PLEDGE OF ALLEGIANCE Led by Mayor Saltarelli~ III. INVOCATION Led by Mayor Saltarelli. IV. ROLL CALL Present: Councilmen: Saltarelli, Edgar, Sharp, Sutcliff, Welsh. Absent: Councilmen: None Others present: City Administrator William Bopf Assistant City Administrator for Community Development Ken Fleagle City Attorney James Rourke City Clerk Ruth Poe V. PUBLIC HEARINGS 1. MEDIAN CONFIGURATION ~ NEWPORT AVENUE The public hearing was opened at 7:40 p.m. Mr. John Stueve, Manager of the Altedena Dairy, stated his concern regarding the elimination of the left turn lane going northerly on Newport Avenue and requested Council to reconsider Alternate D6. Mr. Franklin Metzleur, owner of the library site, presented Council with ~ plan that varied with Alternate D and explained his concerns regarding the elimination of the left turn lane onto his property going in a southerly direction on Newport Avenue. Discussion centered on a 9' drive off of Andrews Street which could provide entry onto this property rather than creating the left turn lane off of Newport Avenue. His request was Alternate D5. Mr. Nobno Miyamoto, owner of the nursery at 13812.Newport Avenue, stated his concern that under Alternate D southbound traffic on Newport Avenue will be unable to make a left turn onto the alley on the north side of his property. His request was Alternate D4. The public hearing was closed at 7:55 p.m. After some discussion among the Council it was moved by Edgar, seconded by Sharp to accept the Alternate D plan as recommended by the City Engineer. Carried unanimously. VI. PUBLIC CONCERNS None. VII. CONSENT CALENDAR 1. APPROVAL OF MINUTES - October 6, 1975 meeting. 2. RATIFICATION OF DEMANDS in amount of $150,374.03 and CONFIRMATION OF PAYROLL LISTING in amount of $108,432.54. 3. AGREEMENT WITH ASSISTANCE LEAGUE OF TUSTIN Tentative approval of agreement with the Assistance League of Tustin for use of City owned old Tastee Freeze building re services to local Senior citizens~ as recommended by Parks & Recreation Director. 4. SUMMER RECREATION & ACQUATIC PROGRAM Authorization of payment to the Tustin Unified School District of $1,111.06 which is its share of the net profit of $2,222.12 as per joint agreement. City Council Minutes 10/23/75 Page two 5. PHYSICAL EXAMINATION - FIRE DEPARTMENT Authorization for i~itiation of program as recommended by the City Administrator. 6. RESOLUTION NO. 75-67 A Resolution of the City Council of the City of Tustin APPROVING ~ TENTATIVE PARCEL MAP NO. 75-78 ON APPLICATION OF CITIES SERVICE COMPANY. Adoption as reconnnended by Asst. City Administrator-COmmunity Development Director Mr. Fleagle informed that the Cities Service Company has requested a continuance on item NO. 6. Movedby Welsh, seconded by Sutcliff that items 1 through 5 on the Consent Calendar be approvedo Carried unanimously. After some discussion Council requested a follow-up report on item 5 regarding physical examinations for the Fire Department, in approxi- mately one year. VIII. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 664 An Ordinance of the City of Tustin, California, AMENDING THE TUSTIN CITY CODE RELATIVE TO ISSUANCE OF CITATIONS Moved by Edgar, seconded by Sutcliff that Ordinance No. 664 have second reading by title. Carried unanimously. The secretary read Ordinance No. 664 by title. Moved by Edgar, seconded by Sutcliff that Ordinance NO. 664 be passed and adopted. Carried. Ayes: Saltarelli, Edgar, Sharp, Sutcliff. Noes: Welsh. Absent: None. 2. ORDINANCE NO. 665 An Ordinance of the City of Tustin, California, REZONING THE SITE OF ST. CECILIA CATHOLIC CHURCH FROM THE R-4 (RESIDENTIAL) TO THE P&I (PUBLIC & INSTITUTIONAL) DISTRICT ON APPLICATION ZC 75-2. Moved by Sharp, seconded by Edgar that Ordinance No. 665 have second ~ading by title. Carried unanimously. The secretary read O~dinance No. 665 by title. Moved by Sharp, seconded by Sutcliff that Ordinance No. 665 be passed and adopted. Carried. Ayes: Saltarelli, Edgar, Sharp, Sutcliff, Welsh. Noes: None. Absent: None. IX. ORDINANCES FOR INTRODUCTION None. X. OLD BUSINESS 1. NEWPORT AVENUE UTILITY UNDERGROUNDING DISTRICT Moved by Edgar, seconded by Welsh, that Alternate B be given first priority with Alternate A to follow with the understanding that if adequate funds are available Alternate B & A will be accomplished concurrently. Carried unanimously. 2. ORDINANCE NO. 666 AN ORDINANCE OF THE CITY COUNCIL, CITY OF TUSTIN, AMENDING THE TUSTIN CITY CODE PROHIBITING CERTAIN NIGHTTIME USE OF PUBLIC PARKS City Council Minutes 10/23/75 Page three Moved by Edgar,'seconded by Saltarellithat Ordinance No. 666 have first reading by title only. Carried unanimously. The secretary read Ordinance No. 666 by title. Moved by Edgar, seconded by Sharp that Ordinance No. 666 be introduced. In response to questions from Council, Mr. Biery stated that the Parks & Recreation Commission will be reviewing this Ordinance at their next meeting a~d a report will be presented to Council at their next regular meeting. In response to questions from Mr. John Olivieri, 14692 Westfall Lane, Mayor Saltarelli explained that this is not an action to harass anyone but rather to have enforcement over young people that have been dis- turbing the peace in Centennial Park. The intent~of this ordinance is to disallow the use of the parks one-half hour after sunset and the same before sunrise with exceptions made for recreational activities that take place with lighting facilities. Special permits will be issued for special events. The above motion was carried. Ayes: Saltarelli, Edgar, Sharp, Sutcliff. Noes: Welsh. ~sent: None. XI. NEW BUSINESS 1. REGIONAL TRANSPORTATION STUDY Moved by Sharp, seconded by Edgar that the Council formally express its interest in participating in this Regional Transportation Study with- holding its final con~nltment until it is apprised of the proposed sharing formdl~and the cost. Carried unanimously. 2. ORANGE COUNTY PIANNING COMMISSION RESOLUTION RELATIVE TO LAND USE AMENDMENTS AND ZONE CHANGES WITHIN THE AREA OF S/E ORANGE COUNTY CIRCULATION STUDY. RESOLUTION NO. 75-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN IN SUPPORT OF DETERMINATION OF TRAFFIC CIRCULATION REQUIREMENTS PRIOR TO LAND USE AMENDMENTS WITHIN THE SOUTHEAST ORANGE COUNTY CIRCULATION STUDY AREA. Moved by Edgar, seconded by Sutcliff that Resolution No. 75-68 be read by title only. Carried unanimously. The secretary read Resolution No. 75-68 by title. Moved by Edgar, seconded by Sharp that Resolution No. 75~68 be passed and adopted. Carried unanimously. XII. OTHER BUSINESS 1. STUDENT GOVERNMENT WEEK An announcement was made that Student Government Week will be held October 27-31. 2. LONG RANGE BUDGET Mr. Bopf reported on the progress of the long range budget. 3. CITY SPONSORED SWIM PROGRAM Mr. Biery was commended for the financial results of the City swim program. After some discussion pertaining to future swim programs, it was moved by Edgar, seconded by Sutcliff to instruct Mr. Biery to draw up a program for acquatics at Foothill and Tustin High Schools for next summer. After further discussion it was moved by Welsh, seconded by Saltarelli to amend the motion to drop Foothill High and pursue the same program as last seer. Amended motion failed. Ayes: Welsh. FIRE INSURANCE RATINGS Staff to inquire asto date of new rating. 5. PRIORITY OF FREEWAYS Resolution to be prepared for next meeting in support of completion of Freeway 55 and extension of Freeway 57. 6. POLE SIGNS FOR PROFESSIONAL DISTRICT Council directed s~aff to prepare a report on the above matter. 7. PERSONNEL REPLACEMENTS Council directed that new hires and replacements are to be filled only with Council approval. 8. CITY/SCHOOL PROGRAMS Council directed that ~n inventory of supplies is to be accounted for relativ~ to City/School~Programs- 9. CORRESPONDENCE TO MAYOR TEMPLE Council directed staff to prepare correspondence to Mayor Temple commending him upon his retirement with the City of Orange. XIII. ADJOURNMENT The meeting was adjourned at 10:05 p.m. to the next regular meeting Of November 3, 1975.
