SUBJECT: ADVERTISE FOR BIDS, REMEDIAL GRADING FOR JAMBOREE ROAD
DISPOSAL SITE NO. 2
RECOMMENDATION
That the Tustin City Council at their meeting of November 21, 1994
approve the plans and specifications for the Remedial Grading for
the Jamboree Road Disposal Site No. 2, and authorize the
advertisement of bids for said project.
FISCAL IMPACT
No impacts to the City General Fund. Ail costs will be initially
borne by City of Tustin Assessment District No. 86-2 with
reimbursement being sought through litigation against the
responsible parties. Estimated cost of the remedial grading is
$781,000.00.
BACKGROUND
In July, 1988 the City of Tustin formalized Assessment District No.
86-2 (AD86-2) which provided funding for the public infrastructure
improvements within a portion of the Tustin Ranch Development. One
of the AD 86-2 projects was the construction of Jamboree Road
between Irvine Boulevard and Santiago Canyon Road in the City of
Orange.
The Jamboree Road project included a cut and fill grading operation
that resulted in an excess amount of earth which was placed in two
disposal site areas within the vicinity of the project. These
disposal sites are identified as the Jamboree Road Disposal Site
No. 1 and No. 2. The disposal site in question and the topic of
this memorandum is identified as Disposal Site No. 2, which is
located within Tract No. 13627 and lies within portions of Lots 1,
10, 11, 16, 17 and 18 of that tract.
During the Jamboree Road construction, excess material from the
roadway grading operation was placed within the limits of Disposal
Site No. 2. As a part of this operation, the City contracted the
geotechnical services with the firm of Geo-Soils, Inc. to serve as
the City's geo-technical inspectors/soils engineers for the grading
operation within the disposal site area. These contracted services
included, but were not limited to, the following:

Provide direction to the contractor as to the limits of
unsuitable material prior to the placement of any fill
material within the disposal site area.

Evaluate and direct the contractor as to the required
limits of alluvial material removal within the disposal
site area.

Inspect the placement of excess fill material within the
disposal site area and perform compaction testing on all
replaced alluvial material from the site and all excess
fill material generated from the Jamboree Road project.
The initial grading operation within Disposal Site No. 2 has been
completed by the City's contractor. However, as a result of the
Irvine Company's final plan preparation for final grading on Lot 10
of Tract No. 13627, it was discovered that certain areas within
Disposal Site No. 2 still contained unsuitable material identified
as alluvial deposits, which have the potential for consolidation/
collapse when subject to excessive moisture. These findings were
confirmed byan independent (third party) geo-technical consultant
hired by the City.
The City Council previously authorized binding arbitration with the
Irvine Company to resolve a dispute over who was responsible for
the remediation of this soils problem. On September 2, 1994, the
arbitration was conducted by the Judicial Arbitration Service
(Judge Blanpied) and was found in favor of the Irvine Company.
Additionally, it was directed that the remedial grading operations
be implemented at the earliest feasible date. The Irvine Company
and the City have tentatively agreed to commence work in late March
or early April, 1995 with completion scheduled for late May or
early June, 1995.
DISCUSSION
Plans and specifications for the Remedial Grading for DisPosal Site
No. 2 have been completed and are now ready for the City Council's
approval and authorization to advertise for bids.
It is the City's intent not to commence any work on this project
until after the upcoming rainy season. However, to expedite the
project, staff is proposing to commence the bid advertisement at
this time to complete all of the necessary administrative work by
February, 1995. Following is a tentative schedule for the remedial
grading project:

A detailed Scope of Work will be developed with the geo-technical
firm of Converse Consultants West to provide inspection and testing
services during the remedial grading operations pertaining to
Jamboree Road Disposal Site No. 2. This firm is the same firm that
the City previously utilized as their independent (third party)
geo-technical consultant. A Professional Services Agreement for
this work will be scheduled for City Council consideration
concurrently with City Council award of the construction contract.
