HUSTON, EXECUTIVE DIRECTOR FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: REDEVELOPMENT AGENCY IMPLEMENTATION PLAN RECOMMENDATION It is recommended the Agency adopt Resolution No. RDA 94-16 approving the Implementation Plan for the Town Center and South Central Redevelopment Project Areas. FISCAL IMPACT This action will have no fiscal impact on the Redevelopment Agency. State Law requires the Agency to adopt a five (5) year Implementation Plan outlining, in general terms, its intentions for the coming five years. This plan does not appropriate Agency funds, nor does it require the Agency to appropriate Agency funds in the future. DISCUSSION AB 1290, adopted by the Legislature in 1993, made considerable changes in California Redevelopment Law and placed additional requirements on local redevelopment agencies. One of these requirements is the adoption of a five (5) year implementation plan by each redevelopment agency before December 31, 1994. The Implementation Plan is intended to identify the Agency's intentions for programs and projects it intends to undertake during the coming five years. The law allows an Agency to combine different project areas into a single Implementation Plan, which is what the Staff has done. The proposed Implementation Plan covers both the Town Center and the South Central Redevelopment Project Areas. The Staff originally brought this before the Agency at its meeting of October 3, 1994, in order to receive direction concerning the public works projects the Agency wished to include. The proposed projects were those which the Agency had previously identified as priority projects for the Project Areas. At the October 3rd meeting the Agency continued its consideration allowing it time to consider the prioritization of the public works projects, as well Redevelopment Agency Report Implementation Pl~an December 5, 1994 Page 2 as economic development activities it Wished to undertake during the period covered by the Implementation Plan. At its meeting of October 17, 1994, the Agency adopted a prioritization of public works projects as well as the economic development programs and housing the Agency is expecting to offer. We have, however, added youth recreational facilities to the public works projects in the South Central Project Area based on the Council direction at its November 21, 1994 meeting. As with the public works projects, the economic development activities and the housing programs are those which the Agency had previously adopted. The proposed Implementation Plan consists of three sections. The first includes background on each project area, including accomplishments to date. The second section deals with redevelopment activities and includes those public works projects and economic development programs the Agency directed Staff to include at its October 17th meeting. This section of the plan also identifies how these activities will assist in eliminating blight in the two project areas. The second section deals with housing activities. It outlines specific housing goals the Agency has previously adopted, its accomplishments to date, as well as the housing activities the Agency intends to implement in the coming five years. In reviewing the Implementation Plan, the Agency should note the following: The purpose of the Implementation Plan is to provide basic information about the Agency's intentions over the coming five years. It is not intended to take the place of the Agency's ability to establish its priorities and direct staff accordingly. · By its nature, redevelopment is opportunistic and must remain fluid in order to respond to the marketplace. The Implementation Plan does not limit the Agency from developing additional or alternative programs or projects in the future. o If the Agency wishes to alter the Implementation Plan in the future, it may do so easily. · The State has not included any penalties in Law if the Agency does not meet expectations of the Implementation Plan. Redevelopment Agency Report Implementation Plan December 5, 1994 Page 3 · The Implementation Plan includes more projects and programs than the Agency expects to be able to fund. If the Agency cannot afford all of the activities and programs outlined in the Plan, there is no penalty. However, Staff feels it is important to list all possible projects and programs, particularly in light of the history of the State to take from local agencies money the State feels is unencumbered. The Implementation Plan is attached for the Agency members review· Staff will be available at the Agency meeting to answer any questions the members may have. CONCLUSION Christine A. S~/ngleton Assistant City'Manager State Law requires the Agency to hold a public hearing before adoption of the Implementation Plan. The hearing has been noticed as required by State Law. RDA 94-16 10 11 12 13 14 15 16 17 18 19 20 21 22 24 25 26 27 28 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE FIVE YEAR IMPLEMENTATION PLAN FOR THE TOWN CENTER ANDSOUTH CENTRAL REDEVELOPMENT PROJECT AREAS. I · The Redevelopment Agency finds and determines as follows: A· That the City Council adopted the Town Center Redevelopment Plan on November '22, 1976 by Ordinance No. 701 and subsequently amended the Redevelopment Plan on September 8, 1981 by Ordinance No. 855, further amended the Redevelopment Plan on March 20, 1989 by Ordinance No. 1021 and further amended the Redevelopment Plan on November 21, 1994 by Ordinance No. 1141; · That the City Council adopted the South Central Redevelopment Plan on August 1, 1983 by Ordinance No. 890 and subsequently amended the Redevelopment Plan on July 15, 1985 by Ordinance No. 939, and further amended the Redevelopment Plan on November 21, 1994 by Ordinance No. 1142; Co That Section 33490(a) (1) (A) of the Community Redevelopment Law requires the Agency to adopt a Five (5) Year Implementation Plan, outlining specific programs, including potential projects and expenditures proposed by the Agency to be made during the next five 95) years; D. That Section 33490(a) (1) (B) the Community Redevelopment Law states that the adoption of an Implementation Plan is not a "project" within the meaning of Section 21000 of the Public Resources Code and is not subject to environmental review. E . That a public hearing was duly noticed, called and held by the Redevelopment Agency on December 5, 1994; II.
