HUSTON, CITY MANAGER COMMUNITY SERVICES DEPARTMENT SUBJECT: AUTHORIZATION TO ADVERTISE FOR BIDS FOR REPLACEMENT OF PLAY EQUIPMENT AT CENTENNIAL PARK RECOMMENDATION: That the City Council, at the July 1, 1991 meeting approve specifications for replacement of play equipment at Centennial Park and direct the City Clerk to advertise for bids as recommended by the Parks and Recreation Commission and the Community Services staff. BACKGROUND: In the 1990/91 Capital Improvement Budget, $12,000 was appropriated to replace play equipment at Centennial Park. This project will replace outdated equipment at the park including the dome climber, and swing rings. The design of the new equipment was developed with input from the Tustin Meadows Homeowners Association, and the Tustin Meadows Tiny Tot Program staff and parents. The new equipment is designed to complement other improvements recently made to Centennial Park Play Equipment. The design includes an 11 foot cyclone slide, a spider climber, climbing pole, a hand ring bridge, several ladders, a twister slide, and a cargo net climber. The tentative timetable for this project is: Council Authorizes Advertisements for Bids First Legal Advertisement Second Legal Advertisement Open Bids Award Bids Installation 7/1/91 7/11/91 7/18/91 8/6/91 8/19/91 10/28/91 The cost estimate for this equipment layout and installation is $11,977.14. Generally delivery and installation takes six to eight weeks. Staff is requesting bids for play equipment at Frontier Park simultaneously to get a better price as suggested by the council. Susan M. White, Director of Community and Administrative Services Attachments: Notice Inviting Bids Diagram of Equipment SECTION A CITY OF TUSTIN, CALIFORNIA NOTICE INVITING BIDS FOR PLAY EQUIPMENT SEALED PROPOSALS will be received at the office of the Tustin City Hall, 15222 Del Amo, Tustin, California 92680 a.m. on August 6, 1991 at which time they will be publicly read, for performing work as follows: Centennial Park Play Structures City Clerk, until 10:00 opened and Specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tustin City Hall, 15222 Del Amo, Tustin, California 92680, or will be mailed out at no charge. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by bidder's security in the form of cash, cashier's check, certified check or bid bond executed by an accredited surety. The security shall be for an amount not less than 10% of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Faithful Performance Bond in the amount of 100% and a labor and materials Bond in the amount of 100% in the form attached to the contract documents shall be provided. Said bonds shall be issued by a surety company rated grade A or better and Class IV or better by the latest edition of Best's Key Rating Guide. The City of Tustin hereby affirmatively ensures that minority business enterprises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, sex, or religion in any consideration leading to the award of contract. The City of Tustin reserves the right to reject any or all bids, and/or to waive any informality on a bid. No bidder may withdraw his bid for a period of thirty ( 30 ) days after the date set for the opening thereof. Prior to bid opening, bidder may withdraw his bid. Bids received after the bid opening time and date herein will be returned to bidder unopened. Pursuant to the California Public Contract Code, the contractor will be entitled to post approved securities with the City or an approved financial institution in order to have the City release funds retained by the City to insure performance of the contract. Prior to contract award, the successful bidder shall posses a valid State of California contractor's license in the classification of A. For all projects not subject to Section 10164 of the, Public contracts Code of the State of California (federally funded state projects), bidders must comply with Section 7028.15 of the Business and Professions Code of the State of California which provides that all bidders subject to the section must state on their bid the number of their contractors's license, the date of expiration of their contractor's license, and a statement that the representations made in their bid are made under penalty of perjury. The City Council of the City of Tustin has obtained from the Director of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which the work is to be performed for each craft or type of work needed and a copy of the same is on file in the office of the City Engineer. Not less than said prevailing rates shall be paid to workers employed on this public works contract as required by Labor Code Sections 1771 and 1774 of the State of California.
