall review, elaborate upon, and
clarify the overall objectives for the development of the Tustin Ranch Tree Park. We
shall also verify the expected goals and criteria to be met within each phase of our
services. During this review, we shall determine appropriate procedures to 'promote
efficient working relationships and communication among all participants who need to
interact with the Design Team.
We suggest the following logistical procedures be refined and further determined with
input from the City. :
Participation of City Staff and Community Groups
We also propose t° discuss the ."Project Committee" concept and develop a listing of
residents who would be interested and available to participate as a Project Committee
member. Final selection of the Project Committee by City Staff would occur at a later
date to ensure an appropriate cross section of the community was included.
Data Collection and Unification
Establish a comprehensive data base through a thorough review and analysis of existing
pertinent information. (City to provide the following documents)

uses. The critical region of investigation shall be focused upon the immediate site
and those sites physically adjacent to Tustin Ranch Tree Park. Upon
completion of the detailed site analysis, and a review of the existing Tree Grove
and current evaluation of the general health and condition of the trees, a
comprehensive opportunity and constraint exhibit will be prepared at 1' = 40'
scale together with a detailed photo board depicting the site elements and
characteristics.
Generally, we anticipate the following tasks to be necessary for the preparation
of a Comprehensive Opportunity and Constraint Exhibit.

8.1 FEE SCHEDULE
It is the objective of our Design Team to provide the most comprehensive, yet efficient approach
to the development of Train Ranch Tree Park. We have structured our scope of work into
Part I: Master Plan, Part H: Construction Documents, Part HI: Construction Services.
Part I: Master Plan (Phases 1.0-5.0) Fee $ 26,500.

The Construction Document and Construction Services shall be negotiated with the City
after the Master Plan has been approved and specific program elements (site acce.ss,
parking lot, buildings, utility plans, extent of grading, possible project phasing) are able

In order to save consultant mark-up on reprographic, printing, and photographic
expenses, it is our suggestion that a City account be established at a local blueprint
company for Tustln Ranch Tree Park. This will save the City approximately 10-20 %
(City discount and consultant mark-up).

There will be no fee escalation during the Master Plan Phase of the project. Fees may be

other mutually agreed upon cost index during the Design and Construction Phases of the project.
All provisions for escalations stated, pertain to all contract extension and additional work.

and landscape architectural firm of RJM Design Group, Inc.
I have had the pleasure of working with RJM Design Group, Inc. on
the development.of the Flamenco and Pinecrest Parks for the City of
Mission Viejo. This 47.5 acres of undeveloped parkland and open
space involved working with Southern'California Edison Company, the
Department of Fish and Game, the City of Mission Viejo, and several
citizen action groups.
RJM Design Group, Inc. was a tremendous asset to this project. The
City of Mission Viejo had hired another firm to complete the Master
Plan for Flamenco and Pinecrest· Parks. As the City of Mission
Viejo began to wor~ with RJM Design Group, Inc. on the development
of these two park sites, it soon became apparent that the firm the
City hired to complete the Master Plan did not complete a thorough
plan for the area. The Master Plan called for building amenities
directly under Southern California Edison easements. This· is
strictly prohibited by Southern California Edison. Thus, RJM
Design Group,. Inc. really worked with us to secure that what the
City of Mission Viejo wanted to do would be acceptable to Southern
California Edison. Joint meetings between the City of Mission
Viejo and Southern California Edison were arranged by RJM Design
Group, Inc. As a result of RJM Design Group, Inc.'s involvement,
professionalism, and experience, the City of Mission Viejo was able
to develop these park sites to everyone's satisfaction.
The City of Mission Viejo has an excellent working relationship
with RJ~ Design Group, Inc. We have worked with this firm on
numerous park development projects. This firm'~brings a sense of

The City shall appoint a Project Manager to coordinate the Maste~' Plan process on
behalf of the City, the Project Manager shall report to a Contract Officer who shall
be Christine Shingleton. HNTB is cUrrently appointed as the Project Mflnager for
this project.
The Project Manager shall certil'y pay~nent applications, ad~ninister chahge orders,
and shall be the primary liaison between the Architect and the City. All items listed
will require approval by Contract Officer.
If Consultant observes or otherwise beco~nes aware of any fault or defect in the
project, or non-conformity with contract documents, prompt Written notice will be
given to the Contract Officer.
.Consultant shall not release to the public or the press information on this project
without prior authorization by Contract Officer.
A no-fee business license shall be provided by the City to Consultant.
Consultant shall present to City certificates o!' insurance and endorsement I'orms'
verifying that the Consultant has the insurance as required by this agreement. Said
forms shall be reviewed and approved by the office of the City Attorney of the City
of Tustin. On the CertiliCate o1' Insurance attached, designate City of Tustin and
HNTB (Project Manager) as additional insured parties.
Design Review/Master Plan adoption shall include:

Contract officer determines that a product deliverable is unacceptable, either before
or after a dral't of linal dral't is issued because it did not conform to the
requirements of this agreement, the consultant shall submit a revised report or
product at consultant's expense.
Consultant shall utilize those professional and sub-contractors to pert'oran services
as identitied in consultant's proposal. No substitution shall be made without the
advance written approval o1' the Contract Officer, after-review o1' the proposed
replacements experience and qualitications with a written explanation of necessity

for the change. No increase on compensation or reimbursable salary rates will be
allowed when personnel or tirm substitutions are authorized.

Consultant shall review and replace project or sub-consultants personnel assigned
to project who do not perform assigned duties in a manner satisfactory to Contract
Officer.
Consultant shall be required to ~neet with Contract Officer and Project Manager as
required to discuss progress on scope o1' work at Contract Officer's direction.
