RESOLUTION NO. 95-36 AUTHORIZING THE CITY OF GARDEN GROVE TO
ACT ON THE BEHALF OF THE CITY OF TUSTIN BOTH AS APPLICANT AND
GRANT ADMINISTRATOR FOR THE CALIFORNIA INTEGRATED WASTE
MANAGEMENT BOARD USED OIL OPPORTUNITY GRANT PROGRAM
RECOMMENDATION
Adopt Resolution No. 95-36 authorizing the City of Garden Grove to act
on the behalf of the City of. Tustin both as applicant and grand
administrator for the California Integrated Waste Management Board Used
Oil Opportunity Grant Program.
Direct'the City Attorney to prePare and authorize the Mayor to execute
an agreement with the City of Garden Grove to develop and manage a Used
Oil Program at no cost to the City of Tustin.
FISCAL IMPACT
There is no fiscal impact associated with this action. Ail fees for
program develoPment and management' will be paid from grant monies
received.
BACKGROUND'AND DISCUSSION
At the regular City Council meeting of January 3, 1995, the City Council
adopted Resolution No. 95-15 authorizing Great Western Reclamation to
prepare and submit an application for a California Used Oil Recycling
Opportunity Grant. However, during the preliminary application process,
the California Integrated Waste Management Board (CIWMB) suggested that
a regional program with other jurisdictions would compete more
effectively for the available grant funds and would provide for more
efficient local used oil collection programs. The regional program
entitlement would allow for a maximum possible award of $300,000 with no
requirement for matching funds.
The regional program also requires that one jurisdiction be designated
to act on the behalf of all participating jurisdictions. Garden Grove
will be designated as the administrator of the regional opportunity
grant.
As Great Western Reclamation does not have the available expertise to
prepare a regional application, the City of Garden Grove will enter into
an agreement with The Oricom Group to administer the Used Oil
Opportunity Grant at no cost to the Cities of Tustin or Garden Grove.
Oricom would fully administer the program under the direction of the
City of Garden Grove and coordination from Tustin's Recycling
Coordinator.

Additionally, a percentage of the funds will be made available for the
purpose of recovering any administrative costs the City may incur.
Funds from the 1995/96 Opportunity Grant Program will be used to develop
a new Residential Call-In Program to enhance existing programs that
address the proper disposal of used lubricating oil. The Call-In
Program will provide for curbside pick-up of used motor oil, filters,
and oily rags for recycling. Public EduCation will continue to be a
significant component .of the Program.
It is estimated that of the 183,182 gallons of motor oil available for
collection from "Do-it-yourselfers" in the two cities, some 36,636
gallons are taken to State Certified Collection Centers or the Orange
County Household Hazardous Waste (HHW) Collection Centers. Orange
County's bankruptcy has resulted in reduced hours for the HHW Centers.
This reduction of hours puts the City's residents at a distinct
disadvantage of options for the safe disposal of used motor oil.
CONCLUSION
To proceed with the development of the grant application, adoption of
Resolution No. 95-36 approving the submittal of an application for State
grant monies and approval of an agreement with the Lead City (Garden
Grove), who will coordinate the applicable submittal, program
development and management is required.

A RESOLUTION OF THE'CITY COUNCIL OF THE CITY OF TUSTIN,
AUTHORIZING THE CITY OF GARDEN GROVE TO ACT ON THE BEHALF
OF THE CITY OF TUSTIN BOTH AS APPLICANT AND GRANT
ADMINISTRATOR FOR THE CALIFORNIA INTEGRATED WASTE
MANAGEMENT BOARD USED OIL OPPORTUNITY GRANT PROGRAM
WHEREAS,~ the people of the State of .California have
enacted the California Oil Recycling Enhancement Act that
provides funds to cities and counties for establishing and
maintaining local used oil collection programs that encourage
recycling or appropriate disposal of used oil; and
WHEREAS, the California Integrated Waste Management Board
(CIWMB) has been delegated the responsibility for the
administration of the program within, the State, settling up
necessary procedures governing application by cities and
counties under the program; and
WHEREAS, the applicant will enter into an agreement with
the State of California for development of the project;
NOW, THEREFORE, BE IT RESOLVED that the City of Tustin
authorizes the City of Garden Grove to submit to the
California Integrated Waste Management Board a regional
application for the Local Government Used Oil Opportunity
Grant on its behalf. The City of Garden Grove is hereby
authorized and empowered to execUte all necessary
applications, contracts, payment requests, agreements and
amendments hereto for the purposes of securing grant funds and
to implement and carry out the purposes specified in the grant
application.
AND BE IT FURTHER RESOLVED that the City council of the
City of Tustin:
Appoint the Dirdctor of Public Works/City Engineer as
agent of the City of Tustin to conduct all negotiations,
execute and Submit all documents including but not limited to:
applications, agreements, amendments, payment requests and so
on, which may be necessary for the completion of the
aforementioned project.
