SUBJECT: LOSSAN CORRIDOR GRADE CROSSING IMPROVEMENTS AT RED HILL AVENUE
RECOMMENDATION
That the Tustin City Council approve Program Supplement No. 010to
Local Agency -State Agreement for Federal -Aid Projects No. 12-5271
for the upgrading of warning and control devices for the Red Hill
Avenue crossing of the A.T. & S.F. Railway (LOSSAN Corridor) and
authorize the Mayor to execute said agreement. It is also
recommended that the amount of $1,005.00 be included in the 1991-92
Capital Improvement Program Budget for said project.
BACKGROUND
The LOSSAN Corridor extends from Los Angeles to San Diego along the
_ Atchison, Topeka and Santa Fe (A.T. & S.F.) Railway right-of-way
and intersects with Red Hill Avenue approximately 300 feet
northerly of Edinger Avenue. As a part of the upgrading of this
corridor, the A.T. & S.F. Railway has applied for federal funding
to upgrade nineteen at -grade street crossings within Orange County
with the installation of warning devices and control devices.
A.T.& S.F. has received approval of same from the State of
California, Department of Transportation, who is acting as the
agent for the Federal Department of Transportation.
The project cost is being funded under the 1973 Federal Highway Act
Funds for crossing warning devices on streets and county roads and
is proposed to be shared as follows:
Federal Share 90%
Local Agency Share 10%
DISCUSSION
As previously mentioned, the State of California is acting as an
agency for the disbursement of Federal funds and has submitted the
attached Program Supplement No. 010 to the Master Local Agency -
State Agreement for Federal -Aid Projects No. 12-5271 which was
originally executed on October 15, 1979. This Program Supplement
provides for the upgrading of warning and control devices at the
Red Hill Avenue crossing of the A.T.& S.F. Railway facilities
(LOSSAN Corridor).
All improvements of this project will be installed by A.T. & S.F.
Railway forces and are estimated to cost $10,041.00 with cost
sharing as follows:
Federal Share $9,036.00
City of Tustin Share $1,005.00
The attached Program Supplement No. 010 provides for the above
mentioned cost obligations and will require the City to budget the
amount of $1,005.00 in the 1991-92 Capital Improvement Program
Budget.

Ls Program Supplement is hereby incorporated into the Local Agency -State
,,�reement for Federal Aid which was entered into between the Local Agency
and the State on 10/15/79 and is subject to all the terms and conditions
thereof. This Program Supplement is adopted in accordance with Paragraph 3
of Article I of the aforementioned Master Agreement under authority of
Resolution No. approved by the Local Agency on
(See copy attached).
The Local Agency further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with the covenants or
remarks setforth on the following pages.

1. The cost of maintenance of the crossing shall be as allocated by
Public Utilities Commission.
2. All required pavement marking and advance warning signs shall
comform to the requirements of MUTCD, 1988 and shall be placed in
their proper location by the Local Agency at the time of
completion of the Railroad's work. -
3. The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway
Administration in the Federal -Aid Project Agreement (PR-2)/Detail
Estimate, or its modification (PR -2A) or the FNM -76, and accepts
any increases in Local Agency Funds as shown on the Finance or
Bid Letter or its modification as prepared by the Division of
Local Streets and Roads.
4. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal -Aid Program.
