SUBJECT: DESTRUCTION OF RECORDS - HUMAN RESOURCES DEPARTMENT
SUMMARY
With approval from the City Council and City Attorney, the City's Record
Retention/Disposition Schedule permits the destruction of records in accordance with
specific criteria. Files pertaining to a number of closed liability claims have been identified
as meeting the criteria for destruction.
RECOMMENDATION
Adopt Resolution"No. 16-06, authorizing the destruction of certain records in possession
of the Human Resources Department.
FISCAL IMPACT
The fiscal impact is minimal and limited to the cost of utilizing an authorized record
destruction company to properly destroy documents and provide a certificate of
destruction.
BACKGROUND AND DISCUSSION
City Council Resolution No. 01-91 serves as the City's formal Record
Retention/Disposition Schedule and outlines specific eligibility criteria for the destruction
of records. Liability claims filed against the City may be destroyed three (3) years after
the claim has been closed. The Human Resources Department has identified a number
of files that were closed (via settlement or via expiration of the statute of limitations) in
excess of three years ago and are currently occupying needed storage space.

RESOLUTION NO. 16-06
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, AUTHORIZING THE
DESTRUCTION OF CERTAIN CITY RECORDS IN
POSSESSION OF THE HUMAN RESOURCES
DEPARTMENT
WHEREAS, the City of Tustin's ("the City's) Record Retention/Disposition
Schedule, adopted by the City Council via Resolution No.01-91, authorizes the
destruction of certain City records upon approval of the City Council and consent of the
City Attorney; and
WHEREAS, the Director of Human Resources has requested authority to destroy
certain records in a time and manner consistent with the City's Record
Retention/Disposition Schedule; and
WHEREAS, the records listed in Exhibit A are occupying spaced needed by the
Human Resources Department and none of the listed records have sufficient value to
justify retention beyond that which is required; and
WHEREAS, the City Attorney has given written consent to the destruction of the
records listed in Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin does hereby resolve as follows:
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 19th day of January 2016.
