HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT/POLICE DEPARTMENT SUBJECT: BAIL SCHEDULE REVISION FOR TUSTIN CITY CODE RECOMMENDATION It is recommended that the City Council approve the Bail Schedule Revision (Exhibit A) to establish fines for certain violations of the Tustin City Code. BACKGROUND AND DISCUSSION In the past, citations with fines have been limited to various vehicle related violations only. In response to citizen concerns, the City Council approved the Southwest Neighborhood Improvement Program (SWNIP) intended to improve or maintain the quality of life currently enjoyed in Tustin. One of the SWNIP elements approved by Council included the development of an improved City Code enforcement program including a citation procedure for other types of code violations. Also, City Code amendments have been previously adopted by Council authorizing certain City officials to issue such citations. The establishment of a bail schedule is the final step needed to allow issuance of citations to afford a more expedient remedy of common code violations. Staff has prepared a bail schedule (Exhibit A) for Council consideration to supplement the existing Vehicle Code Bail Schedule currently in use by the County courts. The proposed Bail Schedule Revision identifies and describes a number of commonly occurring Tustin City Code sections. Other items identified on the schedule include: Degree - The Tustin City Code specifies a number of civil action remedies for violations (misdemeanor, infraction) . All code sections not specified in the Tustin City Code may be enforced by the City as either a misdemeanor or infraction. Bail Amount - Determined by survey of neighboring cites, County practice and at the recommendation of the Tustin Police Department. William Huston Re: Bail Schedule Revision July 29, 1991 Page 2 Penalty Assessment - The County requires an additional processing fee to be levied upon each violation at the time of posting bail. The current County penalty assessment is $17 for every $10 of City fine or portion thereof. Bail Forfeiture - If checked, permits the alleged violator to plead guilty and pay the noted fine without going to trial in a manner similar to most traffic citations. Proof of Correction - If checked, requires the alleged violator to correct the violation prior to court acceptance of bail forfeiture. Mandatory Appearance - Requires mandatory court appearance. The Tustin Bail Schedule requires some third time offenders to appear in court (designated by a 3). Also,. first time offenders of some of the more serious criminal violations are immediately required to appear in court (designated by a 1). In the interest of maintaining positive public relations and support, it should be noted that City Code enforcement staff will continue to pursue most code enforcement issues not related to safety through the current practice of giving violator a warning notice. Only as a last resort will staff be authorized to issue citations to uncooperative violators. We are confident that this valuable tool will greatly assist the City in meeting the goals established by Council for the Southwest Neighborhood Improvement Program. It should be noted that staff is also working on additional code amendments related to property maintenance. Once these amendments are complete, amendments for the attached bail schedule will be necessary. CONCLUSION The Community Development and Police Departments recommend that the City Council approve the Bail Schedule Revision (Exhibit A) to establish f ines for certain violations of the Tustin City Code and direct staff to forward said schedule to the County Court.
