HomeMy WebLinkAbout00 AGENDA 07-01-91AGENDA CITY COUNCIL REGULAR MEETING CITY OF TUSTIN JULY 11 1991 - 7:00 P.M. The City Council meets the first and third Monday of each month at 7:00 p.m. in the City Council Chamber at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use in the Council Chamber during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chamber; however, if you desire to smoke, an outside speaker has been provided. WORKSHOP - The City Council has scheduled a Budget Workshop and review of Tustin Ranch development project (Lots 2 and 3) at 5:30 p.m. in the Council Chamber. ROLL CALL IV. PROCLAMATION - PARKS AND RECREATION MONTH V. PUBLIC HEARINGS 1. PRELIMINARY DRAFT OF CITY OF TUSTIN SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT The City has prepared a draft Source Reduction and Recycling Element (SRRE) in accordance with the requirements established by the enactment of Assembly Bill 939. In addition to the SRRE required by AB 939, a Household Hazardous Waste Element is also required. Recommendation: Open the Public Hearing and request testimony and comments from the public regarding the Preliminary Draft of the Source Reduction and Recycling Element and the Household Hazardous Waste Element as recommended by the Community Development Department. EMINENT DOI 'HEARING - ACQUISITION OF iL PROPERTY (ASSESSORIS PARCEL NO.'-__1-582-02/PERFIT PROPERTY) Acquisition of a parcel of land on the easterly, side of Prospect Avenue between Main Street and Third Street for the purpose of expanding the Tustin Water Services Plant currently located at 235 East Main Street. Recommendation: After the receipt of testimony and the closure of the hearing and if the City Council determines the Perfit property is to be acquired by eminent domain proceedings, adopt the following Resolution No. 91-90 (a minimum four-fifths (4/5) vote is required) as recommended by the Public Works Department/Water Services Division: RESOLUTION NO. 91-90 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY AND THE EXPENDING OF FUNDS THEREFOR IN THE INSTITUTION OF EMINENT DOMAIN PROCEEDINGS (ASSESSOR'S PARCEL NO. 401-582-02/PERFIT PROPERTY) VI. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - JUNE 17, 1991 REGULAR MEETING Recommendation: Approve the City Council Minutes of June 17, 1991. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,972,238.35 and ratify Payroll in the amount of $288,810.72. 3. REJECTION OF CLAIM NO. 91-25 - CLAIMANTS, MARTIN BALDERA AND MARIA LEDEZMA; DATE OF LOSS, 5/5/91; DATE FILED WITH CITY, 5/30/91 Recommendation: Reject subject claim for general damages in the amount of $100,000.00 as recommended by the City Attorney. 4. ACCEPTANCE OF PUBLIC IMPROVEMENTS - PARCEL MAP NO. 90-104 Recommendation: Accept the public improvements within Parcel Map No. 90-104 and authorize the release of the following subdivision public improvement bonds: Faithful Performance Bond No. 204754S - $130,000.00; Labor and Materials Bond No. CITY COUNCIL AGENDA PAGE 2 JULY 1, 1991 204754S 565,000.00; and Monument )n Bond No. 204756S - $2,320.0u as recommended by the i-olic Works Department/ Engineering Division. 5. ANNUAL AGREEMENT TO PROVIDE SPECIAL DISTRICT ADMINISTRATIVE CONSULTING AND RELATED SERVICES Recommendation: Authorize the City Manager to execute an agreement with Muni Financial Services, Inc. to provide administrative services and consulting for the City of Tustin Special Assessment Districts as recommended by the Finance Department. 6. RESOLUTION NO. 91-94 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITY TREASURER/ FINANCE DIRECTOR TO INVEST MONIES WITH THE COUNTY OF ORANGE TREASURER'S COMMINGLED INVESTMENT POOL Recommendation: Adopt Resolution No. 91-94 authorizing the Finance Director/City Treasurer to deposit surplus City funds in the Orange County Treasurer's Commingled Investment Pool as recommended by the Finance Department. 7. REJECTION OF CLAIM NO. 91-26 - CLAIMANT, VICTORIA STEPHENSON; DATE OF LOSS, 5/23/91; DATE FILED WITH CITY, 6/3/91 Recommendation: Reject subject claim for personal injury damages in the amount of $850.56 as recommended by the City Attorney. REJECTION OF CLAIM NO. 91-23 - CLAIMANT, GENE STEWART; DATE OF LOSS, 5/9/91; DATE FILED WITH CITY, 5/15/91 Recommendation: Reject subject claim for property damage in the amount of $570.24 as recommended by the City Attorney. 9. STREET SWEEPING PARKING PROHIBITORS Recommendation: Approve change to the hours of parking restriction from 9:00 a.m. to 1:00 p.m. to 8:00 a.m. to 12:00 p.m., change of designated days of sweeping for certain streets to accommodate the schedule as prepared by Arroyo Seco Associates, Inc., and for all future citizen requests for parking prohibitions to conform to street sweeping schedules as recommended by the Public Works Department/Field Services Division. 10. RESOLUTION NO. 91-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR MAGNOLIA TREE PARK PLAY STRUCTURES Recommendation: Accept the public improvements installed by Miracle Recreation Equipment Company at Magnolia Tree Park by adopting Resolution No. 91-93 and authorizing the City Clerk to record the Notice of Completion as recommended by the Community Services Department. 11. ADVERTISEMENT FOR BIDS, FRONTIER PARK PLAY STRUCTURES Recommendation: Approve specifications for construction of play equipment at Frontier Park and direct the City Clerk to advertise for bids as recommended by the Parks and Recreation Commission and the Community Services Department. AUTHORIZATION TO ADVERTISE FOR BIDS FOR REPLACEMENT OF PLAY EQUIPMENT AT CENTENNIAL PARR Recommendation: Approve specifications for replacement of play equipment at Centennial Park and direct the City Clerk to advertise for bids as recommended by the Parks and Recreation Commission and the Community Services Department. 14. REJECTION OF CLAIM NO. 91-27 - CLAIMANT, KENNETH LORITZ; DATE OF LOSS, 12/14/90; DATE FILED WITH CITY, 6/5/91 Recommendation: Reject subject claim for property and personal injury damages in the amount of $80,400.00 as recommended by the City Attorney. 15. REJECTION OF CLAIM NO. 91-28 - CLAIMANT, STEVE BELLOISE; DATE OF LOSS, 3/17/91; DATE FILED WITH CITY, 6/6/91 Recommendation: Reject subject claim for personal injury damages of an undetermined amount as recommended by the City Attorney. VIII. ORDINANCES FOR INTRODUCTION - None IX. ORDINANCE FOR ADOPTION 1. ORDINANCE NO. 1074 - COUNCIL COMPENSATION The following Ordinance No. 1074 had first reading by title only and introduction at the June 17, 1991 City Council meeting: ORDINANCE NO. 1074 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATIVE TO COUNCIL COMPENSATION Recommendation: Have second reading by title only and adoption of Ordinance No. 1074 (roll call vote). CITY OF IRVINE BUS STOP SHELTERS At the City Council meeting of June 3, 1991, Councilmember Prescott requested a staff report regarding the bus stop shelters being located within the right-of-way in the City of Irvine. Recommendation: Pleasure of the City Council. 2. REQUEST FOR CURB AND GUTTER INSTALLATION - CALIFORNIA STREET Mr. George Santori appeared at the June 17, 1991, City Council meeting and presented a petition from four property owners CITY COUNCIL AGENDA PAGE 4 JULY 11 1991 requesting ! installation of curbs ar utters on both sides of California ,creet between Main Street and Third Street. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - JUNE 24, 1991 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of June 24, 1991. 2. CITIZEN CONCERN - FIRE HYDRANT PAINTING At a previous City Council meeting, Mr. Dick Yaberg raised a concern regarding the painting of fire hydrants throughout the service area of the Tustin Water System. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 3. WATER CONSERVATION PROGRAM STATUS REPORT Update report to the City Council on the status of the Water Conservation Program. Recommendation: Receive and file subject report as recommended by the Finance Department. 4. INVESTMENT SCHEDULE AS OF MAY 31, 1991 Investment schedule with maturities, 12 months or less.
