HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ACQUISITION OF WASTE AND RECYCLING CONTAINERS FOR CITY PARKS SUMMARY The City has received a California Department of Conservation grant to implement a beverage container recycling program at City parks. Staff is seeking a waiver of City bidding requirements due to the proprietary nature of the waste receptacles, RECOMMENDATION Waive the City's bidding requirements pursuant to City Code Sections 1624 and 1625 and authorize staff to acquire 50 waste and recycling receptacles from Quick Crete Products Corporation. FISCAL IMPACT The cost of the trash and recycling units is $20,741.88. Adequate California Department of Conservation funds are available in the Public Works Operating Budget (01-401-6722) to acquire the trash receptacles. BACKGROUND The City has received a grant in the amount of $39,260 from the State of California Department of Conservation to implement a program to increase beverage container recovery rate and related educational programs. Staff will utilize the funds to install new trash and recycling containers at nine City parks and utilize the Orange County Conservation Corps to collect the recyclables and implement public education efforts. This State program will provide the City in future fiscal years approximately $19,000 a year for authorized initiatives. City Code Section 1624 b specifies certain permitted exceptions to competitive bidding requirements where bidding would be impossible, impractical, incongruous or where an emergency exists. Obtaining bids is impractical due to the unique design characteristics of the waste and recycling receptacles required to be utilized in a park setting. The desired receptacles are an all concrete design in which the top is also covered with concrete to protect waste and recyclables from the elements, thereby complying with NPDES requirements. They also must come in matched sets with one receptacle for trash and a second for recyclables in order to qualify for State funding. In accordance with Section 1625 e. (1) of the City Code regulating the purchases of patented or proprietary articles, staff contacted the only known manufacturers/vendors of enclosed and covered concrete trash and recycling containers; Quick Crete Products Corp. and San Diego Precast Concrete. While the trash receptacles are similar in form and function, they are aesthetically dissimilar. Staff prefers the Quick Crete design.
