SEISMIC RETROFIT PROGRAM.

In response to the requirements of State Senate Bill 547, on
February 19, 1991 the City of Tustin adopted Ordinance No. 1059
that created an earthquake hazard mitigation program for existing
unreinforced masonry buildings. A survey revealed that eight
buildings, all in the downtown area, may require remedial
construction to comply with the minimum earthquake -resisting design
standards.
The effected buildings and the property owners are listed in
Exhibit A. Buildings 2, 3 and 8 were identified as Class -I,
potentially very high hazard rating, while the other five buildings
are in Class -II, potentially high hazard category.
The administrative provisions of the ordinance require that the
Building Official notify each owner with an order to comply with
the provisions of the codified ordinance. •Class -I building owners
must be notified within 180 days of the effective date of the
ordinance, or August 19, 1991. Class -II building owners must be
notified within 2 years, or February 19, 1993. To date, no orders
have been sent.
Once the orders have been sent, however, each owner has 270 days to
respond with:
a) a structural analysis that demonstrates the building complies
with the design standards, or
b) a structural analysis and construction documents for
structural alteration that will bring the building into
compliance, or

C) plans for vacation or demolition of the building (demolition
must f irst be approved by the Director of Community
Development) .
A fourth alternative, due within 120 days of the order,is to
temporarily strengthen the building by installing wall anchors.
This alternative requires that the installation of wall anchors
must be followed up by one of the other three actions within one
year.
If the construction upgrade alternate (b) is chosen, building
permits must be obtained within one year of the order service date
and construction completed within three years of the permit
issuance date.
For example, a Class -II building owner may not be sent the order to
comply until February 19, 1992. The owner would then have until
November 19, 1993 to have the structural analysis completed and
approved. Building permits must be obtained by February 19, 1997.
If, in addition, the owner takes advantage of installing wall
anchors by May 19, 1993, the construction completion date would be
extended to February 19, 1998.
To date, the owners of building #4, Philip and Linda Cox, and of
building 12, the Tustin Pythian Building Association, have
submitted construction plans for the seismic rehabilitation of
their properties. In fact, the Cox' s have completed their retrofit
construction and are making plans to return to their home in Myers
Flat, California. They are to be commended for their immediate
attention to this issue and the enthusiastic spirit in which it was
undertaken. The Pythians are currently in the plan check stage,
and are making corrections to their first review.
Some other owners have expressed a desire to delay the start of
their projects for financial or various other personal reasons.
One property owner, Mr. and Mrs. Martin Perf it, may not be easy to
contact as they have refused correspondence and other communication
regarding other ongoing issues regarding this property.
Through its Commercial Rehabilitation Fund, the Community
Development Block Grant Program has made limited monies available
to assist these owners with either structural design or
construction.of their property. Applications have been received
and approved for three property owners (Zamora, Lindquist and the
Pythians) however funds have not yet been dispersed.

The Council at their meeting of February 19th also authorized staff
to offer owners participation in an assessment district or Mello -
Roos Community Facilities Act District to finance seismic retrofit.
A letter of interest to owners is currently being reviewed by the
City Attorney's office to go out to owners shortly. The letter
will help determine if there is significant enough interest to make
such a bond issue feasible.
