HUSTON, CITY MANAGER FROM: OFFICE OF THE CITY CLERK S U BJFGT: RETENTION OF TAPES FOR CITY COUNCIL/COMMISSION MEETINGS RECOMMENDATION: Adopt Resolution No. 91-83 amending Council Policy No. 00-2 relative to retention of tapes. BACKGROUND: Current policy (attached Resolution No. 73-66) allows for the destruction of tape recordings of City Council and Planning Commission meetings after a two-year period. However, State law provides for destruction of tape recordings of meetings after two years only if those recordings were made solely for the preparation of Minutes. Minutes of meetings of the City Council, Planning Commission and each other City board or commission must be retained and may not be destroyed. Tape recordings of these meetings are not made solely for the preparation of Minutes and, therefore, must be retained indefinitely. c Valerie Whiteman Chief Deputy City Clerk Royleen A. The City Council of the City of Tustin, California, does resolve as follows: 1. That Section 3.A. of Council Policy No. 00-2 is hereby amended to read as follows: 3.A. Tape recordings of meetings of the City Council, Planning Commission and' each other board or commission made solely for the purpose of facilitating the preparation of Minutes of the meeting shall be retained for a period of two (2 ) years after any non -continued action on any matter included on the recording. All other tape recordings of such meetings shall be retained indefinitely. PASSED AND APPROVED by the City Council of the City of Tustin at a regular meeting held on the day of , 1991. MARY E.
