PLEDGE OF "~ ALLEGIANCE Led by Councilman Sharp. III. INVOCATION Given by Councilman Welsh. IV. ROLL CALL Present: Councilmen: Langley, Edgar, Saltarelli, Sharp, Welsh. Absent: Councilmen: None. Others present: City Administrator Harry Gill City Attorney James Rourke Assistant City Administrator for Conununity Development Ken Fleagle City Clerk Ruth Poe V. PLANNING AGENCY MATTERS NONE. VI. PUBLIC HEARINGS NONE. VII. PUBLIC CONCERNS 1. SPEED ON WALNUT AND BROWNING Mrs. Jennie Cody, 14461 Silverbrook Drive, read and presented a petition to the Council containing signatures of 851 resi- dents from the Browning-Walnut area. The petition contained the following recommendations: a. Speed limit be reduced to 25 m.p.h. at intersections of Browning and Walnut. b. Replace speed limit signs on Browning between intersections of Mitchell and Walnut with elevated signs. c. Install stop signs on Walnut to slow traffic and allow safe,pedestrian crossing. d. Prohibit commercial vehicles from Walnut and Browning. e. Provide crossing guard at Walnut and Brown- ing intersection. Mrs. Cody advised Council that the recent accident on Walnut was the second such accident on this street and strongly urged them to take action. Councilman Saltarelli expressed his feelings that Council wa~ obligated to lower speed limit as this is what the people want. He felt that 25 m.p.h. encourages people behind to get irrational and try to go around. He felt reducing the speed limit to 30 m.p.h. was better. Hefelt there is a proper location for boulevard stops and requested the City Engineer give recommendations for stops on this street. Moved by Saltarelli, seconded by Welsh that the following actions be taken: City Council Minutes 4/1/74 Page 2 1. Speedlimiton Walnut be reduced to 30 m.p.h. 2. Stop signs and school crossing signals on Browning Avenue be raised immediately. 3. The City Engineer be directed to bring forth ~ at the next Council meeting recommendations for the best possible locations for boulevard stops. 4. If a crossing guard can be readily obtained that one be placed at Browning Avenue and request that the school district share in the cost of the cross- ing guard. Motion carried. Mr. Hayes, 14412 Sandbrook Drive, Tustin, expressed his feel- ings that it wouldbe Very simple to put a stop sign at Oxford and put the speed at 25 m.p.h. He felt that a stop sign on OXford would eliminate a lot of problems on speed. Councilman Saltarelli advised Council, in answer to M~. Hayes' comment, that it appears in discussions with Mr. Ledendecker that Oxford is the best location for a stop sign but it will take more study. Mr. Jim Kinder, 1941 Hampshire Road, Tustin, advised the Council that six months ago when Tustin started with the Irvine Industrial Complex, the citizens of that area brought this exact problem to Council's attention and they were told that the City Engineers are studying . They lost a child on Walnut Avenue and shortly after a bar was put up so children couldn't ride a bike out of Tustin Meadows. A stop sign was also put up at the end of the street. They have just lost another child and still have to fight Council to put up an additional sign. Ethelyn Wilson, 14461 Pinebrook Drive, Tustin, expressed her feelings that a stop sign or stop signs placed at Browning or Mitchell Street would be good for children crossing in this area. James Cody, 14461 Silverbrook, asked for a clarification of Councilman Saltarelli's motion for the benefit of petitioners in the audience. Councilman Saltarelli repeated the motion as follows: 1) Speed limit be reduced to 30 m.p.h. immediately, 2) raise signs on Browning Ayehue 3) direct City engineer to find a good location place for boulevard stops, 4)obtain services of crossing guards for Browning and Walnut. Mrs. Cod~ expressed her feelings that if the speed limit is changed to 25 m.p.h. and the stop signs are put in the large commercial trucks would not want to keep this speed and may find another route. Mayor Langley advised Mrs. Cody that Walnut was the only route for the commercial trucks going into the Laurelwood development. Mr. Fleagle answered Mrs. Cody's questions pertaining to MyfordRoad. The Santa Ana Freeway access is entirely within the City of Irvine at Myford Road, and not under the exclusive jurisdiction of the City of Tustin. However, the City of Tustin has stipulated that the Myford Road access must be improved prior to the issuance of building permits. The Irvine Company is now working with the City of Irvine to gain approval of the street permits. City Council Minutes 4/1/74 Page 3 Mayor Langley directed the City Administrator to send a letter to the Irvine Company, Industrial Complex, asking them to expedite their plans for Myford Road, requesting something be done now in response to the public demands. Fir. Kinder questioned why the approval of the final tract for Irvine couldn't just be taken off the agenda until the completion of Myford Road. He asked why the road completion couldn't be listed as a condition of approval. Mr. Howard Evans, 14471 Cloverbrook, expressed his opinion that the only thing that stopped traffic on First Street was stop signs and this would be the only thing that would be going to stop it on Walnut. Ann Lamb, questioned double lines on Walnut and expressed her feelings that bike trails would be better. Dwayne Wilson, 1962 Roanoke, President of the Tustin Meadows Community Association, asked the City Council to direct the Police Department to have more stringent surveillance and enforcement of speed limits. He also felt the double lines on Walnut, with the street as wide as it is, is very hazardous. Sam Brock, expressed his feelings that to save a child'S life the speed onWalnut should be changed to 25 m.p.h. Moved by Saltarelli, seconded by Welsh, that above motion be amended to show 25 m.p.h. Carried. Claudia Schmetzer, 14442 Oxford, questioned when the lines on Walnut were going to be sandblasted off as they show through and are a hazard. Gregg Kempton, 14451 ICloverbrook Drive, didn't feel that just lowering the speed limit would slow people down and he felt there should be installation of stop signs. He asked the Council what their resolution was on stop signs. Mayor Langley authorized approval to have a stop sign installed at Oxford if that is therecommendation of the Traffic Engineer. RECESS Mayor Langley declared a recess at 8:45 p.m. CALL TO ORDER Meeting reconvened at 8:55 p.m. VIII. CONSENT CALENDAR 1. APPROVAL OF MINUTES of March 18, 1974, meeting. 2. RATIFICATION OF DEMANDS in amount of $275,238.95. 3. DENIAL OF CLAIM OF DAVID PENMALLOW as recoTm~ended by the City Attorney. 4. DENIAL OF CLAIM OF DOREEN BELL as recon=eended by the City Attorney. 5. FINAL .MAP - TRACT 8574 - Southwesterly corner of San Juan and Browning. Adoption of Resolution No. 74-22 as recommended by the City Engineer. RESOLUTION NO. 74-22 A Resolution of the City Council of the City Of Tustin, California, APPROVING FINAL TRACT MAP NO. 8574. City Council Minutes 4/1/74 Page 4 Moved by Saltarelli, seconded by Sharp that all items on th~ Consent Calendar be approved. Carried unanimously. Council- man Welsh abstained from approval of the Minutes of March 18, 1974. IX. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 615 An. Ordinance of the City of Tustin, California, REPEALING ORDINANCE NO. 608 OF THE TUSTIN CITY CODE RELATIVE TO THE ASSUMPTION OF POWERS AND DUTIES OF THE PLANNING COMMISSION BY THE CITY COUNCIL. 2. ORDINANCE NO. 616 An Ordinance of the City of Tustin, California, AMENDING THE TUSTIN CITY CODE RELATIVE TO TRUCK ROUTES. 3. ORDINANCE NO. 617 An Ordinance of the City of Tustin, California, PROVIDING FOR THE USE OF POLICEMEN, FIREMEN, PARKING CONTROL OFFICERS OR CROSSING GUARDS AT SPECIAL EVENTS. 4. ORDINANCE NO. 618 An Ordinance of the City of Tustin, California, REZONING PROPERTY ON ZONE CHANGE APPLICATION-SPECIFIC PLAN NO. 5 FOR PALMWOOD GARDENS. (Irvine Boulevard - First Street) Moved by Saltarelli, seconded by Sharp, that Ordinances 615, 616, 617 and 618,have second reading by title only. Carried unanimously. The secretary read Ordinances 615,616, 617 and 618 by title. Moved by Saltarelli, seconded by Edgar, that Ordinances 615, 616, 617 and 618 be adopted. Carried. Ayes: Edgar, Saltarelli, Sharp, Welsh, Langley. Noes: none. Absent: none. X. ORDINANCES FOR INTRODUCTION NONE. XI. NEW BUSINESS NONE. XII. OLD BUSINESS NONE. XIII. OTHER BUSINESS 1. COUNCILMAN EDGAR'S CONCERNS In answer to Councilman Edgar's questions, Mr. Gill replied with the following information: a. Gasoline Tax money can be used for two purposes. 1. Construction of certain elements of the streets. 2. Maintenance of the streets. City Council Minutes 4/1/74 Page 5 Typically, street building of curbs, gutters, and con- struction Of this nature will use gasoline tax money. Drainage facilities can be constructed from gasoline taxes if related to a particular arterial street. The gasoline tax is somewhat restrictive in how money can be used. Most of the tax money has been used for maintenance in the past. b. The particular design of First is somewhat of an alter- nate from the written concepts of drainage release in the downtown area and causes some problems to E1 Camino. c. The Main and Bryan triangle is one that has somewhat stymied the Engineering Department in coming up with the best solution pending property development. There is something missing and there will be further study. d. The City of Tustin has overrun its budget on Pine Tree Park and $130,000 on Utt and Mitchell Park. The latest figures show Tustin will be short by approximately $27,000. Tustin will be $15,000 short of Park Bond money to complete the Utt and Mitchell Park. e. The Pacific Fire Rating Bureau is horribly understaffed, is behind schedule, and has not been able to give the City of Tustin a re-rating. It is an agency of private insurance companies that recommend fire rates to insur- ance companies as a guideline for assessing liability. 2. ADVISORY COMMITTEE - NOISE ELEMENT ! ~ Moved by Saltarelli, seconded by Sharp, that approval be given for appointing an ad hoc citizens' committee for the purpose of preparing a Noise Element of the General Plan. Carried. Mr. Gill recommended that the people shown in the report be contacted and that an announcement be made in the newspapers that the City of Tustin is looking for candidates for a com- mittee to serve as a citizens' ad hoc committee for noise. 3. PEDESTRIAN OVERCROSSINGS AT WALNUT AND RED HILL AVENUES Moved b~ Saltarelti, seconded by Sharp, that approval be given the commencement of Phase I of the Pedestrian Over- crossings on Walnut and Red Hill Avenues, the acceptance of E. L. Pearson and Associates as consultants, and Planning and Engineering proceed along the lines to satisfy environ- mental concerns on safety and aesthetic rec~uirements. Carried. Councilman Saltarelli suggested a copy of the report be sent to the Tustin Meadows Homeowners Association President so that the board would be informed of steps the City is taking. 4. POLICE DEPARTMENT - ILLEGAL ALIENS Councilman Saltarelli complimented the Police Department for the work they have done in the last two weeks regarding the illegal alien problem. 5. PINE TREE PARK Councilman Sharp expressed his feelings that the "no dogs allowed" signs in Pine Tree Park were extremely prominent. He requested an adjustment of the height of the signs. LOCAL AGENCY FORMATION COMMISSION Mayor Langley advised Council of a meeting of the City Selection Committee for the purpose of filling a vacancy On the Local Agency Formation Commission and a vacancy on the Airport Land Use Commission.
