PLEDGE OF ALLEGIANCE Led by Councilman Welsh. III. INVOCATION Given by Councilman Saltarelli. IV. ROLL CALL Present: Councilmen: C. Miller, Saltarelli, Langley, Welsh. Absent: Councilmen: None. CHAPTER 27 PROJECT 72-6 CONSTRUCTION OF CURB AND GUTTER, SIDEWALK AND PAVEMENT ON WILLIAMS STREET. Mayor Miller announced that this was the time and place fixed for the hearing of objections or protests to the construction of certain improvements pursuant tO Chapter 27 of the "Improvement Act of 1911u in -- the locations set forth in City Council motion of July 17, 1972r and asked the secretar~v if due notice of the'hearing had been given.' The secretary stated that Notices to Construct Miss- ing Improvements, said Notices setting forth a time and place for hearing thereon, were duly and regularly posted a~d delivered, all as prescribed by lawf and affidavits showing such compliance are on file in the City Clerk's office. In reply to the Mayor, the secretary stated that the City Clerk had received two written protests, and read these protests to the Council. Mayor Miller opened the public portion of the hearing at 7:44 p.m. Mr. Herbert Zarember, Williams Street, one of the writ- ers of letter of protest, reiterated his feelings advis- ing that if these improvements were made, the orange trees in front of his property would have to be removed, taking away the seclusion of his property from the street. He feels that the asphalt "lip" would more than suffice. Mr. Alfred ~erratot 15600 Williams.Street# also reit- erated his feelings as stated in his letter of protest~ There being no further co~mments or objections, Mayor Miller closed public portion of hearing at 7:57 p.m. It was the concensus of Council and Staff that there is a serious situation existing for the school children in this area, and that this would be the best solution to the problem. 9/5/72 Page 2 Moved by Welsh, seconded by Saltar'elli, that ~11 appeals, p_~otests, and objections be overruled and denied. Carried unanimously. RESOLUTION NO. 72-58 A Resolution of the City Council of the City of Tustin, California, ordering the Superintendent of streets to proceed with the construction of mission improvements under the provision of Chapter 27 of the Improvement Act of 1911 (Project 72-6). As directed, the secretary read Resolution by title only. Moved by Langley, seconded by Welsh that further reading 5e waived, and that Resolution No. 72-58 be oassed and adopted. Carried unanimously. REALIGNMENT OF YORBA AND PACIFIC STREETS AT FIRST STREET Mayor Miller opened the public portion of the hearing at 8:10 p.m. Gr~dy HenrZ, President of the Chamber of Commerce, asked if the City has a complete street plan. The speeding up of traffic at First, Pacific and Yorba would be good, but it would add to the traffic at Pacific and Main. Does the City have any plans for the control of traffic there? He also stated that he would not like to see the removal of Tustin Carpets from this location. Lee Wagner does not feel that this realignment would do The downtown business any good, and that more people in the County area. will still continue to use our streets with more traffic. Fred Voss of Tustin Carpets, stated that they pay from ~15,000 to $18,000 in taxes every year. They have 8 employee~ who will have to be terminated if the building is removed. When asked if they have any intentions of relocating in Tustin, he replied that there is nothing available, Phil Siegel, President of Consolidated Reproductions, advised that he felt even with the widening of First Street there will be a traffic problem due to the fact that there would be more vehicles, and the visibility would be worse. Bill Moses, Tustin News, stated that he did not like to see the City putting a firm out of business, for the sake of smoother traffic flow. Gene Mittman, 1777 Mitchell, sales representative for Consolidated Reproductions, stated he is in favor of thi~ realignment. Harold Wray, said that he had just bought a duplex on ~acific, and is in favor of more traffic on Pacific and better access to First and to Yorba Street. Harold Adams, 240 Pacific, objected to the proposed in- -tersection and was wondering why just signals could not be put in. Council Minutes 9/5/72 Page 3 Sal Delg~do, 13351 White Sands, objected to this realign- ment, and stated he felt thaE the City should preserve ~he business on this property. The consensus of the Council was 'that they would like to see Tustin Carpets stay at this location and possibly have 3ust a stop sign or signal to control the traffic flow. Moved by Welsh seconded by Langley~ that the realignt~ t of Yorba and Pacific Streets at First Street be dis-" approved. Carried 3-1o~ Ayes: .Miller, Langley, Welsh. Noes: ~altaretli. VI. CONSENT CALENDAR 1. APPROVAL OF MINUTES - August 21~ 1972 meeting. 2 APPROVAL OF DEMANDS in the amount of $123,521.60 3. RIGHT-QF-WAY EASEMENT DEEDS AND AGREEMENTS, FIRST STREET AHFP PROJECT NO. 604~ PHASE I. Acceptance as recommended by the City Engineer. 4. STREET IMPROVEMENTS ON IRVINE BOULEVARD FROM YORBA TO PROSPECT AVENUE. Project I Pavement reconstruction - Yorba to "B" Project II - Center Medians "B" to Prospect Acceptance as recommended by the City Engineer. 5. PARKING LOT PAVING AND SITE GRADING AT FIRE STATI~ NO. 2. Acceptance of work as recommended by the City Engineer. Moved by Welsh, seconded b~ Sa!tarelli that Items 1-5 of the Consent Calendar be a~proved. Carried unanimously VII. ORDINANCES FOR ADOPTION None VIII. ORDINANCES FOR INTRODUCTION I. ORDINANCE NO. 550 An Ordinance of the City Council of the City of Tustin, California, ADOPTING A SPECIAL SPEED ZONE. (Adopts a 25 mph zone on 1st Street from Newport to Red Hill) Moved by Lanqtey, seconded by Welsh that Ordinance No. 550 have first reading by title only. Carrmed unanim~ ~!' REBOLUTION NO. 72-60 A Resolution of the City Council of the City of Tustin, California, MAKING FINDINGS ON PETITION AND WAIVER, AND ORDERING THE CITY ENGINEER TO PROCEED WITH THE STEPS NECESSARY FOR THE FORMATION OF ASSESSMENT DISTRICT #2. (River Ford Rdo at Orange County Flood Control Bridge) Council Minutes 9/5/72 Page 4 Mo~ed by Langley, seconded by Welsh, that Resolution No. 72-60 be read by title only. The secretary read Resolution No. 72-60 by title. Moved by Welsh, seconded by Sattarelli, that Resolution No. 72-60 be passed and adopted. Carried unanimously. X. OLD BUSINESS 1. DELETION OF FIRST STREET (NEWPORT TO RED HILL) FROM THE MASTER PLAN OF ARTERIAL HIGHWAYS. Grad~ Henry.stated his objection to the closing of First Street, and said he was wondering if the stop signs have decreased the traffiC. Sal Delgado advised that the impression is that the traffic has decreased, but this is only because of the traffic being slower. Walter Leist, 1292 E. First Street, deplored the stop signs that have been put on First Street and felt that they have created more of a 'problem with screeching of brakes, etc. This should be a through street, with the stop signs removed. RESOLUTION NO. 72-59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN REQUESTING THAT THE COUNTY OF ORANGE DELETE FIRST STREET FROM NEWPORT AVENUE TO RED HILL AVENUE FROM THE MASTER PLAN OF ARTERIAL HIGHWAYS. Moved by Sattaretli, seconded by Langley, that Resolu- tion NO. 72-59 be read by title only. The secretary read the resolution by title. Moved by ~angley, seconded by Sattarelli, that R~solu- tion No..72-59 be passed and adopted. Carried unani- mously. Moved by LangleV, seconded by Saltarelli, that the letter to Lo C. McConville, Road Commissioner and County Surve}~or, relative to this matter, be appr~ved as submitted. Carried unanimously. XI. NEW BUSINESS None XII OTHER BUSINESS 1. Water Service to the Irvine Ranch Area East of Browning Mr. Gill referred to the City Council a report of the Ection taken by the IRWD which denied the request than Tustin Water Works provide water service to those sub- divisions within the Incorporated limits of the City o~ Tustin. The Council expressed th2ir disappointment in the IRWD's action. They felt hhat the long-ran~ consequences were most severe and the Council. would be subjected to future citizen pressure due to unequal charges for service. ~ Council Minutes 9/5/72 Page 5 Mr. Rourke advised that the alternatives ~ft to the Council were few~ short of drastic actions such as denying the right to develop there. The Fire Depart- menE indicates that it ls necessary to have a closed loop system and interconnect, which would probably require the cooperation of the Tustin Water Works. Moved by Welsh, seconded by Saltaretli, to direct Staff to ..compose a letter to IRWD, CC: ~o Tustin Water ~ ~mgn_~d by all Councilmen, expressing ~he Council~s co cern and reqlaestmng reconsideration of the matter. Carried unanimously. 2. COUNCIL APPROVAL OF EXPENDITURES (CHECKS) Mr. Gill advised Council that the California Government Code provides that cities incorporated under the general laws. of the State are required to submit all bills (checks) to the City Council for approval prior to pay- ment. However, Section 37208 of the Goverr~.ent Code, provides that cities with annual budgets adopted by ordinance or resolution may pay bills from authorized appropriations prior to specific Council approval of the expenditures. Expenditures are then submitted to Coun- cil for ratification. With payments not restricted to Council meeting dates, a city may process its accounts payable on a schedule that coincides with vendors' re- quirements, discounts, and a more even workload on the City staff. ~gve~ by Langley, seconded by Saltarelli,.~for approval of ratifying budgeted expenditures, rather than approv- !~g checks before actual expenditures are made. Carrfed unanimously. 3. PUBLIC CONSENT ON AGENDA Mr. Welsh stated that he would like to see the Public Comment on the Agenda directly after Public Hearings on a trial basis. 4. CURBING ON FIRST STREET Mrs. Margaret Byrd asked if curbs on First Street, near the corners of A St., B St., etc., could be painted red so that people would have better view of traffic as they attempt to get on to First Street. Mr. Gill ad- vised that this could be done. 5. DPC COMMISSION CONCERNS Frank Greinke stated his concern over the charge of $10 to hear a tape from the DPC, advising that as this is for public use, there should be no charge. The Council requested Mr. Gill to look into this for a possible solution, however, Mr. Gill advised that this was a Council policy which was put into effect several years ago. Y~. Greinke also expressed his concern over the fact that the business community is not represented at all on the DPC Commission. ~ayor Miller advised Mr. Greinke that the Council was looking i~{%~ the enLire system, as presented by Mr. Fleagle and would be making a decision shortly as to their findings. Council Minutes 9/5/72 Page 6 It was moved by Saltarelli, seconded by Welsh, that Frank Greinke be appointed to the Developmenu Preview Commission as member-at-large, William Reed be named to fill the Architect positionr and Bud Jackley b__e_ terminated. Car~ed unanimously. Mr. Reed's term will expire in September, 1974 as well as Mr. Greinke's. 6. LAMBERT SCHOOL CONCERN Mrs. Helga Nelson of the Lambert School Safety Committ- ee, expressed her concern over the traffic situation at Orange and San Juan Streets. As this area is in the County, the Council directed Staff to send letter to Supervisor Clark regarding the crossing and speed limit on Orange and San Juan. 7. FIRST STREET AND WHITE SANDS Jill Nisker requested that the Council check on having a crossing ~uard at the corner of First and White Sands. She stated that there are about 55 children under the age of 12 crossing there, and feels a guard is necessary 8. ARCHITECT FOR PARK SITE Mayor Miller asked Staff to check with the architects as respects their previous work, and the meeting of the time frame and budgets before a selection is made. 9. COUNCIL VACANCY L_ee Wagner questioned as to how long the council seat would be vacant if there were to be an election, and was advised that it would be about 3 1/2 months. She felt that the seat should be filled prior to the first of the year. XIII.
