SUBJECT: TUSTIN CIVIC CENTER - SUBCONTRACTOR LISTING ERROR
RECOMMENDATION
It is recommended that the Redevelopment Agency find evidence that
there was a clerical error as stated in Dillingham's declaration
dated July 5, 1991 and approve Dillingham's request to list
Woodbridge Glass in lieu of A & J Glass due to the clerical error.
BACKGROUND
Bid documents for the Civic Center Expansion Project were received
on June 24, 1991. Award of the bid to Dillingham Construction is
anticipated on July 15th.
The City Council is being requested by Dillingham Construction to
consent to list Woodbridge Glass in lieu of A & J Glass due to a
clerical error in the bid documents by Dillingham. Dillingham
Construction is the low bidder on the Tustin Civic Center Project.
In their bid documents presented to the Agency on June 24, 1991 at
2:00 p.m., Dillingham listed A & J Glass on the subcontractor
listing sheet. The next day, Dillingham called the Project Manager
and verbally notified us that Dillingham had made an error in
listing A & J Glass. We were advised that Dillingham had based
their bid on Woodbridge Glass quotation received just prior to the
2:00 cutoff, but had forgotten to change the name of the
subcontractor on the listing sheet.
On June 26th, staff received written confirmation of this error
from Dillingham. We also received a written protest from A & J
Glass. Subsequently, staff has received declarations from
Dillingham and Woodbridge attesting to the validity of Woodbridge
Glass' quotation, and the circumstances leading to the clerical
error by Dillingham. Staff also reviewed other bidders lists and
found Woodbridge Glass listed.
The Project Manager has telephoned and interviewed Dillingham, A &
J Glass, and Woodbridge Glass on this subject. We have reviewed
the documentation with Deputy City Attorney John Shaw.

- Subcontractor Listing Error
Based upon the above evidence, it is recommended that the
Redevelopment Agency confirm and find that there was a clerical
error as stated in Dillingham's declaration dated July 5, 1991.
The City Council is advised by the Deputy City Attorney that
Dillingham Construction correctly followed the procedures for a
request of substitution of a subcontractor due to a clerical error
pursuant to Article 4107 Public Contract Code. In conclusion,
staff recommends approval of Dillingham Construction's request to
list Woodbridge Glass in lieu of A & J Glass due to a clerical
error.
