HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/WATER DIVISION AWARD OF CONTRACT FOR COLUMBUS TUSTIN WELL EMERGENCY POWER RETROFIT - CITY PROJECT NO. 600112 ,RECOMMF~NDATION: That the Tustin City Council, at its regularly scheduled meeting of April 17, 1995, award the contract for the subject project to American Electric Company, of Orange California, in the amount of $122,640. ..FISCAL IMPACT: $122,640 from Certificate of Participation (Bond) Procx~s. There is currently $109,000 budgeted for completion of this project. Savings from the completed Newport Avenue Water Main Replacement Project (Project No. 600101) will be transferred for completion of this project. BACKGROUND: Bids for the subject project were opened on March 30, 1995, and were received as follows: 1. American Electric Company $122,640 2. Shultz Electric, Inc. $123,449 3. Miron Electric Construction Corp. $131,800 4. Allied Engineering & Construction Corp. $132,648 5. Power Distributors, In,.' $136,175 The low bid was 8% below the Engineers' Estimate of $132,715. The contract consists of two bid items: . Fumishing and installing electrical components and appurtenant items at a cost of $22,840 and; . Furnishing a trailer mounted emergency diesel generator at a cost of $99,800. The second low bidder, Shultz Electric, Incorporated, protested award of the contract to the low bidder because American Electric Company did not list a generator supplier as a subcontractor. The City Attorney has reviewed the protest, along with applicable sections of the Public Contracts Code and AWARD OF CONTRACT FOR COLUMBUS TUSTIN WELL EMERGENCY POWER RETROFrr - CITY PROJECT NO. 600112 April 17, 1995 Page 2 Business and Professions Code. Under these sections, materials and services suppliers are not required to be licensed contractors, and therefore, it is not required that they be listed as a subcontractors in a General Contractor's bid documents. It is therefore recOmmended that the award to the low bidder to upheld. DISCUSSION: The Water System Storage Evaluation Study, completed in October of 1990, recommended purchase of a portable generator for the purpose of providing an emergency water supply. When operational the emergency power system will provide 2 million gallons per day of added water supply in the event of a widespread power outage.
