MANAGEMENT AND DESIGN SERVICES FOR THE CORPORATE YARD AND
EMERGENCY OPERATIONS CENTER PROJECT
SUMMARY
In 2012, Griffin Structures, Inc. worked with Public Works staff to analyze the current and future
needs of the City's Corporate Yard. The result of this effort was a comprehensive needs
assessment. Based on the information collected during that exercise, Griffin Structures, Inc. was
tasked with developing and presenting conceptual plans to the City. A concept has been selected
and it is now necessary to enter into an agreement for project management and design services.
RECOMMENDATION
It is recommended that the City Council authorize staff to enter into a Consultant Services
Agreement with Griffin Structures, Inc. for project management and design services for the
Corporate Yard and Emergency Operation Center Project.
FISCAL IMPACT
Sufficient funds have been budgeted and appropriated in the Fiscal Year 2015/16 Capital
Improvement Program budget utilizing General Fund and Water Capital to cover project
management and design services. The fee for these services is not -to -exceed $805,040, and is
comprised of $132,840 for project management for Griffin Structures, Inc. and $672,200 for
architectural services for LPA, Inc. A separate supplemental budget of $37,000 will be supported
for reimbursable expenses typically covering costs for reproduction, plotting, mailing, possible
renderings, presentations, flythrough and 3D graphics.
CORRELATION TO THE STRATEGIC PLAN
The completion of this project contributes to the fulfillment of the City's Strategic Plan Goal B: Public
Safety and Protection of Assets. Specifically, this project addresses Strategy 2(c), which is to
create a new emergency operations center.
BACKGROUND AND DISCUSSION
Staff has completed a number of significant steps in moving the Corporate Yard project forward.
Building off our facility needs assessment that was completed by Griffin Structures, Inc. in January
2013, several iterations of conceptual layout options have been evaluated and vetted. The site
constraints of this project are a challenge. The existing layout of the corporate yard is not efficient,
due in part to the somewhat irregular shape, and also to the evolution of site occupancy. The
overall width of the site, in combination with the fixed vehicle maintenance and warehouse
buildings, has presented considerable challenges with fleet and heavy equipment/material storage,
circulation and access. The relocation of Fire Station 37 to Tustin Legacy and the utilization of

available public right-of-way along the Red Hill frontage provide much needed room to expand the
yard facilities and repurpose these areas.
The preferred option proposes a site configuration that maximizes a new building footprint
combining both field service operations and water services personnel under one roof. Water
services personnel have been operating out of temporary facilities for over 15 years. The new
administration facility will be designed to Essential Services Building Code requirements, meaning
constructed to higher electrical and structural standards (1.5X structural code) and will contain a
dedicated Emergency Operations Center (EOC), water quality lab, dedicated and secure water
supervisory control and data acquisition (SCADA) center with full backup power for the entire
building, including the existing vehicle maintenance shop and fuel island. Photovoltaic (solar) will
be included for the new facility and canopy structures to offset nearly 100% of the electrical
demand. The proposed building will be designed to LEED standards with building materials
selected to reduce long-term operation and maintenance costs. Additionally, a demonstration
garden is included in the design plans to promote the use of sustainable and drought tolerate
planting materials for Tustin residents.
Experience has shown that the most successful projects involve integrating project/construction
managers with the design team at the beginning of the project to ensure lessons learned from
design and construction experience are applied very early on in the process. Based on the
successful approach of combining project management and design services for both the Tustin
Library and Fire Station 37 projects, the team of Griffin Structures, Inc. and LPA, Inc. was selected
for the Corporate Yard and Emergency Operations Center project.
Design and construction of these specific facilities are highly specialized fields, and Griffin
Structures and LPA bring more than eight decades of project management, construction
management, and design expertise, particularly in the area of maintenance and administration
buildings. Relevant projects range from the $12M Westminster Corporate Yard, to $8M Stanton
Corporate Yard, or to the $5M Walnut Creek Corporate Yard Consolidation. Additionally, more
complicated projects, with an emergency operation center and designed/built to essential service
standards, include the $38M Buena Park Police Headquarters, $31M Hesperia Civic Center, and
$26M Burbank Police, Fire and Public Safety Operations. Furthermore, this team also recently
provided project management and design services for the upgrades of our Police Briefing
Room/EOC. This team understands the distinct challenges in managing the design and
construction of important government facilities and the intricacies of the City's unique site.
Deliverables for this stage in the project's development will provide:
• Design Development Documents
• Design Development Cost Report
• Project Critical Path Master Schedule
• Construction Documents
• ConstructabilityNalue Engineering Review Report
• Pre -Bid Cost Estimate
The proposed Consultant Services Agreement between the City and Griffin Structures, Inc. is
attached. It provides for comprehensive project management and design services, including related
sub -consultant services for architectural design services, structural engineering, mechanical
engineering, electrical and lighting, landscape architecture, civil engineering, preparation of
specifications and cost estimating. The personnel identified in the consultant's proposal are senior
individuals with many years of experience in their respective roles. All sub -consulting, activities
identified in the Agreement will be administered by Griffin Structures in accordance with the budget

amounts and tasks identified. It is estimated that the schedule for completion of design services will
take approximately 12 months, concluding with a bid -ready design package. Staff expects Griffin
Structures, Inc. to act as the project management team through the end of construction for this
project. Once bids for construction are received, the CSA with Griffin Structures, Inc. will be
amended.
The proposal does contain an option for LEED Certification. LEED is the benchmark for green
design issued by the U.S. Green Building Council and stands for "Leadership in Energy and
Environmental Design." Although the new facility will be designed to this benchmark, an additional
$50,000 would be required to process the project through the Green Building Council certification.
Staff has elected not to include this process unless directed by Council. Essentially that process is
a documentation and submittal of the design effort to quantify and qualify LEED certification per the
criteria.
Staff is recommending the City Council authorize staff to enter into a Consultant Services
Agreement with Griffin Structures, Inc. for project management and design services for the
Corporate Yard and Emergency Operation Center Project.

Consultant Services Agreement
CONSULTANT SERVICES AGREEMENT
THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into
this _ day of 20_, by and between the CITY OF TUSTIN, a municipal
corporation, hereafter referred to as "City", and Griffin Structures, Inc., a California
Corporation, hereinafter referred to as "Consultant".
RECITALS
WHEREAS, City requires the services of an expert consultant to furnish the
necessary personal services for the Project Management and Design Services for the
Corporate Yard and Emergency Operation Center Project, hereinafter referred to as
"Project"; and
WHEREAS, in response to City's request, Consultant has submitted to City a
proposal dated January 13, 2016, a copy of which is attached hereto marked as Exhibit
"A" and is by this reference incorporated into this Agreement; and
WHEREAS, based on experience and reputation, Consultant and its' team are
qualified to provide the necessary services and have agreed to provide such services;
and
WHEREAS, City desires to retain the services of Consultant for said Project.
NOW, THEREFORE, for the consideration and upon the terms and conditions
hereinafter set forth, the parties agree as follows:
AGREEMENT
Section 1: Scope of Consultant's Services
1.1 Scope of Services. Consultant shall perform all work necessary to
complete in a manner satisfactory to City, the services set forth in Exhibit
"A" in accordance with the terms and conditions of this Agreement.
1.2 Compliance with Law. All services rendered hereunder shall be provided in
accordance with all laws, ordinances, resolutions, statutes, rules, and

regulations of the City of Tustin and of any federal, state or local
governmental agency of competent jurisdiction.
1.3 Licenses and Permits. Consultant shall obtain at its sole cost and expense
such licenses, permits and approvals as may be required by law for the
performance of the services required by this Agreement.
1.4 Care of Work. Consultant shall adopt and follow reasonable procedures
and methods during the term of the Agreement to prevent loss or damage
to materials, papers, or other components of the work, and shall be
responsible for all such damages until acceptance of the work by City,
except such loss or damages as may be caused by City's own negligence.
1.5 Representative of Consultant. The following Principal of the Consultant is
hereby designated as being the principal and representative of Consultant
authorized to act in its behalf with respect to the work specified herein and
make all decisions in connection therewith: Roger Torriero. It is expressly
understood that the experience, knowledge, capability and reputation of the
foregoing Principal is a substantial inducement for City to enter into this
Agreement. Therefore, the foregoing Principal shall be responsible during
the term of this Agreement for directing all activities of Consultant and
devoting sufficient time to personally supervise the services hereunder.
The foregoing Principal may not be changed by Consultant without the
express written consent of City.
1.6 Changes. In the event any changes or changes in the work is requested by
City, the parties hereto shall execute an addendum to this Agreement,
setting forth with particularity all terms of such addendum, including, but not
limited to, any additional Consultant's fees.
Section 2: Order of Precedence
In the event of a conflict between or among any of the documents comprising this
Agreement, the following order of precedence shall govern the provision in question:

Section 3: Time for Completion
Time is of the essence in the performance of this Agreement. The time for
completion of the work to be performed by Consultant is an essential condition of this
Agreement. Consultant shall prosecute regularly and diligently the work of this
Agreement according to reasonable schedules established by the City for various items

described and as outlined within Consultant's proposal. Consultant shall not be
accountable for delays in the progress of its work caused by any condition beyond its
control and without the fault or negligence of Consultant. Delays shall not entitle the
Consultant to any additional compensation regardless of the party responsible for the
delays.
Section 4: Compensation
A. The compensation to be paid under this Agreement shall be as set forth in Exhibit
"A", which shall not -exceed a total cost of $805,040.00 and $37,000 for approved
reimbursable expenses.
B. Consultant shall submit detailed invoices, based upon the actual work performed
accompanied by backup documentation as requested by the City.
C. Progress payments for work completed shall be paid by City as the work
progresses, within thirty (30) days of the date of Consultant's invoice.
D. Consultant shall provide City with a monthly itemization of all work performed, and
the fees accrued thereon, in complete and sufficient detail to fully apprise City
thereof.
Section 5: Independent Contractor
Consultant's relationship to City in the performance of this Agreement is that of an
independent contractor. Consultant's personnel performing services under this
Agreement shall at all times be under Consultant's exclusive direction and control and
shall be employees of Consultant and not employees of City. Consultant shall pay all
wages, salaries and other amounts due its employees in connection with this Agreement
and shall be responsible for all reports and obligations respecting them, such as social
security, income tax withholding, unemployment compensation, worker's compensation
and similar matters.
Section 6: Indemnification
Consultant agrees to indemnify, defend and hold City, its officers, agents,
employees, successors and assigns harmless from any loss, damage, injury, sickness,
death, or other claim made by any person and from all costs, expenses and charges
including attorney's fees caused by or arising out of Consultant's, its officers', agents',
subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or
willful misconduct, or conduct for which the law imposes strict liability on Consultant in the
performance or failure to perform this Agreement.

Section 7: Insurance
A. Consultant shall maintain in full force and effect during the term of this Agreement
policies of commercial general liability and automobile liability insurance (each of
which shall include property damage and bodily injury) and each with limits of at
least $1,000,000 combined single limit coverage per occurrence.
B. Consultant shall maintain in full force and effect during the term of this Agreement
a policy of professional liability insurance coverage with limits of at least
$1,000,000 combined single limit coverage per claim or per occurrence. If
Consultant provides claims made professional liability insurance, Consultant shall
also agree in writing either (1) to purchase tail insurance in the amount required by
this Agreement or to cover claims made within five (5) years of the completion of
Consultant's service under this Agreement, or (2) to maintain professional liability
insurance coverage with the same carrier, or with an equivalent carrier in the
amount required by this Agreement for at least five (5) years after completion of
Consultant's services under this Agreement. Consultant shall also provide
evidence to the City of the purchase of the required tail insurance or continuation
of the professional liability policy by executing the attached Letter Agreement on
Consultant's letterhead.
C. Consultant shall carry and pay for such workers' compensation insurance as is
required to fully protect Consultant and its employees under California Worker's
Compensation Insurance Law. The insurance company shall agree to waive all
rights of subrogation against the City for losses paid under the policy, which losses
arose from the work performed by the named insured.
D. Other applicable insurance requirements are: (1) Name the City, its officials and
employees as additional insured on the commercial general liability and
automobile liability insurance policies. (2) The insurance shall be issued by a
company authorized by the Insurance Department of the State of California and
rated A, VII (seven) or better (if an admitted carrier) or A-, X (ten) or better (if
offered by a surplus line broker), by the latest edition of Best's Key Rating Guide,
except that the City will accept workers' compensation insurance rated B-, VII
(seven) or better, or from the State Compensation fund. (3) The insurance shall
not be cancelled, except after thirty (30) days written prior notice to the City; and
(4) The commercial general liability and automobile liability insurance shall each
be primary as respects the City, and any other insurance maintained by the City
shall be in excess of this insurance and not contribute to it.
E. Upon execution of this Agreement, Consultant shall provide to City certificates of
insurance and insurer endorsements evidencing the required insurance. Insurer
endorsements (or a copy of the policy binder if applicable) shall be provided as
evidence of meeting the requirements of Subsections (1)(3) and (4) of Section 7D
above and the waiver of subrogation requirement in Section 7C above. If self -

insured for worker's compensation, Consultant shall submit to City a copy of its
certification of self-insurance issued by the Department of Industrial Relations.
Section 8: Termination of Agreement
A. City and Consultant shall each have the right to terminate any or all of the services
covered by this Agreement at any time or any reason by giving ten (10) business
days written advance notice to the other party.
B. Upon termination of this Agreement, Consultant shall be paid for services
rendered by the effective date of the termination.
C. Upon termination of this Agreement or completion of the Project, all documents
relating to the Project shall become the sole property of City. Should City
terminate this Agreement pursuant to subparagraph A. of this Section, Consultant
shall within ten (10) business days of receipt of notice of termination, provide City
with all documents within Consultant's possession relating to this Agreement and
the Project, including but not limited to all completed documents and all drafts of
uncompleted documents.
Section 9: Notice
Any notice allowed or required to be given shall be effective upon personal
delivery thereof, or upon depositing thereof in the United States Postal Service, certified
mail, upon receipt requested, postage prepaid, addressed as follows:

Section 10: Miscellaneous Provisions
A. Consultant shall proceed immediately and diligently to perform the services
provided for in this Agreement upon receipt of notice from City to proceed
therewith.

B. Information obtained by Consultant is performance of this Agreement shall be
treated as strictly confidential and shall not be used by Consultant for any purpose
other than the performance of this Agreement without written consent of the City.
C. No part of this Agreement may be assigned by Consultant without the prior written
approval of City.
D. This Agreement shall extend to and be binding upon and inure to the benefit of
heirs, executors, administrators, successors and assigns of the respective parties
hereto.
E. Consultant shall perform all services required under this Agreement using that
degree of care and skill ordinarily exercised under similar conditions in similar
localities, and shall be responsible for all errors and omissions for services
performed by Consultant under the terms of this Agreement.
F. Consultant certifies that there shall be no discrimination against any employee
who is employed in the work covered by this Agreement, or against any
application of such employment, because of race, religion, color, sex, or national
origin including but not limited to, the following: employment, upgrading, demotion
or transfer, recruitment, or recruitment advertising, lay-off or termination, rate of
pay or other forms of compensation, and selection for training, including
apprenticeship.
G. All drawings, specifications, reports, records, documents and other materials
prepared by Consultant in the performance of this Agreement shall be the property
of City. Consultant may retain copies of such documents for its own use.
Consultant shall have an unrestricted right to use the concepts embodied therein.
H. This Agreement shall be interpreted in accordance with California Law. The
parties agree that the Orange County Superior Court is the exclusive venue for
any lawsuits by either party regarding this Agreement.
I. This Agreement may be amended at any time by the mutual consent of the parties
by an instrument in writing.
J. In the event that any one or more of the phrases, sentences, clauses, paragraphs,
or sections contained in this Agreement shall be declared invalid or unenforceable
by valid judgment or decree of a court of competent jurisdiction, such invalidity or
unenforceability shall not affect any of the remaining phrases, sentences, clauses,
paragraphs, or sections of this Agreement, which shall be interpreted to carry out
the intent of the parties hereunder.

Dear Mr. Stack,
The city of Tustin is positioned to further develop its maintenance facility infrastructure through design and construction of the Corporate Yard
project. Design and construction of these specific facilities are highly specialized fields, and Griffin Structures, Inc. (Griffin) and LPA, Inc. (LPA)
bring more than five decades of project management, construction management, and design expertise, particulary in the area of maintenance
and administration buildings. Relevant projects range from the $12M Westminster Corporate Yard, to $8M Stanton Corporate Yard, or to the
$5M Walnut Creek Corporate Yard Consolidation. Griffin also has experience working in and with the city of Tustin in its project and construction
management of the OCFA Fire Station No 37, the Tustin Library, and the Tustin EOC renovation projects. Our Team understands the distinct
challenges in managing the design and construction of important government facilities and the intricacies with each unqiue site.
With the importance of this project, Roger Torriero will serve as principal -in -charge throughout the course of this project at NO CHARGE to the
City. His background in project management, construction, and architecture over his 40+ career will serve as a critical resource for the team.
As Project Executive and day-to-day contact, Jon Hughes will bring his design management and construction management experience from the
many critical service facilities he has managed through his 25 year career. As we get closer to construction, our Construction Manager, Justin
Dirico will be staffed on this project working hand-in-hand with Jon Hughes. Justin is currently completing several projects for the City and has an
excellent understanding of the City's process and expectation of service. Jay Helekar will serve as project cost estimator contributing his 20 years
of estimating experience to the team. Resumes and proposed project team members include Griffin's Director of Operations, Gary Chubb, serving
as a strategic resource for the Project. Gary's 25 years of project and construction management includes his working experience with the City and
successful completion of the Tustin Library. Dustin Alamo, Griffin's Vice President of Strategic Services, is also included as a strategic resource for
this Project as he managed the project through the end of Schematic Design and will be vital to our team to ensure information is properly relayed.
In summary, the Griffin team is well qualified and immediately available to perform design and project / construction management services
required for delivery of the Tustin Corporate Yard project. The Griffin team combines the resources, knowledge, and proven abilities to ensure
timely and on -budget delivery for an exceptional facility that will benefit the community for years to come.

Section 1: Proposed Work Plan and Scope
APPROACH AND QUALIFICATIONS
The city of Tustin has completed a number of significant steps
towards moving the Corporate Yard project forward. Experience
has shown that the most successful projects involve integrating
project/construction managers with the design team at the
beginning of the project to ensure "lessons learned" from
our design and construction experience are applied very
early in advancing project in order to ensure and maintain
established budget and schedule compliance and maintenance.
Our Proposal includes working as the organization's project
and construction manager to provide design management,
conduct constructability reviews, and manage the project
schedule and budget. This will keep the project moving forward
successfully. Please note that in Griffin Structures' 35+ years
of business, we have never missed a budget nor a schedule.
PROPOSED WORK PLAN AND SCOPE
Building off previous efforts, Griffin's proposal is divided into
two phases, each with a number of essential tasks needed to
accomplish the proposed results.
Note: The design team, LPA, Inc., has provided a proposal to
Griffin Structures for their requisite design services. This proposal
is included as an attachment to our proposal.
The following discussion is a narrative of the proposed activities.
PHASE 1
The goals of Phase 1 include:
• We plan to continue our current
role in design managment to include the
design development (DD) and Construction
Document (CD) stages of project design and
architecture.
• Development of accurate and thorough
schedule updates and cost estimates for each of these
design stages.
• Management of design refinement and, if
needed, Value Engineering to assure alignment
of the design documents and the Citys
budget.
• On approval of drawings and budget,
Management of preparation of documents
suitable for later bidding of the project (Bid
documents are prepared in this phase, and
bidding/ selection of Contractor is included in the next
phase).
• Complete drawing package produced by LPA, Inc.
The following identifies our approach to achieving each of the
goals noted above.
1.01 Design Management thru Design Development (DD)
Coordinate and oversee the design services, per
the agreements between the City and its
Architect Team. Obtain City sign -off approvals
at the end of the end of Design Development. Costs,
schedules, and all subsequent project decisions

flow from the structured reviews and approval 1.05
points of the project.
1.02 DD Schedule Update
Update the Project Schedule throughout
the design process as required. Produce a
presentation of the project schedule
at the end of Design Development.
1.03 DD Budget
a. Review the Conceptual Project Budget
and ensure the Design teams adhere to it
throughout design.
b. Produce an accurate and complete project
budget at the end Design Development.
C. Provide DD -level value engineering
recommendations as may be appropriate
and recommend appropriate cost reduction
opportunities should that be necessary
to meet the Project Budget, including, for
example, selection of materials, building
systems,equipment, construction feasibility, availability
of materials and labor, schedule acceleration,
and any other opportunities for project economies.
1.04 DD Constructability Review
Perform constructability review of plans and
specifications near the end of Design
Development. Review the drawings and
specifications to eliminate areas of conflict.
Design Management through the completion of
Construction Documents, per the agreements
between the City and its Architect Team
a. Attend all project meetings between the
City and Architect to understand fully the
intent and objectives the City expects for
the project.
b. Review progress of the Design Team in weekly
project meetings, and review
milestone work products through the Design
Development and Construction Document phases.
C. Make formal communications with the
Design Team as to recommendations for
removal of all ambiguities and potential
Requests for Information.
d. Maintain a log of such communications and
other documentation of all changes during the
design process.
e. Make a final review of all plans and
specifications prior to release for bidding.
1.06 Pre-bid Constructability Review
Perform major constructability review of plans
and specifications in design development.
Review the drawings and specifications to
eliminate areas of conflict. Perform a series of

1.07 Pre-bid Project Schedule

project design. Publish to the City's Team

1.08 Construction Document Budget
Produce an accurate and complete 95% CD
project budget. Review the Design
Development Project Budget and provide
revision and update as required. Determine

a formal Value Engineering (VE) process as
may be appropriate to achieve the Project
Budget. Upon completion of CD, produce a final

1.09 Value Engineering
If required, implement a formal Value
Engineering process and manage its execution
and completion. Note that during the various
design phases, we review feasible alternative
design approaches with the City and
Architect. Griffin Structures will assess various
trade-offs given the project budget and demands
for aesthetics, program, construction
constraints (staging, security, safety, access,
etc.), and other project parameters.
1.10 Agency Approvals
Coordinate with all reviewing, permitting,
and oversight authorities to assure that the
Design Team obtains plan approval and permits.
Our Team has successfully built projects in the
city of Tustin and understand the process and
procedures of City government.
1.11 Construction Planning and Bidding
a. Assist the Architect in preparing the Bid
Docs and assist the City with bid process.
b. Griffin will schedule and host a Pre -Bid
conference to introduce interested bidders
to the project, communicate project
expectations, and properly orient the bidders
to allow for a smooth and protest free
bid environment. Griffin also can utilize
its extensive prequalification process if the
client is interested.
c. Using our extensive experience, Griffin will
review all bids to assure they are both
responsive and responsible and make
recommendations for award. Griffin will also
bring extensive financial analysis to identify
trends and/or strategies should the bids come
in over budget.
d. LPA will participate in the bid phase as identied in
their attached proposal.

guidance and management of Griffin Structures, in

• Design Development Cost Report The
SD Budget will be updated based on the elaborated
design development, and presented for City review.
• If Needed: Value Engineering Report. Based on
approval of the Design Development cost, there may
be a need to address budget constraints and
opportunities. This will be accomplished in a careful,
thorough, and accurate value engineering process.
• Project Schedule Update Summary schedule for
project delivery, based on inputs and scope of the
project as determined in the above Tasks.
• Construction Documents As prepared by
LPA, Inc. and their engineers, under the
management of Griffin Structures, in accordance
with the DD documents and associated
budget reviews. Please see LPA's attached proposal
for a list of deliverables they include for the design
development phase.
• Constructability Review Report At about
50% completion of the Construction
Documents, Griffin Structures will perform a
Constructability Review of these materials
to assure that the documents meet the highest
and best standards for the project, and are
consistent and complete in their preparation.
• Pre -Bid Cost Report An estimate of Probable
Cost based on 95% complete construction
drawings and specifications. The estimate of
probable cost will be based on the information
provided in the Design Documents noted above.

Justin DiRico has more than 15 years of experience in project and
construction management for a variety of product types including public
safety, civic, hotel, retail, higher education, K-12, hospital, and office
facilities. He has managed the design and construction of over one million
square feet of building space; administered sites requiring demolition; built
in occupied facilities; and managed budgets as large as $140 -million. Justin
has also led teams in the construction of multi -phased, complex sustainable
projects which included a significant solar photovoltaic installation at
various school district sites statewide.
Mr. DiRico responsibilities have included design phase management,
project management, project administration, coordination and scheduling
including risk assessments; quality control and surveying; review of
contractors' technical and safety adequacy; labor compliance; and overall
project documentation.
Additionally, Mr. DiRico is a Major in the United States Marine Corps
Reserve and holds a Military Occupational Specialty of Combat Engineer.
While on active duty, he served with the 1st Combat Engineer Battalion
stationed at Camp Pendleton, California. As a reservist, he served with 4th
Light Armored Reconnaissance Battalion and 2nd Battalion/23rd Marine

Section 3: Fee Proposal
Griffin Structures' Fee Proposal is based on all reasonable costs necessary to perform Project Management and A&E services for Tustin's
Corporate Yard project. Phase 1 is one of two phases, and necessary for the development of a complete design package and bid
package for the corporate yard project. Phase 2 will later focus on the construction management and administration of the project,
and is not part of the cost of this proposal.
Phase 1 includes management of the design process through Design Development and Construction Document phases, with schedule
and budget up -dates at each milestone. This phase ends with the preparation of a ready -to -bid plan set, detailed project schedule,
and complete pre-bid budget estimate.
The costs for the services we propose, for each of these phases is detailed on the attached Fee Schedule. We estimate the duration
of the total project to be 24 months with 12 months dedicated to construction (as part of Phase 2). In summary, we propose the
following fixed fee for execution of each phase of the work:
Phase 1- Project Management & Design Services: $805,040 (Eight hundred five thousand forty dollars)
Additional Reimbursables Expenses: $37,000
Optional Services (LEED Certification): $50,000
The proposed fee is fully burdened and includes overhead, profit, taxes, and benefits. We reserve the right to reallocate hours between
staff members and tasks in order to accomplish the overall objectives and requirements for the project. Proposal assumes a total project
cost of $14,200,000.
Our fee will be billed based on the attached Fee Proposal and Resource Allocation Project Schedule. Any extension of the schedule may
result in additional fee, in negotiation with the city of Tustin.
APPROACH TO FEE CALCULATION
As represented in the schedule, and in an attempt to bring cost efficiencies to this project and thus provide the City with a competitive
Fee Structure, we have based our proposal on the following approach:
1. Roger Torriero will serve as the Principal -in -Charge for the duration of the project and will provide whatever hours and services
deemed necessary to manage the project management staff and deliver a successful project to the city of Tustin. Currently we estimate
Roger applying 8 hours per month AT NO CHARGE TO THE CITY, which is equivalent to a valuation of $24,000 in contributional services.
2. Jon Hughes will serve as Project Executive for the duration of the project. Jon' s hours are allocated in the following manner:
a. Phase 1 Design Management: Jon will support this project at 48 hours per month through contractor bidding.
3. Justin Dirico will serve as Construction Manager for the duration of the project. His hours are allocated as follows:
a. Phase 1 Design Management: Justin will initiate services during the bid and award phase at 48 hours per month.
4. Jay Helekar will serve as Cost Estimator for the duration of the project. Jay will take the lead in establishing an updated estimate at the
completion of Design Development and and 95% CD's.
5. LPA, Inc. will serve as lead for the A&E Team for the duration of the project. Their fees can be found in their attached proposal and in
the fee proposal following this page.
QUALIFICATIONS AND EXCLUSIONS
1. Proposal excludes geotechnical services such as Phas2 1, Phase 2, ESA, Soils Report, etc.
2. Cost for all permits required for the project. It is assumed that the City will pay for all permitting fees, assessments, easements, school
fees, and other agency or governmental fees or costs to support the design and construction the project. We have not included permit
related fees within our proposal.
3. Costsfor Building and Public Works inspections, surveying, construction staking, soils compaction testing and inspections, environmental
and hazardous materials surveys, and all remediation costs. Services performed by the City or their desired outside consultant.
4. Software licenses or fees for specific project management software being required by either the City or their contractor(s).
5. Cost of bulk blueprinting for plans and specifications for use by the contractors and subcontractors. Funds included in reimbursable
expenses are for Griffin printing costs alone.
6. Wage Compliance Program including Certified Payroll auditing, field interviews, or reporting. It is assumed that the Dept. of Industrial
Relations will manage this effort at the State level should it be required on this project.
7. Independent or third party testing companies such as Roofing, Commissioning, Peer Reviews, LEED, or other specialized third party
oversight services.
8. This proposal assumes an overall project schedule starting in February 2016 through January of 2018, for a total of 24 months. Phase
1 services, however, will be completed in December 2016.
9. The hours identified for each individual employee and task are estimates only and are not to be construed as not to exceed hours for
any individual task or phase. We reserve the right to reallocate hours between staff members and tasks in order to accomplish the overall
objectives and requirements for the project within the overall Fee.
10. Hourly rates are valid through March of 2018 and will escalate by CPI annually
11. Extensions to the schedule resulting in additional PM or CM services will result in additional hourly compensation, to be negotiated
with the City.
12. No FF&E or OS&E is included in this proposal.
13. Construction Manager will review all RFI's and Submittals for completeness, approvals to be executed by the designer of record.
14. It is our understanding that the project will fall under a non-profit entity, therefore, at no cost to the City, and subject to Internal
Revenue Code 179D, (Deduction for Energy Efficient Commercial Buildings) the City agrees to allocate any applicable tax credits to Project
Manager (GSI Inc.) as may be relevant to 'public entity' projects.
15. Cost of insurance premiums will be based on $8/1,000 of each monthly gross invoice amount.

1 - DESIGN DEVELOPMENT SERVICES
In the Design Development Phase, LPA, INC. shall provide
those services designated necessary to prepare from the
approved Schematic Design Documents, for approval by the
City, the Design Development Documents consisting of
drawings and other documents to fix and describe the size
and character of the entire Project, including architectural,
structural, mechanical and electrical systems, materials and
such other elements as may be appropriate. Consideration
shall be given to availability of materials, equipment and labor,
construction sequencing and scheduling, maintenance
requirements and energy conservation. The following

In the furniture design and management phase of the project,
LPA shall provide the following services necessary to design

10 - CLIENT RESPONSIBILITIES:

habitat are not included in this proposal. It
is anticipated that the Client has the
