SUBJECT: ADVERTISEMENT FOR BIDS, FRONTIER PARK PLAY STRUCTURES

That the City Council, at the July 1, 1991 Meeting approve
specifications for construction of play equipment at Frontier Park,
and direct the City Clerk to advertise for bids as recommended by
the Parks and Recreation Commission and the Community Services
Department staff.
BACKGROUND:
The Playground Renovation Project is currently underway at Frontier
Park. The project was set up to remove deteriorated play
structures -with replacement to be accomplished over the next five
years. Because the contract price for the renovations was below
the initial estimates, replacement structures can be funded through
the budget allocation for this project. It is expected that
$13,000 will be available for play equipment replacement. The
project designer has prepared the attached sketches which locate
the proposed play apparatus within the new playground.
The playground will feature:
-Pipe wall with wheel
-Tunnel slide
-Curve slide
-Climbing platforms
-Chain ladder
-Steps
-Fire pole
-Chinning bar A
-Tick-tac-toe panel
-Talk tube
-Double poly slide
The design was developed by the renovation project designer from
Cardoza Dillalo Harrington and has been reviewed by the Parks and
Recreation Commission. These structures are part of a playground
structures master plan now being developed by the project designer.

After the contract is awarded, a period of six to eight weeks is
necessary for delivery of the equipment. Bids will be solicited
from all qualified vendors. This project is being bid at the same
time -as the play equiment replacement at Centennial Park to
possibly get a better price. The plans proposed fall within the
$13,000 budgeted remaining for this portion of the project.

CITY OF TUSTIN, CALIFORNIA
NOTICE INVITING BIDS FOR PLAY EQUIPMENT
SEALED PROPOSALS will be received at the office of the
Tustin City Hall, 15222 Del Amo, Tustin, California 92680
a.m. on August 6, 1991 at which time they will be publicly
read, for performing work as follows:

Specifications and proposal forms to be used for bidding on this project
can only be obtained by prospective bidders at the office of the City
Clerk, Tustin City Hall, 15222 Del Amo, Tustin, California 92680, or
will be mailed out at no charge.
In conformance with Section 37931 of the Government Code, all bids shall
be presented under sealed cover on the proposal form provided and
accompanied by bidder's security in the form of cash, cashier's check,
certified check or bid bond executed by an accredited surety. The
security shall be for an amount not less than 10% of the amount of the
bid. A bid shall not be considered unless one of the forms of bidder's
security is enclosed therewith.
A Faithful Performance Bond in the amount of 100% and a labor and
materials Bond in the amount of 100% in the form attached to the
contract documents shall be provided. Said bonds shall be issued by a
surety company rated grade A or better and Class IV or better by the
latest edition of Best's Key Rating Guide.
The City of Tustin hereby affirmatively ensures that minority business
enterprises will be afforded full opportunity to submit bids in response
to this notice and will not be discriminated against on the basis of
race, color, national origin, ancestry, sex, or religion in any
consideration leading to the award of contract.
The City of Tustin reserves the right to reject any or all bids, and/or
to waive any informality on a bid. No bidder may withdraw his bid for
a period of thirty ( 30 ) days after the date set for the opening thereof.
Prior to bid opening, bidder may withdraw his bid. Bids received after
the bid opening time and date herein will be returned to bidder
unopened.
Pursuant to the California Public Contract Code, the contractor will be
entitled to post approved securities with the City or an approved
financial institution in order to have the City release funds retained
by the City to insure performance of the contract.
Prior to contract award, the successful bidder shall posses a valid
State of California contractor's license in the classification of A.
For all projects not subject to Section 10164 of the Public contracts
Code of the State of California ( federally funded state projects) ,
bidders must comply with Section 7028.15 of the Business and Professions
Code of the State of California which provides that all bidders subject
to the section must state on their bid the number of their contractors's
license, the date of expiration of their contractor's license, and a
statement that the representations made in their bid are made under
penalty of perjury.
The City Council of the City of Tustin has obtained from the Director of
Industrial Relations the general prevailing rate of per diem wages and
the general prevailing rate for legal holiday and overtime work in the
locality in which the work is to be performed for each craft or type of
work needed and a copy of the same is on file in the office of the City
Engineer. Not less than said prevailing rates shall be paid to workers
employed on this public works contract as required by Labor Code
Sections 1771 and 1774 of the State of California.
