SUBJECT: FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - EDINGER AVENUE STORM
DRAIN IMPROVEMENTS BETWEEN DEL AMO AVENUE AND RED HILL AVENUE

RECOMMENDATION
It is recommended that City Council, at their meeting of July 15,
1991, adopt the attached resolution accepting said work authorizing
the recordation of the Notice of Completion.
Assuming no claims or stop payment notices are filed, it is further
recommended that 35 days after the date of recordation of the
Notice of Completion, that the Council authorize payment of the
final 10% retention amount of $40,443.47. This amount together
with previous payments of $363,991.25 represents 100% of the final
contract amount.
BACKGROUND
In September 1990, the City Council awarded the contract to Silveri
& LeBouef JV of Anaheim in the amount of $399,669.00. This project
provided for installation and construction of storm drain pipes,
junction structures, catch basins, and related pavement replacement
work on Edinger Avenue between Del Amo Avenue and Red Hill Avenue
to mitigate the flooding that typically occurs near the Santa Fe
railroad crossing during heavy rains.
The final contract amount on this project was $404,434.72. All
work has been completed as per the requirements of the plans and
specifications and to the satisfaction of the Public Works
Department.

RESOLUTION NO. 91-95
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ACCEPTING WORKS OF IMPROVEMENTS AND AUTHORIZING RECORDATION OF
NOTICE OF COMPLETION FOR CONSTRUCTION OF EDINGER STORM DRAIN
IMPROVEMENTS BETWEEN DEL AMO AVENUE AND RED HILL AVENUE
WHEREAS, Silveri & LeBouef JV, having a contract with the
City of Tustin to construct the hereinafter described public works
and improvements; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly.
described in accordance with the provisions of the contract
documents and the notice of completion, and acceptance of said
public work and improvement should be filed and payment of the
balance due of said contract authorized in accordance with the
contract documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said public work and improvement be, and the same is
hereby accepted. Said public work and improvement is more
particularly described as follows:
Installation and construction of storm drain pipes, junction
structures, catch basins, and related pavement replacement work on
Edinger Avenue between Del Amo Avenue and Red Hill Avenue to
mitigate the flooding that typically occurs near the Santa Fe
railroad crossing during heavy rains.
AND BE IT FURTHER RESOLVED that the City Engineer of the City
of Tustin be and is hereby authorized to execute and file a notice
of completion and acceptance of said public work and improvement
described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin on the 15th day of July, 1991.
