HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES DIVISION ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE A NOTICE OF COMPLETION FOR THE HERITAGE PARK HOCKEY RINK RESURFACING PROJECT (CIP NO. 2054) SUMMARY The resurfacing of the Heritage Park hockey rink has been completed to the satisfaction of the Public Works Department and is ready for acceptance by the City Council. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 03-68 accepting the Heritage Park Hockey Rink Resurfacing Project (CIP No. 2054) and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Payment Bond not sooner than thirty five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than 3-years after the date of recordation of the Notice of Completion, and Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five (35) days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $1,696.00 to Malibu Pacific Tennis Courts, Inc. This amount together with the payment of $15,264.00 represents 100% of the final construction cost for the project. FISCAL IMPACT The final cost of the project is $16,960.00, which is included in the FY 2002~03 Capital Improvement Project budget for Major Park Maintenance (CIP No. 2054). Acceptance of Public Improvements and Authorization to File a Notice of Completion for the Heritage Park Hockey Rink Resurfacing Project (CIP No. 2054) May 5, 2003 Page 2 BACKGROUND The construction of the Heritage Park Hockey Rink Resurfacing Project was completed on March 31, 2003. The warranty on this project is set for three years with three years Faithful Performance Bond. The work has been completed to the satisfaction of the City Engineer and the project is now ready for City Council acceptance. Tim D. Serlet Director of Public Works/City Engineer TDS:WA:ccg:NOC Heritage Hockey Rink Resurface & Reso 03-68.doc Attachments Wisam Altowaiji Field Services Manager RESOLUTION NO. 03-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF A NOTICE OF COMPLETION FOR THE HERITAGE PARK HOCKEY RINK RESURFACING PROJECT (CIP NO. 2054) WHEREAS, Malibu Pacific Tennis Courts, Inc., having a contract with the City of Tustin to construct the hereinafter described public works improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements, hereinafter mentioned, in a manner satisfactory to the City Council of the City of Tustin, and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion and acceptance of said public works improvement should be filed; NOW THEREFORE, BE IT RESOLVED BY THE City Council of the City of Tustin that said public works improvement is found to be complete, and the same is hereby accepted. Said public works improvement is more particularly described as follows. HERITAGE PARK HOCKEY RiNK RESURFACiNG PROJECT (CIP No. 2054) AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works improvement described herein as required by law.
