ENVIRONMENTAL: THIS PROJECT IS CATEGORICALLY EXEMPT PURSUANT TO SECTION 15303 (CLASS 3) OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA). Planning Commission Report January 26, 2016 CUP 2015-26 & DR 2015-21 Page 2 RECOMMENDATION: That the Planning Commission adopt Resolution No. 4308 approving Conditional Use Permit (CUP) 2015-26 and Design Review (DR) 2015-21 authorizing the conversion of an existing temporary modular building to a permanent structure located at St. Cecilia Church at 1301 Sycamore Avenue. APPROVAL AUTHORITY: The project site is within the Public and Institutional (P&I) Zoning District. Pursuant to Tustin City Code (TCC) Section 9245b, the proposed permanent structure requires the approval of a CUP. TCC Section 9291 authorizes the Planning Commission to review applications for conditional use permits. Design Review is required for site planning and design pursuant to TCC Section 9272a. BACKGROUND: Site and Surrounding Properties The property at 1301 Sycamore Avenue is located on the northerly side of Sycamore Avenue and surrounded by two-story single-family residential dwellings to the west, multiple -family residential dwellings to the north and east, and the A.G. Currie Middle School and Jeane Thorman Elementary School to the south across Sycamore Avenue. At the time of annexation, property improvements included the church building and two (2) school buildings. On August 25, 1975, the Planning Commission adopted Resolution No. 1462 (Attachment D) approving Use Permt 75-18 for the construction of a 7,664 square foot parish hall at St. Cecilia Church ("Church"). On December 13, 1993, the Planning Commission adopted Resolution No. 3211 (Attachment E) approving CUP 93- 031 for the temporary placement and use of a 2,490 square foot modular classroom building on the property until December 13, 2000. On January 10, 2005, the Planning Commission adopted Resolution No. 3935 (Attachment F) approving CUP 04-011 and DR 04-009 for the construction of a one-story, 5,950 square foot, free-standing office and meeting room and, as part of the approval, allowed the existing modular classroom building that was scheduled for removal to remain until January 10, 2007. On May 23, 2005, the Planning Commission adopted Resolution No. 3971 (Attachment G) modifying Condition 1.9 of Resolution No. 3935 to extend the use of the existing modular classroom building in conjunction with the new office and meeting room building until March 1, 2012. Permits for the proposed 5,950 square foot building were never applied for or issued and the entitlements for CUP 04-011 and DR 04-009 became null and void after twelve (12) months along with the extension for the use of the modular classroom building. On April 25, 2011, the Planning Commission adopted Resolution No. 4172 (Attachment H) to allow an additional four (4) year extension for the use of the existing modular classroom building until April 26, 2015. The modular classroom building remains on the property, and the applicant has requested approval for its conversion to a permanent structure. DISCUSSION: For over a decade, City staff has been working with the staff of St. Cecilia Church, regarding the associated deadlines and conditions for extensions related to the temporary modular classroom building (Attachment 1). On May 7, 2015, City staff met with the applicant and church staff members, to discuss the options available for the temporary modular classroom building. Two (2) options were discussed at this meeting. The first option was to maintain the modular classroom building and permit the structure as permanent. Under this option, the permanent modular classroom building will need to be structurally evaluated as a new structure and will require full site compliance with the current codes including a permanent foundation. A permanent foundation was not installed initially because the Church representatives stated that the modular classroom building would be a "temporary use" and would be removed within seven (7) years of approval of the temporary use, or by December 13, 2000. The building will need to be evaluated as a permanent building now and adhere to the required building, fire life safety, and disabled access standards. This option requires the approval of the requested CUP and DR entitlement application prior to building plan check and permitting. Planning Commission Report January 26, 2016 CUP 2015-26 & OR 2015-21 Page 4 The second option would have involved removing the modular building from the property, as was agreed to in 2000, 2007, and 2015. Church staff has identified the intent to construct a new building if the temporary modular classroom building were to be removed. Construction of a new building would also require the approval of a CUP and DR entitlement application prior to building plan check and permitting. In June of 2015, City staff indicated the expectation to receive an entitlement application or demolition permit application by July 22, 2015, pursuant to a timeline proposed by Church staff to either permit the modular classroom building as a permanent structure; construct a new building in place of the modular classroom building; or remove the modular classroom building from the site. Following additional correspondence with City staff, on September 14, 2015, Church staff submitted the application to convert the modular building to a permanent structure. Project Description The existing prefabricated modular classroom building is a single -story structure with the dimensions of forty-one and one-half (41.5) by sixty (60) feet and comprises 2,490 square feet. The building is approximately eleven (11) feet tall. As indicated in the background section of this report, this building was only approved as a temporary structure and use. The modular building is proposed to remain at its existing location forty (40) feet northeast of the church building and twenty (20) feet southeast of the parish hall. The building is a flat -roof rectilinear structure constructed of cream color synthetic siding that presents a rough trowel finish. The six (6) windows are bronze glass in an aluminum frame and the doors are brown within a bronze metal frame. A covered walkway exists over the sidewalk connected to the building on the southwesterly elevation. The covered walkway consists of wood support beams attached to a corrugated sheet metal cover. Planning Commission Report January 26, 2016 CUP 2015-26 & DR 2015-21 Page 6 Design Review The design of the existing modular building does not provide four-sided architecture and was not originally reviewed or approved as a permanent structure. During the review of the application for CUP 2015-26 and DR 2015-021, staff requested that the design of the modular building be enhanced to be more consistent with the City's design requirements for newly constructed buildings. However, the applicant has requested that the original design be allowed to remain without any substantive changes. To make a recommendation of approval for the conversion of the temporary modular building to a permanent structure, staff has included conditions of approval within draft Resolution No. 4308. Condition 2.1 requires the existing exposed mechanical equipment on the side of the building to be screened through the installation of additional landscaping and individual screening elements or a screen wall. Condition 2.2 requires that new landscaping be provided adjacent to the elevations of the building that face the northerly parking lot. This new landscaping would be required to be consistent with the existing landscaping that is adjacent to the entrance to the building. And Condition 2.3 requires that brick or brick veneer and columns be installed on the modular building to match the brick and columns that are found on the adjacent parish hall. The additional landscaping, screening of mechanical equipment, and design enhancements on the building's elevations would give the modular building a more permanent appearance and would be consistent with the design of the adjacent buildings. These design improvements/enhancements are minimal and such design considerations are required for other developments throughout the City. Further, the approval of the design of the building without the conditioned improvements/ enhancements could set a precedent for other projects citywide. If it is the desire of the Planning Commission to not require the enhancements to the existing design of the building and adjacent landscaping, proposed Conditions 2.1, 2.2, and/or 2.3 may be modified or removed, provided that the required findings for the DR approval can be made to show that the proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole when taking into consideration factors such as exterior material and colors, landscaping, the appearance of exterior equipment, and compatibility of the structure with existing structures. The issue of precedent setting would also need to be addressed. Planning Commission Report January 26, 2016 CUP 2015-26 & DR 2015-21 Page 7 Parking In accordance with prior approvals for the site, the total required number of parking spaces for St. Cecilia Church is based on the most intensive use on the site, which is the sanctuary with 632 seats. Pursuant to TCC Section 9263g, one (1) parking space is required for every three (3) seats in a place of assembly. Therefore, a total of 211 parking spaces are required to be provided on-site. The proposed conversion of the existing temporary modular building to a permanent structure does not trigger a requirement for additional on-site parking, because when church services take place, the building would be used for ancillary purposes only, such as the Children's Liturgy. FINDINGS: In determining whether to approve the CUP and DR for the proposed conversion of the existing temporary modular building to a permanent structure, the Planning Commission must determine whether or not the proposed use will be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be ,injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City; and that the location, size, architectural features, and general appearance of the proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. A decision to approve this request may be supported by the following findings: 1. The proposal is consistent with the Public and Institutional Zoning District standards in that religious assembly requires a conditional use permit and the development standards are determined through the conditional. use permit and design review process by the plans approved by the Planning Commission. The uses are appropriate under the General Pian Land Use Element Public/institutional designation in that the Church functions as a quasi -public use. 2. The site maintains all legal non -conforming rights (establishment of the Church and school occurred without a CUP prior to annexation) and is consistent with prior conditions of approval for the parish hall under CUP 75-18. While additional square footage is being proposed, no new uses are being added to the site in that a church and school currently exist on the property. 3. Parking for the proposed use can be accommodated on-site, as the required number of parking spaces has been provided based on the most intensive use, which is the sanctuary with 632 seats. 4. With the implementation of conditions related to compatible architectural features, landscaping, and equipment screening, the architectural design, features, and color palette are consistent with the other buildings on the site. In addition, the scale and massing of building are consistent with the other buildings on the site. Ptanning Commission Report January 26, 2016 CUP 2015-26 & DR 2015-21 Page 8 5. The conditioned design improvements are minimal and would have been incorporated with the structure in 1994„ if the structure had been proposed as °permanent." Such design considerations are required for other permanent buildings throughout the City, and the approval of the design of the building without the conditioned improvements could set a precedent for other projects citywide. The ,Planning Commission finds and determines as follows: A. That a proper application for Conditional Use Permit 2011-03 was filed by St. Cecilia Church requesting to extend the use a 2,490 square foot modular classroom building for an additional (4) years or until April 26, .2015 at St. Cecilia Church located at 1301 Sycamore Avenue. B. The proposed project is consistent with the policies of the General Plan "Public/institutional" designation which allows schools and churches. In addition, the project has been reviewed for consistency with the Air Quality Sub -element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub -element. C. That a public hearing was duly called, noticed, and held for said application on April 26, 2011, by the Planning Commission. D. That the modular classroom building would be temporary and the applicant would be required to post a bond to ensure removal by April 26, 2015. E. The modular classroom building originally intended to be used temporarily has remained in its location for the past seventeen (17) years and use as a permanent building resulting in unintended impacts to overall parking/traffic demand. No specific parkingltraffic analysis was conducted and impacts have not been mitigated due to the nature of its original intent to use the structure for temporary measure. F. On December 13, 1993, the Planning Commission adopted Resolution No. 3211 approving CUP 93-031 for the temporary placement and use of a 2,490 square foot modular classroom building on the property until December 13, 2000. G. On January 10, 2005, the Planning Commission adopted Resolution No. 3935 approving CUP 04-011 and DR 04-009 for the construction of a one- story, 5,950 square foot, free-standing office and meeting room and, as part of the approval, allowed the existing modular classroom building that was scheduled for removal to remain until January 10, 2007. On May 23, 2005, the Planning Commission adopted Resolution No. 3971 modifying Condition 1.9 of Resolution No. 3935 to extend the use of the existing modular classroom building in conjunction with the new office and meeting room building until March 1, 2012. Permits for the proposed 5,950 square foot building were never applied for or issued and the entitlements for CUP 04-011 and DR 04-009 became null and void after twelve (12) months along with the extension for the use of the modular classroom building. The easterly driveway along Sycamore Avenue which is used to access the facility is in a state of disrepair and will need to be removed and replaced by the applicant prior to August 1, 2011. This improvement was required in 2004 and has not been installed. J. This project is Categorically Exempt pursuant to Section 15303, CIass 3 of the California Code of Regulations (Guidelines for the California Environmental Quality Act II. Instructions for filing a development application form were provided to Reverend AI Baca and Jim Marshall of St. Cecilia Church in the City's letter dated June 10, 2016. Unfortunately, the City cannot accept your application as provided' since it does not include the required submittal items for a conditional use permit and design review application. Additional required submittal items include, but are not limited to application fees, plans, a .prellminary title report, and public noticing package. Multiple subsequent approvals have allowed the continued use of the temporary modular classroom building until April 26, 2015. As noted in your letter, City staff met with members 'of your staff on May 7, 2015, to discuss the options available for the ,temporary modular classroom building. As discussed, there are two options available. The first option would involve maintaining the modular classroom building and permitting it as a permanent structure. The permanent modular classroom building will need to be structurally evaluated as a new structure and will require full site compliance -with the current codes including a permanent foundation. This, was not installed initially because the Church stated that the modular classroom building would be a "temporary use" and would be removed in seven (7) years of approval, by December 13, 2000. Since this is no longer the case, the building needs to be evaluated as a permanent building now and adhere to the required building and fire life safety standards. This option will require approval of a conditional use permit and design review entitlement application prior to building plan check and permitting. The second option involves removing the modular building from the property. This option will require approval of a demolition permit. In your letter, you identified the intent to construct a new building if the temporary modular classroom building were to be removed. Construction of a new building would also require approval of a conditional use permit and design review entitlement application prior to building plan check and permitting. Given the circumstances of the parish in changing. Pastor's next month, the proposed timeline identified within' your letter is acceptable to the City. The City will expect to receive an entitlement application or demolition permit application by July 22, 2015,- per your timeline to either permit the modular classroom building as a permanent structure; construct a new building in place of the modular classroom building; or remove the modular classroom building from the site. The Planning Commission of the City of Tustin does hereby resolve as follows: The Planning Commission finds and determines as follows: A. That a proper application for Conditional Use Permit (CUP) 2015-26 and Design Review (DR) 2015-21 was filed by Jim Marshall on behalf of St. Cecilia Church requesting authorization to convert an existing 2,490 square foot temporary modular building to a permanent structure at St. Cecilia Church located at 1301 Sycamore Avenue. B. That the proposed project is consistent with the policies of the General Plan "Public/institutional" designation which allows schools and churches. In addition, the project has been reviewed for consistency with the Air Quality Sub -element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub -element. C. That a public hearing was duly called, noticed, and held for said application on January 26, 2016, by the Planning Commission. D. That on December 13, 1993, the Planning Commission adopted Resolution No. 3211 approving CUP 93-031 for the temporary placement and use of a 2,490 square foot modular classroom building on the property until December 13, 2000. E. That on January 10, 2005, the Planning Commission adopted Resolution No. 3935 approving CUP 04-011 and DR 04-009 for the construction of a one-story, 5,950 square foot, free-standing office and meeting room and, as part of the approval, allowed the existing modular classroom building that was scheduled for removal to remain until January 10, 2007. F. That on May 23, 2005, the Planning Commission adopted Resolution No. 3971 modifying Condition 1.9 of Resolution No. 3935 to extend the use of the existing modular classroom building in conjunction with the new office and meeting room building until March 1, 2012. Permits for the proposed 5,950 square foot building were never applied for or issued and the entitlements for CUP 04-011 and DR 04-009 became null and void after twelve (12) months along with the extension for the use of the modular classroom building. That on April 25, 2011, the Planning Commission adopted Resolution No. 4172 to allow an additional four (4) year extension for the use of the existing modular classroom building until April 26, 2015. H. That the establishment, maintenance, and operation of the proposed use will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin in that: a. The proposal is consistent with the Public and Institutional Zoning District standards in that religious assembly requires a conditional use permit and the development standards are determined through the conditional use permit and design review process by the plans approved by the Planning Commission. The uses are appropriate under the General Plan Land Use Element Public/institutional designation in that the Church functions as a quasi -public use. b. The site maintains all legal non -conforming rights (establishment of the Church and school occurred without a CUP prior to annexation) and is consistent with prior conditions of approval for the parish hall under CUP 75-18. While additional square footage is being proposed, no new uses are being added to the site in that a church and school currently exist on the property. c. Parking for the proposed use can be accommodated on-site, as the required number of parking spaces has been provided based on the most intensive use, which is the sanctuary with 632 seats. I. That the location, size, and general appearance of the proposed project, as conditioned, is compatible with the surrounding area in that the scale and massing of the proposed building is consistent with the other buildings on the site. With the implementation of conditions related to compatible architectural features, landscaping, and equipment screening, the architectural design, features, and color palette are consistent with the other buildings on the site. J. That the conditioned design improvements are minimal and would have been incorporated with the structure in 1994, if the structure had been proposed as "permanent." Such design considerations are required for other permanent buildings throughout the City, and the approval of the design of the building without the conditioned improvements could set a precedent for other projects citywide. In making such findings, the Planning Commission has considered at least the following items: 1. Height, bulk, and area of proposed structure. 2. Setbacks and site planning. 3. Exterior material and colors. 4. Type and pitch of roofs. 5. Size and spacing of windows, doors and other openings. 6. Towers and roof structures. 7. Landscaping, parking area design and traffic circulation. 8. Location, height and standards of exterior illumination. 9. Location and appearance of equipment located outside of an enclosed structure. 10. Location and method of refuse storage. 11. Physical relationship of proposed structure to existing structures. 12. (1) 1.6 The applicant shall be responsible for costs associated with any necessary code enforcement action, including attorney fees, subject to the applicable notice, hearing, and appeal process as established by the City Council by ordinance. The Community Development Director shall review the use to ascertain compliance with conditions of approval. If the use is not operated in accordance Conditional Use Permit 2015-26 and Design Review 2015-021, or is found to be a nuisance or negative impacts are affecting the surrounding businesses or neighborhood, the Community Development Director shall impose additional conditions to eliminate the nuisance or negative impacts, or may initiate proceedings to revoke the Conditional Use Permit. (1) 1.8 As a condition of approval of Conditional Use Permit 2015-26 and Design Review 2015-021, the applicant and property owner shall agree, at its sole cost and expense, to defend, indemnify, and hold harmless the City, its officers, employees, agents, and consultants, from any claim, action, or proceeding brought by a third party against the City, its officers, agents, and employees, which seeks to attack, set aside, challenge, void, or annul an approval of the City Council, the Planning Commission, or any other decision-making body, including staff, concerning this project. The City agrees to promptly notify the applicant and property owner of any such claim or action filed against the City and to fully cooperate in the defense of any such action. The City may, at its sole cost and expense, elect to participate in defense of any such action under this condition. DESIGN REVIEW (4) 2.1 The existing mechanical equipment on the building shall be screened, subject to approval by the Director of Community Development. The screening may consist of individual screening elements or a screen "wall" and landscaping to adequately screen the equipment from view. If a screen "wall' is proposed, gates may be placed at both ends between the screen "wall" and the existing modular building. (4) 2.2 New landscaping shall be provided adjacent to the two elevations of the building that face the parking lot. The new landscaping shall be consistent with the existing shrubs adjacent to the entrance of the existing modular building. (4) 2.3 Brick (or brick veneer) and columns that match the existing brick and columns on the adjacent parish hall shall be incorporated on the building, subject to the approval of the Director of Community Development. The matching brick (or brick veneer) and columns shall be proposed on all elevations, except the elevation where the mechanical equipment is located. The brick (or brick veneer) and columns shall extend from ground level to the roof, similar to the adjacent parish hall. Exhibit A - Resolution No. 4308 CUP 2015-26 and DR 2015-21 Page 3 PLAN SUBMITTAL (***] 3.1 The scope of work is to convert the temporary building, comprised of three connected modular units, to a permanent structure for meeting and classroom uses. A building permit shall be applied for and professionally prepared drawings, calculations and specifications shall be submitted to show what construction is needed to meet the requirements of the current (2013) building codes as adopted by the City of Tustin. (1) 3.2 The permanent structure shall be made to comply with the CA Building Code, Electrical Code, Mechanical Code, Plumbing Code, Energy Code, Fire Code, Green Building Standards and other applicable codes. (***) 3.3 Prior to use and within .30 days of the CUP/DR approval date, construction documents shall be submitted to the Building Division for plan check, and construction shall be completed with a certificate of occupancy issued within 120 days of the permit issuance date. PUBLIC WORKS DEPARTMENT (1) 4.1 Prior to issuance of a permit, the applicant shall provide written approval from the Orange County Sanitation District (OCSD) or East Orange County Water District (EOCWD) to make permanent use of the existing modular building. (1) 4.2 Construction and Demolition Waste Recycling and Reduction Plan (WRRP). a. The applicant/contractor is required to submit a WRRP to the Public Works Department. The WRRP must indicate how the applicant will comply with the City's requirement (City Code Section 4351, et al) to recycle at least 50% of the project waste material or the amount required by the California Green Building Standards Code. b. The applicant will be required to submit a $50.00 application fee and a cash security deposit. Based on the review of the submitted Waste Management Plan, the cash security deposit shall be in the amount of five (5) percent of the project's valuation as determined by the Building Official, rounded to the nearest thousand, or $2,500, whichever is greater. In no event shall a deposit exceed $25,000. C. Prior to issuance of a permit, the applicant shall submit the required security deposit in the form of cash, cashier's check, Exhibit A - Resolution No. 4308 CUP 2015-26 and DR 2015-21 Page 4 personal check, or money order made payable to the "City of Tustin." FEES (1) 5.1 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of fifty dollars ($50.00) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period the applicant has not delivered. to the Community Development Department the above -noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. (1) 5.2 Prior to the issuance of any building permits, payment shall be made for all applicable fees, including -but not limited to, those listed below. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. A. Building plan check and permit fees to the Community Development Department. B. Orange County Fire Authority plan check and inspection fees to the Community Development Department. C. Any applicable sewer and water connection fees to OCSD and EOCWD. D. New development tax to the Community Development Department based upon the most current schedule. E. School facilities fees to Tustin Unified School District based upon the most current schedule. Proof of payment shall be provided to the Community Development Department prior to issuance of building permits. F. Major Thoroughfare and Bridge fees to the Public Works Department. With proof of exemption from the payment of property taxes, the project is exempt from the payment of Major Thoroughfare and Bridge fees.
