HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGiNEERING DIVISION ACCEPTANCE OF IMPROVEMENTS AND AUTHORIZATION TO RECORD A "NOTICE OF SUBJECT: COMPLETION" FOR PUBLIC FACILITIES AND IMPROVEMENTS FOR COMPLIANCE WITH THE AMERICANs WITH DISABILITIES ACT COMMUNITY DEVELOPMENT BLOCK GRANT (CDBO) FUNDINO FOR ]993-94 FY ~PWN.T~.~ ~ 9~9Q%~ RECOMMENDATION It is recommended that the City Council, at their meeting of April 3, 1995, adopt the attached resolution accepting the works of improvement as complete and authorize the recordation of the Notice of Completion and direct the City. Clerk to: 1. Release the Labor and Materials Payment Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and ' 2. Release the Faithful Performance Bond not sooner.than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention in the amount of $2,422.18. This amount together with the previous payments of $21,799.65 represents 100% of the final contract amount of $24,221.83. FISCAL IMPACT The final cost of construction is $24,221'83. This project is funded with Community Development Block Grant Funding for the 1993-94 FY. BACKGROUND The purpose of this project was to provide access ramps at various public facilities in the CDBG areas in compliance with ADA requirements. The project'involved sidewalk removal and reconstruction .as well as modification to existing curb and gutter. This project included one change order in the amount of $2,468.83 to cover extra work costs for construction of retaining curbs and the removal of a previously unknown traffic signal foundation. This work has been completed to the satisfaction of the Engineering Division. Hallman Junior Civil Engineer TDS:%VEH:klb:cdb{ Atlacl~neat 1 $ 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 25 27 RESOLUTION NO. 95-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR PUBLIC FACILITIES AND IMPROVEMENTS FOR COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT, COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDING 1993-94- FY WHEREAS, Hi Tech Pro Construction, having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Public Facilities and Improvement for Compliance with the Americans with Disabilities Act, Community Development Block Grant (CDBG) Funding for 1993-94 FY PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 3rd-day of April, 1995.
